Connoys wish to convey the south 25 feet of Lot 4 of Birch Grove Beach to Habermans for pemanent attachment to the Haberman property described as Lots 5 and 6 of Birch Grove Beach and backlot Tract B. The result will be that Connoys and Habermans will each own the backlot parcel located behind their own lakelot parcels, and the lakelot parcels of Connoys and Habermans will be more equal in size. Haberman - Denied Motion was made by Mark Steuart, second by Randall Mann and unanimously carried, to deny the variance as requested noting that no adequate hardship had been shown that would merit changing the condition which was placed on the variance request approving the creation of a 3.28 acre tract. Haberman, Pelican Rapids, MN, requested a variance which would allow Paul and Barbara Haberman to convey Tract A, as depicted on the registered surveyor’s drawing, to June and Thomas Connoy for permanent attachment to Lots 1,2,3 and the north 25’ of Lot 4, Birch Grove Beach and a variance which would allow June and Thomas Connoy to convey the south 25’ of Lot 4, Birch Grove Beach, to Paul and Barbara Haberman for permanent attachment to Lots 5 and 6, Birch Grove Beach. It should be noted that Paul and Barbara Haberman presently own Tract A and Tract B as depicted on the registered surveyor’s drawing. If the variance as requested is approved Tract B would be permanently attached to the south 25’ of Lot 4, all of Lot 5 and Lot 6, Birch Grove Beach. Paul and Barbara Haberman represented the variance request at the public hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Mark Steuart, second by Randall Mann and unanimously carried, to deny the variance as requested noting that no adequate hardship had been shown that would merit changing the condition which was placed on the variance request approving the creation of a 3.28 acre tract. Don and Sue Swenson - Denied Don and Sue Swenson, Perham, MN, requested a variance of 6’ from the required ordinary high water level setback of 75’ for the placement of an open porch 69’ from the ordinary high water level. The property is described as Lot 12, Augustana Beach First Addition, Otter Tail Lake in Amor Township. The audience was polled with David Spies speaking in favor of the applicants’ request. He noted that the applicants’ proposal would have no negative impact and would in fact meet the string test if the test was not applied to the immediately adjacent lots. After consideration, motion was made by Bert Olson, second by David Holmgren and unanimously carried, to deny the variance as requested noting that it would be ahead of the existing string line and noting that no adequate hardship had been shown that would allow for the granting of the requested variance. Lee and Shirley Krump - Denied Lee and Shirley Krump, Battle Lake, MN, requested a variance of 5’ 6” to 7’ 2” from the required side lot line setback of 10’ for the construction of an attached single car garage being 2’ 8” to 4’ 6” from the side lot line and being 30’ from the road right-of-way. The property is described as Lot 11, Block 1, Baker’s Addition to Sand Beach Park, Otter Tail Lake in Everts Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Mark Steuart, second by David Holmgren and unanimously carried, to deny the variance as requested as no adequate hardship had been shown, the granting of the variance would establish a precedence for this immediate area, the proposed project would most likely cover more than 25% of the total lot area with impervious surface and the applicants have a reasonable use of there property. It was noted that the size of some lots does not necessarily accommodate all the development a property owner might like to undertake on his/her property.
