Motion was made by Cecil Femling, seconded by George Walter and carried with Randall Mann and John Everts
voting no, to approve a variance of 2’ 6” from the required 18’ maximum height of a non-dwelling for an existing
structure having a height of 20’ 6". The Board of Adjustment directed that a letter be sent to Craig D. Helenske,
Architect, informing him of Otter Tail County’s building requirements. It was noted that the design of the structure
matches the design of the applicants other structures.

Dear Mr. Collins,
Yesterday it was brought to my attention that a new garage had been constructed
on your lot without a Site Permit being issued. During my onsite visit, I found that
while the garage is legally located, it does exceed our 18’ maximum non-dwelling
height restriction.
Because of the height issue, we cannot give you the required Site Permit until one
of the following is done:
1. The garage is lowered tolmeet the 18’ height limit.
2. A variance is applied for and granted to allow the garage height to remain
as is. All other Site Permit;requirements must be met .if the Variance is
approved.
Please contact me by September 3, 1998 regarding this matter.

Dear Kyle,
I apologize for not applying prior to construction of my
garage. I must plead ignorance. I thought the construction
permit issued for my new house inciuded the repositioning of my
carport. The carport was pre-existing, we moved the buiiding
approximateiy 22 feet south, weli within the aliowable property
set back and enclosed the structure.
Vertically, the structure was raised approximately 30” to a
height of 20 feet. I was not aware of a height restriction
regarding the structure.
We would appreciate a variance for the following
reasons:
1. Garage door/height is 10 feet. If we lower the
structure, the available garage door clearance will be
reduced to 7 Vt. feet, which renders the structure
virtualiy unusable for boat or vehicle storage,
2. The garage is surrounded by mature trees with
vertical heights exceeding 40 feet, which sufficientiy
seciudes the structure from the road.
3. The vertical height of the gatjage in relationship to the
home and lot position, effectively balance both
structures.
4. The codes and ordinances employed in most other
communities in Minnesota, define building height on a
gabled structure as the height midway between eave
and ridge. The State Building code (Section 209 of
the Uniform Building Code) defines building height of
a gabled or hip roofed structure as the vertical height
from grade to the average height of the roof. This
idefinition would result in a structure height of
approximately 15’ 3” for our proposed garage. Such a
definition would be cohsisterpt with other jurisdictions
in the area. Therefore, under the state code
definition, the structure conforms to the standard.
We have complied with aii aspects of the county building
code and have constructed a facility which provides value
to the lake and I am confident our neighbors would not
register any objection to the height of the structure.
Therefore, we respectfully apologize for our
oversight regarding the permit and request a variance be
issued to allow the structure to remain at the constructed
height.
