Warren B. Diederich - Approved
Motion was made by Frank Lachowitzer, seconded by George Walter to approve the variance as requested. The
motion failed with John Everts, Randall Mann, and Cecil Femling voting no. It was noted that the granting of the
variance would allow a very substandard situation to become even more substandard. After much consideration and
discussion, motion was again made by George Walter, seconded by Frank Lachowitzer and carried with Randall Mann
and John Everts voting no, to allow the applicant to raise his existing boathouse by one foot. It was noted that the
granting of this variance request would provide the applicant with the ability to protect his property from the increased
water level.

property is described as the South Half and the South 10’ of the North Half of Lot 20 and all of Lot 21,
Pelican Point, Pelican Lake in Dunn Township. A letter from Lolita B. Hoffman in favor of the
applicant’s request was read for the record: After consideration, motion was made by Frank
Lachowitzer, seconded by George Walter to approve the variance as requested. The motion failed with
John Everts; Randall Mann, and Cecil Femling voting no. It was noted that the granting of the variance
would allow a very substandard situation to become even more substandard. After much consideration
and discussion, rnotion was again made by George Walter, seconded by Frank Lachowitzer and carried
with Randall Mann and John Everts voting no, to allow the applicant to raise his existing boathouse by
one foot. It was noted that the granting of this variance request would provide the applicant with the

I.A. and Bertha Rick - Denied
I.A. and Bertha Rick, Pelican Rapids, MN, requested a variance of 8’ from the required road right-of-
way setback of 20’ for the placement of a dwelling 12’ from the road right-of-way or approximately 45’
from the center of the road. The property is described as part of Government Lot 6, Section 1 of
Scambler Township by Pelican Lake. The audience was polled with Dale Larson and Robert Poolman
expressing concerns with the applicants’ request. Letters from the following individuals expressing
concerns with the applicants’ request were read for the record: John and Gretchen Marquart, Ben and
Joanne Ackerson, Paul and Sheila VVurzer and Al and Gladys Hovland. After consideration, motion
was made by John Everts, seconded by George Walter and unanimously carried, to deny the variance
as requested as no adequate hardship had been shown and a reasonable use of the applicants’
property can be made without the granting of a variance.
Allen Eckley Trust-Approved
Allen Eckley Trust, Fergus Falls, MN, requested a variance of 5’ from the required side lot line setback
of 10’ and a variance of 10’4” from the required road right-of-way setback of 20’for the placement of an
8’ by 12’ shed 5’ from the side lot line and 9’ 6” from the road right-of-way. The property is described as
Lot 7, Eureka Beach, Jewett Lake in Elizabeth Township. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by John Everts, seconded ji
by Randall Mann to deny the varianceVas requested as no adequate hardship had been shown and
adequate space forthe proposed shed does exist between the house and the garage. The motion
failed with Cecil Femling, Frank Lachowitzer, and George Walter voting no. After additional
consideration and discussion, motion was made by George Walter, seconded by Frank Lachowitzer
and unanimously carried, to approve the placement of an 8’ by 12’ shed up against the existing garage
extending 8’ towards the road right-of-way and being at least 10’ from the side lot line.

Dear Bill:
Good talking to you today and as I promised I am enclosing three pictures of my boat house on Pelican
Lake in Ottertail County.
On picture #11 hope that you can see there is about 5” of water in the boat house. On picture # 2 you
can see the banks on either side of the boat house. On picture # 3, because of the high water you can
see the amount of sand that washes up on a windy day.
I would like to raise the boat house 1 foot. After I raise it 1 will pour a new floor to keep water out.
With this kind of operation we can use the existing doors and utilities on the inside.
I would appreciate a response soon, if possible, so 1 could start the operation.

concerns over the high water. He noted that if nature could be modified in any way, it would be
appreciated.
Approval of Property Appraisal Service Agreements
Motion by Portmann, second by Lindquist, and unanimously carried to approve the following
service agreements for 1999 property appraisal services:

Request for Filing Extension for Final Plat
Land & Resource Director, Bill Kalar, presented a request from Kurt A. Maethner for an extension
for filing a final plat on MAET-BOH Development. Motion by Lindquist, second by Portmann, and
unanimously carried to approve an extension on the preliminary plat of MAET-BOH Development
in Clitherall Township until November 1, 1998.
Conditional Use Permit - Proposed Golf Course
Land & Resource Director, Bill Kalar, reported that approval of a CUP for a proposed golf course
(Charles & David Will, Stalker Lake, Tordenskjold Township) was conditioned upon a performance
bond. Additional staking of greens and tee boxes was required before a bond amount could be
set. Mr. Kalar informed Chuck Will of this requirement. This CUP has been pending for over a
year at this point and Mr. Kalar requested some type of resolution since Mr. Will has not contacted
the Land & Resource office.
Motion by Lindquist, second by Portmann, and unanimously carried to rescind the original approval
and deny the CUP of Charles and David Will as described above.
Request to Raise a Boathouse
Commissioner Lee reported that a request had been received to raise the foundation and wooden
portion of a boathouse on Pelican Lake due to the high water level - the floor of the boathouse is
flooding. Mr. Kalar noted that under the terms of the SMO, a site permit and variance would be
required because the outside dimensions would be changed.
Motion by Lee to waive the variance requirement for Warren Diederich on Pelican Lake to raise the
floor and the wooden portion of his boathouse due to excessive high water. The County Attorney
stated that the County Board does not have the authority to waive a variance requirement.
Chairman Lee withdrew the motion.
