The Board of Adjustment considered the following applications for variance: Bruce C. and Beth Jones Martinson - Approved the variance request as modified. (6:32 p.m.) Paul Larson Bruce C. and Beth Jones Martinson, part of Government Lot‘8, Section 31 of Candor Township by Ctter Lake, requested a variance of 47’ from the required ordinary high water level setback of 200’ for the addition of 8’ deep by 32’ wide unenclosed front porch 153’ from the ordinary high water level. The applicant’s sister appeared with the applicant at the public hearing. The audience was polled with no one speaking for or against the variance as requested. After consideration, Steve Schierer made a motion, second by Paul Larson and unanimously carried, to approve the placement of a covered unenclosed porch no closer to the ordinary high water level than the lakeside of the existing dwelling (house not the deck). It should be understood that the variance as approved does not directly or indirectly grant any other variances for the proposed developrnent and that the variance as approved will provide the applicants with a reasonable use of their property. It was also noted that the variance as requested would establish precedence and that there is a variance on fiie for the location of the existing house: Robert and Sandra Fagen - Approved the variance as requested with a condition. (6:45 p.m.) Robert and Sandra Fagen, part of Government Lot 3, Section 2 of Dead Lake Township by Marion Lake, requested the following: We wouid like to put a home 24’ by 36’ with attached garage 16’ by 24’ and an attached breezeway 10’ by 24’ on our lot on Marion Lake. Also, relocate our existing.8’ by 12’ storage shed. We are requesting a variance of a 20’ setback from the 75’ setback placing new dwelling 55’ from ordinary high water level due our substandard lot of record and terrain of lot. Our existing cabin will be removed upon completion of our new dwelling. The proposed new cabin will be 33’ farther from the lake than the existing cabin. The audience was polled with no one speaking for or against the variance as requested. After consideration, Paul Larson made a motion, second by Steve Schierer and unanimously carried, to approve the variance as described in the variance application dated July 28'^, 2008 and as depicted on the drawing submitted with the application with the condition that the existing cabin must be removed on or before August 1, 2009. It was noted that the size of the proposed development is reasonable and that the proposed development will be an:improvement to the property. Also, requesting a variance.to cover more than 25% of the eligible lot area with impervious surfaces. Daryl Rath appeared with the applicant at the public hearing. The, audience was polled with no one speaking for or against the variance as requested. Letters from Roberta and Gerald Lovell, Rick Kuske, Barbara Peppersack and Susan and Richard Neameyer in support of the variance as requested were noted for the record.
