Motion was made by Cecil Femling, second by Randall Mann and carried with John Everts and Mark Steuart voting no, to approve a variance to place a wooden deck, with a 36” safety rail, on top of the existing water orientated accessory structure with the condition that the existing stainway must be removed immediately after the installation of the new stairway and proposed deck. Hardship is the terrain and topography of the applicants’ property. It was noted that the steep slope of the property prevents the proposed deck from obstructing the view from the adjacent properties. It was also noted that the granting of this variance would not establish precedence for this area. The placement of the deck on top of the boathouse would j: ovide an area near the water for us to enjoy the lake without having to be in the water or on the r taining wall. The placement of a deck on top of the boathouse would als > provide an area for the more senior members of our family to rest during their climb from the 1 keshore to tire cottage. The slope from the lake to the cabin is fairly steep. The vertical rise i li approximately 20 feet in a horizontal distance of approximately 55 feet. Without a re iting area, the climb from the shoreline to the cottage for physically challenged individuj s is very difficult. The deck would significantly reduce this hardship by providing a conveniei: resting point on trips to and from the cottage. In addition, the deck would make the top of the boathouse nore visually appealing. The flat roofed top of the boathouse, which is visible from the cotti je, is covered with a black tar like substance. The wooden deck would completely hide the t< 3 of the boathouse from view. The existing boathouse was built over 20 years ago and is onstructed of poured concrete vvalls approximately 9 inches thick with a reinforced concrete sli ) roof approximately 6 inches thick. The roof is sealed with a black tar substance, which is visil le from the cottage. The boathouse is located in the southwest portion of the lot. The boathouse is not directly in the neighbors line of sight because of the location of their WO AS which is local :d approximately the same distance from the lot line as our boathouse and is S to 10 feet taller. : tback standards from the OHWL and ; of the boathouse and the slope of the 1 August 19,1998, Midwest Testing Our existing boathouse is not in compliance with current s lot lines. Because of the materials used in the Constructioi land, it is not possible to remove the existing structure. Oi Laboratory, Inc. conducted soil evaluations that indicated ' le integrity of the slope might be compromised if the concrete is removed. Therefore, reloc tion or removal of the boathouse docs not appear to be prudent. rt directly on top of the boathouse. However, the deck would not be ad dowTi from the deck to the water. The proposed deck will be constructed of wood and will n There will be a safety rail around the perimeter of the dec! roofed, screened or enclosed in any way. A stairway will 1 SEAGULL ENERGYJUL.12'1999 18:22 713 951 1344 #2104 P.003/004 Another stairway will lead firom the deck up the slope to th cottage. The stairway from the deck to the cottage will be partially hidden from view from the I ke by trees that are located on the slope between the boathouse and the cottage. If granted, this request will not exacerbate the variances to at line and shoreline standards that have existed for more than 20 years. By allowing us to pU :e a deck on top of the existing boathouse, you will enhance the natural beauty of this area ind you will provide a less physically changeling access to the lakeshore for all members of our f mily. In addition, by placing a wooden deck on top of the black tar roof of the boathouse, ve will make this area considerably more visually appealing. Members of the Board of Adjustments or their designated i :pre$entatives are cordially invited to visit the property to get a better understanding of the excep ional circurn stances that are precipitating this request.
