Milton Lee - Denied
Motion was made by Randall Mann, second by Bert Olson and unanimously carried, to deny the variance as
requested and as modified by the applicant at the public hearing as no adequate hardship had been shown unique to
the property that would allow for the granting of the requested variance. It was noted that changing the use of an
existing building might be an alternative for the applicant’s consideration if the desired space for storage is critical for
the applicant.

Mary Ellen Frey, Jamestown, ND, notes that the structure that stands on the property is a two-story
structure. The roof leaks severely and has caused rotting and must in lower level. Because of this our
plan is to tear the top story off and replace the existing structure with a log structure. The existing
structure is 24’ by 28’. The proposed structure is 42’ by 48’ and is approximately 28’ from the ordinary
high water level. The required ordinary high water level setback is 100’. The property is described as
the Westerly 30’ of Lot 4A, all of Lot 5A, part of Lot 6A of the Survey Lots of Government Lot 10,
Section 7 of Hobart Township by Lake Seven. Eric Anderson, contractor, appeared along with the
applicant at the public hearing. The audience was polled with no one speaking for or against the
request. After consideration motion was made by Cecil Femling to approve a 40’ variance or a 60’
ordinary high water level setback with the condition that the Land and Resource Department review the
property for the existence of a bluff. This motion was withdrawn. After additional discussion and
consideration, motion was made by John Everts, second by Cecil Femling, to approve the placement of
the proposed development no closer than 10’ back from the second tier break, which is assumed to be
approximately 90’ from the ordinary high water level. Hardship is the terrain and topography of the
applicant’s property, which makes development and a reasonable use of the property difficult without a
variance. This motion failed with Bert Olson, David Holmgren and Randall Mann voting no. After
additional discussion and consideration, motion was made by Cecil Femling, second by John Everts
and unanimously carried, to approve residential development of this property with the condition that the
applicant or the applicant’s representative must meet on-site with representatives of both the Land and
Resource Department and the Department of Natural Resources to determine the best type of
development and the best location for the placement of this residential development so that the
applicant will have a reasonable use of her property. The previously mentioned hardship was noted.
Milton Lee - Denied
Milton Lee, Ada, MN, requested a variance of 10’ from the required holding tank setback of 10’, a
variance of 3’ from the required lot line setback of 10’ for the placement of an 8’ by 10’ utility shed 0’
from the holding tank and 7’ from the lot line. The property is described as Lot 3, Linden Park, Pelican
Lake in Dunn Township. The audience was polled with no one speaking for or against the request.
After consideration motion was made by Randall Mann, second by Bert Olson and unanimously carried,
to deny the variance as requested and as modified by the applicant at the public hearing as no
adequate hardship had been shown unique to the property that would allow for the granting of the
requested variance. It was noted that changing the use of an existing building might be an alternative
for the applicant’s consideration if the desired space for storage is critical for the applicant.
Matt Wolfe - Approved as requested.
Matt Wolfe, Anoka, MN, requested a variance to add to an existing roof so insulation can be added. I
want to add 2” by 8” on edge on top of the existing roof. The cabin is within the current setback from
the lake. Per the applicant’s drawing the ordinary high water level setback is 77’. The required
ordinary high water level setback is 100’. The property is described as Lot 2, Block 7 and Lot 7, Block
6, Leaf Lake Pleasure Grounds, Section 22 of Leaf Lake Township by West Leaf Lake. The audience
was polled with no one speaking for or against the request. After consideration motion was made by
Cecil Femling, second by David Holmgren and unanimously carried, to approve the variance as
requested noting that the applicant’s request is very reasonable and will allow him the ability to add
insulation to the roof area.
