the applicant's request until the November 2nd, 1995, meeting.
Motion was made by Craig Anderson, seconded by Cecil Femiing and unanimously carried, to
approve a variance of 4' from the recjuired holding tank setback of 10' for the construction
of 1 16' by 20' shed 6' from the holding tank. It was noted that this is an unoccupied

Dale W. Muckey - Approved
Dale W. Muckey, Dent, MN, requested a variance of 106’ from the required ordinary high water level
setback of 200’ and a variance of 6’ from the required shore impact zone setback of 100’ for the
placement of a mobile home 94’ from the ordinary high water level. The property is described as Sub
Lot A of Government Lot 5, Section 28 of Edna Township on North Rice Lake. The audience was not
polled as their was no one in the audience at the time of this hearing. After consideration, motion was
made by Randall Mann, seconded by Cecil Femling and unanimously carried, to approve a variance of
106’ from the required ordinary high water level setback of 200’ and a variance of 6’ from the required
shore impact zone setback of 100’ for the placement of a mobile home 96’ from the ordinary high water
level with the following conditions:
1. All structures between the mobile home and the ordinary high water level must be removed,
2. The sewer system must be brought into compliance with existing code, and
3. The well pit must be covered and maintained in a manner that provides safety for the public.
Milt R. Lee - Approved
Milt R. Lee, Ada, MN, requested a variance of 4’ from the required holding tank setback of 10’ for the
construction of a 16’ by 20’ shed 6’ from the holding tank. The property is described as Lot 3, Linden
Park on Pelican Lake in Dunn Township. The audience was not polled as their was no one in the
audience at the time of this hearing. After consideration, motion was made by Craig Anderson,
seconded by Cecil Femling and unanimously carried, to approve a variance of 4’ from the required
holding tank setback of 10’ for the construction of a 16’ by 20’ shed 6’ from the holding tank. It was noted
that this is an unoccupied structure. Hardship being a substandard lot of record.
Martelle B. Sherman - Tabled
Martelle B. Sherman, Richville, MN, requested a variance of 4’ from the required side lot line setback of
10’ for the placement of a 12’ by 20’ garage 6’ from the side lot line. The property is described as Lot 7,
Beauty Beach, Otter Tail Lake in Amor Township. Due to inclement weather in the area the applicant
was unable to attend the variance hearing. After consideration, motion was made by Randall Mann,
seconded by Cecil Femling and unanimously carried, to table the applicant’s request until the next
scheduled meeting.
Russell H. Sauer - Reconsideration
Russell H. Sauer appeared before the Board of Adjustment to request a reconsideration of a variance
previously approved by the Board of Adjustment on May 4th, 1995. After discussion and consideration,
motion was made by Randall Mann, seconded by Robert Schwartz and carried with Craig Anderson
voting no, to grant an additional 3 months (until September 1st, 1996) for the installation of a certified
sewage system.
William L. Weitzel - Approved
William L. Weitzel, Wahpeton, ND, requested a variance of 8’ from the required ordinary high water
level setback of 75’ and a variance of 72’ from the required ordinary high water level setback of 200’ for
the placement of an addition to an existing dwelling 67’ from West Battle Lake and 128’ from Beauty
Shore Lake. The property is described as part of Government Lot 3, Section 20 of Girard Township
between West Battle Lake and Beauty Shore Lake. Tim Schmidt represented the applicant at the public
hearing. The audience was polled with no one speaking for or against the request. After consideration,
motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve the
proposed addition with the condition that it be no closer to either lake than the existing structure. It was
noted that the addition should be constructed in the shadow of the existing dwelling on the east side of
the structure.

public hearing. The audience vas polled vith no one speaking for or against the request.
After consideration, motion was made Randall Mann, seconded by Cecil Femling and
unanimously carried, to deny the variance as requested as no [adequate hardship had been
shown and the granting of the variance would create grossly substandard parcels.

setback of 50' for the replacement of an existing mobile home [with a 24' by 42' dwelling,
having a 10' by 10' utility room addition, 45' from the ordinary high water level with
the conditions that the existing trailer house must be removed and the existing cabin to
the west of the proposed location must be torn down or removed from the property by the:iIt was noted that two dwellings are being replaced by one dwelling.Fall of 1996.

Glen Homei Bolatad - Tabled
Glen Homer Bolstad, Battle Lake, MN, requested a variance ;to subdivide, without platting,
3 - 2.5 acre parcels from an existing 62 acre parcel. These parcels would be considered
backlots and each parcel would have approximately 260' of frontage. The ininirnuin size for
platted backlots on a recreational development lake is 80,000 square feet of area and 300'
of frontage.'lot width. The property is described as the Northeast 1/4 of the Southwest
1/4, part of Government Lot 3 and part of Government Lot 13, Section 35 of Tordenskjold
Township on Stalker Lake. Sherry and Janet, the applicant's daughters, represented their
father at the public hearing. The audience was polled with no one speaking for or against
the request. After consideration, motion was made by Randall Hann, seconded by Craig
Anderson and unanimously carried, to table the variance request until the applicant has an
opportunity to have the property being proposed for subdivision surveyed. The Board of
Adjustment is requesting additional information regarding lot line locations and the
areount of property remaining in the original parcel after the subdivisions.

approximately 62’ from the ordinary high water level. The property is described as Lot 1,
Block 1, Walida Heights, Big McDonald Lake in Edna Township. The audience was polled with
no one speaking for or against the request. After consideration, motion was made by Craig
Anderson, seconded by John Everts and unanimously carried, to table the variance request
until the November 2nd, 1995, meeting to allow the Land and Resource Department an
opportunity to determine if the applicant's property is affected by a bluff. The Land and
Resource Department determined that the applicant’s properlty does not contain a bluff.
After additional consideration, motion was made by Craig Anderson, seconded by Leslie
Estes and unanimously carried, to approve a variance of 28’ from the required ordinary
high water level setback of 100' for the construction of a 30' by 60' structure no closer
than 72’ from the ordinary high level. Hardship being the, steepness of the applicant’s
property with sensitive areas for erosion. |

subdivide a parcel of approximately 2.5 acres from an existing 6S.45 acre parcel with the
condition that a registered surveyor's drawing must be provided at the time of conveyance.
It was noted that the parcel has public road access and room for two on site septic
systems.
Esther Trigg - Approved
Esther Trigg, Pelican Rapids, MN, requested a variance to subdivide a parcel of less than
5 acres from an existing 1.02 acre parcel. The parcel will be approximately 65’ wide and
55' deep and will be permanently attached to the adjacent property owned by Wayne A.
Haugrud. The property is described as part of Government Lot 2, Section 11 of Pelican
Township on Prairie Lake. The applicant was represented at the hearing by Wayne and Donna
Haugrud. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by Cecil Femling, seconded by John Everts and unanimously
carried, to approve a variance to subdivide a 65’ wide by 55' deep parcel from an existing
1.02 acre parcel with the condition that it be permanently attached to the adjacent
property owned by Wayne and Donna Haugrud. The granting of the variance squares off the
property currently owned by Wayne and Donna Haugrud.
