We are requesting a variance to add to our existing deck the new addition to deck will be 5' from
property line and no closer to the lake than existing. This will allow us to utilize deck better creating
safer access and better traffic flow. With this request we are proposing to remove another portion of
the deck and a portion of our existing sidewalk this will bring our impervious surface which is currently
at 40.25% down to 38.71%.

After consideration and discussion, Terry Marthaler made a motion, seconded by Michael Donoho and carried by roll
call vote to approve the variance as requested to do a 30” addition to the existing deck being 5’ from the NE lotline and
to approve the impervious surface reduction to 38.71% with the removal of a portion of the deck and sidewalk. This
decision is also based on the Findings of Fact and Decision Form, which contains the criteria reviewed and the Board’s
finding have been attached to and incorporated as an official part of the minutes which have been placed on file with
the Land & Resource Management Department. The variance as approved does not directly or indirectly grant any
other variances for future development.

Requested Variance: We are requesting a variance to add to our existing deck the new addition to deck will be 5' from
property line and no closer to the lake than existing. This will allow us to utilize deck better creatine safer access and

A variance may be granted only where the strict enforcement of county land use controls will result In a "practical difficulty". A
determination that a practical difficulty exists is based upon consideration of the following criteria:
The applicant identified the following practical difficulty: Want to make the deck larger for convenience and because of the traffic
coming from the doorway and want to increase by 33" which will allow them to put a table on the deck. They will be removing
impervious surface. Both neighbors are in support of our variance request.

The Board of Adjustment may impose conditions in the granting of variances. A condition must be directly related to and must bear
a rough proportionality to the impact created by the variance. (Mitigating impervious surface with storm water management, deep
rooted vegetative buffers, rain gardens, etc.)
It is the Board of Adjustment's job to apply appropriate legal standards to a specific fact situation. Variances are meant to be an
infrequent remedy where an ordinance imposes a unique and substantial burden.

requesting a variance to add to our existing deck the new addition to deck will be 5’ from property line and no closer to the lake than
existing. This will allow us to utilize deck better creating safer access and better traffic flow. With this request we are proposing to
remove another portion of the deck and a portion of our existing sidewalk this will bring our impervious surface which is currently at

home by replacing 20’ x 30’ garage to living space and adding 28’ x 48’ garage which begins at 55’ from OHWL.
Danny Flanson, property owner represented the variance application. The audience was polled with no one speaking for or against the
variance application.
After consideration and discussion, Thomas Lee made a motion, seconded by Michael Donoho and carried by roll call vote to approve
the variance to replace the 20’ x 30’ garage and make it living space and add a 28’ x 48’ garage being 55’ from the ordinary' high
water level. This decision is also based on the Findings of Fact and Decision Form, which contains the criteria review ed and the
Board’s finding have been attached to and incorporated as an official part of the minutes w hich have been placed on file w ith the Land
& Resource Management Department. The variance as approved does not directly or indirectly grant any other variances for future
development.

In addition to the five criteria required in MN Statute 394, the Otter Tail County Shoreland Management Ordinance allows the
Board of Adjustment the option to consider the following while deciding on a variance request:
1. Whether the variance will secure for the applicant a right or rights that are enjoyed by other owners in the same area.

approved.
3. Whether granting the variance will be contrary to the public interest or damaging to the rights or other persons or to
property values in the neighborhood.

NOTES
1.) We anticipate removing the deck section shaded in a darker beige, as a condition for securing
approvai for the proposed expansion of the deck. We wouid be removing impervious structures currentiy in
piace that cover 116 square feet and wouid be adding 43.20 square feet of new impervious structure from
the expansion of the deck. This change in the percentage of the lot covered by an impervious structure wouid
decline from 40.25 % to 38.71 %. This is not a large reduction in the percentage of the lot covered by
impervious structures Oust under a 2% reduction of the total presently covered), but it is an improvement
that would not otherwise occur. And it is almost twice the square footage of the lot covered by the proposed
deck enlargement itself.
We understand that Board Members may at their individual discretion decide to visit the property
involved in this request for a variance. A staff member suggestedthat we plant some marking flags to
designate where the proposed deck extension would be located and which might illustrate visually the space
which would be the area of the proposed deck expansion. I will mark the area with blue flags. Blue is a color
not used for underground electrical, gas, fiber optic, or by any other utility service we know of and is
therefore unlikely to be confused with flags used to mark any other activity that would be flagged.
2.) We anticipate removing the sidewalk section shaded in a darker blue, as a condition for securing
approval for the proposed expansion of the deck. We would be removing Impervious structures currently
88.16 square feet and adding 43.20 square feet of the new enlargement of the deck. This change would
reduce the area covered by Impervious sidewak structures a little more than 2% of the area currently covered
by impervious structures on this lot. That is not a large change, but it is an improvement that would not
otherwise occur. And it is approximately twice the square footage of the lot covered by the proposed deck
enlargement itself.
Taken together, the removal of the portion of the deck discussed in Note #1 above and the removal of
the portion of the sidewalk discussed in Note #2 above would lead to a net offset of 161.56 square feet of
currently covered by impervious structures on this lot. That is approximately 3.74 times the 43.20 square feet
that our proposed deck extension would involve.
3.) Regardless of whether or not we are permitted to add an additional 43.20 square feet of new
impervious structure to the deck, we intend to convert from propane to natural gas. A feeder gas line has
recently been added along the roadway, and metered natural gas will beavailable in the next year or so. This
will entail adjusting our furnace, our dryer, and our stove to permit those appliances to use natural gas. This
will permit us to have a metered supply of fuel delivered insteadas needed automatically and relieve us of
the need to order and store bulk propane deliveries. But it will also permit us to have the bulk propane tank
removed from the premises. That tank measures 31" by 91" (2.58'X 7.58'), orapproximately 19.56 sq. ft. While
this conversion is not part of our deck proposal because we intend to do this whether or not a variance is
granted, it will be done during the same time frame when the work on the deck goes forward. And that
means we will have to budget and meet expenses just as if this were all part of the same project, whether or
not the deck is extended or remains at its present dimensions.
4.) The Appraisal performed at the time of the sale in late 2018 established and recorded the area
of the lot as "10,500 square feet + or -." That is the basis I have used in determining the
percentage of the property covered by impervious structures.
