After discussion and consideration, Steve Schierer made a motion, second by Paul Larson and unanimously carried, with the applicant’s verbal permission, to table this request until the next scheduled meeting of the Board of Adjustment to provide the applicants with an opportunity to consider other alternatives (size and location) that would keep the proposed development out of the shore impact zone and that would limit impervious surface coverage for the proposed development (structure and driveway) to 25 percent or less. It was noted that the applicants already have one structure within the shore impact zone. It was also noted that the applicants’ property is a substandard lot of record, which might not support the development being proposed. May 7, 2009 Meeting - Darryl Hirsch presented two letters of support from Kenneth Erickson and George and Wanda Dutton. After consideration and discussion, Steve Schierer made a motion, second by Paul Larson and unanimously carried, to approve the construction of a 22’ by 24’ garage 50’ from the ordinary high water and at least 10’ from the side lot line with the condition that no more than 25% of the total lot area can be covered with impervious surfaces. (7:45 p.m.) Richard and Maxine Lindberg, part of Lot 1 Block 1, Pischke and Taylor First Addition, Spitzer Lake in Leaf Mountain Township, requested the following: Per applicant - new roof on existing cabin and planned 16’ by 24' addition cannot meet 200’ setback. Added by Land and Resource Department - Need variance for 100' setback from lake and 160' setback from lake bed for new roof on existing cabin and proposed 16’ by 24’ addition. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Paul Larson made a motion, second by Thomas Lee and unanimously carried, to approve the proposed development as described in the variance application dated April 13, 2009 and as depicted on the drawing submitted with the variance application. It was noted that the proposed development will be no closer to the ordinary high water level than the existing structure and that part of the proposed development will be maintenance to the existing structure. Hardship/practical difficulty is a substandard lot of record. Darryl and Deb Hirsch - Approved the construction of a 22’ by 24’ garage with a condition. (7:50 p.m.) Darryl and Deb Hirsch, Lots 69 and 70 Midland Beach, Little Pelican Lake in Dunn Township, requested a variance of 66' from the required ordinary high water level setback of 100’ and a variance of 5’ from the required lot line setback of 10’ for the placement of a 26’ by 26' garage 34’ from the ordinary high water level and 5' from the south property line. Jeanna, the applicant’s daughter appeared at the public hearing with her father, April 9, 2009 Meeting - The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, second by Paul Larson and unanimously carried, with the applicant's verbal permission, to table this request until the next scheduled meeting of the Board of Adjustment to provide the applicants with an opportunity to consider other alternatives (size and location) that would keep the proposed development out of the shore impact zone and that would limit impervious surface coverage for the proposed development (structure and driveway) to 25 percent or less. Land and Resource Request- Mark Ronning, Land and Resource Department, presented the following application that had been previously heard by the Board of Adjustment on Thursday, September 4, 2008: Robert and Sandra Fagen - Approved the variance as requested with a condition. (6:45 p.m.) Robert and Sandra Fagen, part of Government Lot 3, Section 2 of Dead Lake Township by Marion Lake, requested the following: We would like to put a home 24' by 36' with attached garage 16' by 24' and an attached breezeway 10' by 24' on our lot on Marion Lake, Also, relocate our existing 8' by 12' storage shed. We are requesting a variance of a 20' setback from the 75' setback placing new dwelling 55' from ordinary high water level due our substandard lot of record and terrain of lot. Our existing cabin will be removed upon completion of our new dwelling. The proposed new cabin will be 33' farther from the lake than the existing cabin. The audience was polled with no one speaking for or against the variance as requested. After consideration, Paul Larson made a motion, second by Steve Schierer and unanimously carried, to approve the variance as described in the variance application dated July 28'^, 2008 and as depicted on the drawing submitted with the application with the condition that the existing cabin must be removed on or before August 1,2009. It was noted that the size of the proposed development is reasonable and that the proposed development will be an improvement to the property. The practical difficulties/hardships are the terrain and configuration of the applicants’ property. The Board of Adjustment considered the following applications for variance; Darryl and Deb Hirsch - Tabled (6:31 p.m.) Darryl and Deb Hirsch, Lots 69 and 70 Midland Beach, Little Pelican Lake in Dunn Township, requested a variance of 66’ from the required ordinary high water level setback of 100’ and a variance of 5’ from the required lot line setback of 10’ for the placement of a 26’ by 26' garage 34’ from the. ordinary high water level and 5’ from the south property line. Jeanna, the applicant’s daughter appeared at the public hearing with her father. The audience was polled with no one speaking for or against the variance as requested. Deborah and John Garner - Approved the application as modified. (6:43 p.m.) Deborah and John Garner, Sub Lot 7 of Government Lot 3, Section 27 of Rush Lake Township by Round Lake, requested the following: This application for variance is an amendment to the variance request approved at the 10/2/08 Board of Adjustment meeting. It is still our intention to demolish and remove the.existent cabin and garage in Area "A” with no variances required. After another survey was completed delineating the Rush Lake Township cart way, the approved variance requests are now only partially accurate for placement of the garage in Area ”C”. The garage will still be placed in the same area as initially proposed, but will now be downsized to 20’ by 40’. Also note the existent road (in yellow) within the designated cart way. We will still accept the approved 3’ variance from the 10’ minimum structure setback on the east lot line, the 13’ variance from the 20’ setback from the cart way on the NW Corner of the garage, and the 12’ at point “D” (on plan); however, we’ve adjusted the other requests as follows: Option 1 - (1) a 20’ variance from the 20’ setback from the cart way on the SW corner of the garage, and (2) a “varying” variance from the 20’ minimum setback of the cart way for the N side of the garage, ranging from 12’ at point “D” (on plan) down to 6’ at point “E” (on plan). Because Option 1 provides for no room between the legal edge of the cart way and the SW corner of the garage, the following second option allows us to move the garage closer to the east lot line. Option 2 - We would still accept the 13’ variance from the 20’ setback from the cart way on the NW corner of the garage, and the 12’ at point “D” (on plan). The variance requests would be adjusted to: (a) a 6’ variance from the 10’ minimum structure setback on the east lot line, (b) a 16’ variance from the 20’ setback from the cart way on the SW corner of the garage, and (c) the requested variance (2) from the above-mentioned Option 1. Katrina L. Wass, Attorney, represented the applicants at the public hearing. The audience was polled with no one speaking for or against the variance as requested. A letter from Carole Baker expressing concerns with the variance application was read for the record. After discussion and consideration, Steve Schierer made a motion, second by Rick Wilson and unanimously carried, to approve the placement of either a 16’ wide by 40’ long structure or a 20’ wide by 30’ long structure 7’ of the easterly lot line (3’ variance) with the northerly side of the proposed structure in the location as identified on the drawing dated March 9, 2009, which was submitted with the applicants’ variance application. The hardship/practical difficulty is the ingress/egress road which divides the applicants’ property both vertically and horizontally preventing the applicants from enjoying the same rights and privileges as other in this immediate area could enjoy if they decided to construct a storage building on the back portion of there property. (7:30 p.m.) Jill Green, Lot 5 Block 2 Sportsman’s Landing, Jewett Lake in Elizabeth Township, requested a variance to change lot size to less than 40,000 square feet. The current size of Lot 5 Block 2 is 40,138 square feet. Would like to sell 4,700 square feet to an adjacent property owner and retain as a buildable lot the remaining 35,438 square feet. The 4,700 square foot tract would be permanently attached to the adjacent property owner’s 100’ by 100’ parcel. The audience was polled with Michael Andvik speaking for the variance as requested. After discussion and consideration, Cecil Femling made a motion, second by Michael Harris and unanimously carried, to deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested and noting that approval of the variance as requested would create a substandard back lot. Francis and Janice Dehmer - Approved modified building setback with a condition. (7:38 p.m.) Francis and Janice Dehmer, South Half of Lot 3, Sun Rise View Beach, Lake Lida in Lida Township, requested a variance of 25’ from the required ordinary high water level setback of 75’ for the placement of a 40’ by 28’ mobile home 50’ from the ordinary high water level. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, second by Paul Larson and unanimously carried, to approve the placement of the proposed 28’ by 40’ dwelling at a location starting 12’ from the septic tank and extending no more than 40’ towards the ordinary high water level with the condition that the applicants must comply with all other setback requirements of the Shoreland Management Ordinance. James Michael Caliandro—Tabled. (7:50 p.m.) James Michael Caliandro, part of Government Lot 9, Section 25 and part of Government Lot 5, Section 26, Sverdrup Township by North Turtle Lake, requested a variance to subdivide three existing metes and bounds parcels totaling 5.18 acres into two tracts. One tract would contain approximately .250’ of frontage and two acres of area and the other tract would contain approximately 550’ of frontage and 3 acres of area. The minimum size required for metes and founds parcels within the shoreland area is 5 acres and the minimum size required for platted lots within the shoreland area is 200’ of frontage and 80,000 square feet of area. The audience was polled with Jourdan Sullivan speaking in opposition to the variance as requested and expressing concern with the amount of development on natural environment lakes within Otter Tail County. After discussion and consideration, Steve Schierer made a motion, second by Michael Harris and unanimously carried, to table, with the verbal permission of the applicant, this variance hearing until the July 6, 2006 Board of Adjustment meeting to provide the applicant an opportunity to consider the possibility of platting the property. Daryl and Deb Hirsch - Approved the variance application as requested with conditions. (8:10 p.m.) Daryl and Deb Hirsch, Lots 69 and 70, Midland Beach, Little Pelican Lake in Dunn Township, requested a variance of 89’ from the required ordinary high water level setback of 100’ for the placement of a 10’ by 26’ 4” addition to the north side of the existing structure 11 ’ from the ordinary high water level. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Randall Mann made a motion, second by Steve Schierer and unanimously carried, to approve a variance of 89’ from the required ordinary high water level setback of 100’ for the placement of a 10’ by 26’ 4” addition IT from the ordinary high water level as described in the variance application dated May 9, 2006 and as depicted on the drawing submitted with the variance application with the following conditions which must be met before a site permit for the addition can be issued 1.) the most northerly existing shed must be removed from the applicants’ property, and 2.) thelO’ by 10’ shed closest to the existing dwelling must be placed in a location to the rear (roadside) of the existing cabin with the condition that it must be placed at least 10’ from the dwelling.1 *; Daryl and Deb Hirsch - Approved the variance application as requested with conditions. (8:10 p.m.) - Continued The variance as approved does not directly or indirectly grant variances from the required side lot line, septic system or well setback requirements but does grant the variances necessary from the required road right-of-way setback and ordinary high water level setback to enable the applicants the ability to place the 10’ by 10’ shed between the rear (roadside) of the dwelling and the road. It should be noted that instead of moving the existing 10’ by 10’ shed to the authorized location the applicants can choose to place a new structure in the authorized location, however, that would required that the shed closest to the existing dwelling must be removed. Hardship is a grossly substandard lot of record, the terrain and the unique shape of the applicants’ property. Robert and Phyllis Narveson - Approved the variance application as requested. (8:23 p.m.) Robert and Phyllis Narveson, part of Government Lot 5, Section 6 of Girard Township by Blanche Lake, requested a variance of 49’ from the required ordinary high water level setback of 100’ for the placement of a 12’ by 18’ addition on the southeast side of Cabin Number Nine 5T from the ordinary high water level and a variance of 58’ from the required ordinary high water level setback of 100’ for the addition of a deck to Cabin Number Nine 42’ from the ordinary high water level. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Cecil Femling made a motion, second by Paul Larson and unanimously carried, to approve a variance of 49’ from the required ordinary high water level setback of 100’ for the placement of 12’ by 18’ addition on the southeast side of Cabin Number Nine 5T from the ordinary high water level and a variance of 58’ from the required ordinary high water level setback of 100’ for the addition of a deck to Cabin Number Nine 42’ from the ordinary high water level. It was noted that neither of the proposed additions will be any closer to the ordinary high water level than the existing dwelling or deck. Hardship is the terrain of the property. The proposed development to Cabin Number Nine is similar to the use of the other structures in this immediate area. Y&M Properties - Approved the variance application as requested. (8:27 p.m.) Y&M Properties, Lot 1 Block 1 Y and M Properties, Lake Ida in Candor Township, requested a variance of 124’ from the required ordinary high water level/aquatic vegetation setback of 200’ for the placement of a dwelling 76’ from the aquatic vegetation. Robert Maneval represented Y&M Properties at the public hearing. Dennis Craswell, the potential buyer, appeared along with the applicant. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Randall Mann made a motion, second by Steve Schierer and unanimously carried, to approve a variance of 124’ from the required ordinary high water level/aquatic vegetation setback of 200’ for the placement of a dwelling 76’ from the aquatic vegetation as depicted on the drawing submitted with the variance application. Hardship is a substandard lot of record and the terrain of the applicant’s property. It was noted that the variance as approved will provide a reasonable use of the property and the proposed location is perhaps the best location for the proposed development. It was also noted that the applicant does have a legal site for the placement of a septic system. James and Anne Melville - Tabled. (8:42 p.m.) James and Anne Melville, Lot 27 Fair Oak, West Battle Lake in Girard Township, requested a variance of 20’ from the required ordinary high water level setback of 75’ for the placement of a dwelling 55’ from the ordinary high water level. Andy Pettow, Contractor, appeared with the applicant at the public hearing. The audience was polled with no one speaking for or against the variance as requested. Letters from Douglas and Karen Wagner, Jim and Lois Ales, David Hansen, Lori and Curtis Johnson, and Dan and Karleen Goodman in support of the variance as requested were read for the record. After discussion and consideration, Paul Larson made a motion to approve the variance as requested with the condition that no more than 25% of the total lot area can be covered with imperious surfaces.
