(7:45 p.m.) Motion was made by Paui Larson, second by David Trites and unanimousiy carried, to approve a variance of 28’ from the required ordinary high water ievei setback of 75’ for the proposed residentiai deveiopment as depicted on the drawing dated October 16, 2003, which was submitted with the variance appiication with the condition that the existing guest house must be abandoned and converted to a non-dwelling use. (8:22 p.m.) Merlyn and Kathleen Lokken, Lot 11 Sunnyside Fifth Addition, East Battle Lake in Girard Township, requested a variance of 55’ from the required ordinary high water level setback of 100’ for the completion of the following projects; 1. Construct a 32’ by 24’ addition behind house, 2. Construct new porch roof over existing south deck from southwest corner to new addition 3. Tie-in new addition roof to ridge of existing house, and 4. Re-Shingle and reside existing house. The audience was polled with Doug Vandenberg speaking against the variance as requested. An email from Bernard Voss addressing the variance application was read for the record. After discussion and consideration, Cecil Femling made a motion, second by Michael Conlon and unanimously carried, to approve the variance as described in the variance application and as depicted in the drawing submitted with the application with the condition that no more than 25% of the total lot area can be covered with impervious surfaces. It should be noted that the variance as approved does not directly or indirectly grant any other variances for the proposed development. Brian Orman - Approved as requested with a condition. (8:45 p.m.) Brian Orman Et Al, Lot 5 and Southeasterly 50’ of Lot 6 Long View, Long Lake in Hobart Township, requested a variance of 2’ 3" from the required 10’ setback for the location of an existing holding tank 7’ 7” from an existing dwelling. July 14, 2005 Meeting - Randall Mann, Chair, polled the audience with no one speaking for or against the variance as requested. A letter from Tom and Toni Mackland in support of the variance as requested was noted for the record. After consideration and discussion, Steve Schierer made a motion, second by Michael Conlon and unanimously carried, to table this variance application until Thursday, August 4, 2005 by which time the applicant will have had the existing tank pumped and will have had the existing tank inspected by a certified individual who will provide a report to the Board of Adjustment regarding the condition of the existing tank. August 4, 2005 Meeting - A letter from Sewer Service stating that they had pumped the holding tank on July 22, 2005 and that in there opinion the tank is a solid pre­ cast concrete tank that does not leak was read for the record. After consideration, Steve Schierer made a motion, second by Cecil Femling and carried with Rod Boyer abstaining, to approve a variance of 2’ 3” from the required 10’ setback for the location of an existing holding tank 7’ 7” from an existing dwelling with the condition that a float alarm must be installed. Other Business - atrick and Donna Schwan - Discussion On Thursday, November 13, 2003 a variance was approved for Patrick and Donna Schwan that tied the proposed development to a drawing dated October 16, 2003. Patrick and Donna Schwan building plans have changed and they have requested that the Board authorize the development as shown on a drawing dated July 25, 2005. After review and consideration, Michael Conlon made a motion, seconded by Steve Schierer and carried with Rod Boyer abstaining to approve the development as depicted on the drawing dated July 25, 2005 noting that the new proposal will place the development further from the ordinary high water level then the original plan and the new proposal does not required any additional variances nor does this approval directly or indirectly grant any other variances for the proposed development or removed any conditions placed on the proposed development when the original application was acted upon. In addition we would like to add an additional 925 square feet on the south side for the existing foot print. This structure would be a single story on the East end and two stories on the West end. Our existing structure is in need of a new roof, siding, windows cind needs to have the electrical wiring updated. In addition the existing structiue sits on a 10 inch foundation. We are asking for a variance that would allow us to rebuild on our existing foot print. Our other option would be to build a two story structure on the south side of our lot, 10 feet from our property line. Staying back 75 feet from the north shore and 10 feet from our south property line would require us to stretch our home farther to the West and East which would cut down our neighbors view of the lake both from there back and front yards.
