Minnesota This letter is in response to your request for a variance from Minnesota Rules, Chapter 4725, to construct the subject water-supply well less than 50 feet from a sewage holding tank located on the subject property. Minnesota Rules, part 4725.4450, subpart 1, item E requires that a water-supply well must be located at least 50 feet from a septic tank, sewage lift station, nonwatertight sewage sump, sewage holding tank, and buried sewer line. Minnesota Rules, part 4725.4450, subpart 1, item F does allow a weU to be located a minimum of 20 feet from a buried sewer line that is pressurized and serves one single-family residence, or is a gravity sewer which is not a collector or municipal sewer, and that meets the materials and pressure testing specifications of Minnesota Rules, parts 4715.0530 and 4715.2820 (Minnesota Plumbing Code). Mr. Jeffrey Grugel of the Minnesota Department of Health (MDH) Fergus Falls district office inspected the subject site on June 3, July 8, and July 19, 2004. During these inspections, Mr. Grugel observed that there was no location on the subject property which meets aH required weU isolation distances. Mr. Grugel evaluated several proposed well locations which were less than 50 feet from the holding tank and/or untested buried sewers. Mr. Grugel identified an additional location on the southwest side of the garage which is 50 feet from the septic tank, 27 feet from an untested buried sewer line on the subject property, and 44 feet from an untested buried sewer line on Dave Grosz’s neighboring property to the southwest. Information provided on the variance application indicates that the proposed well wiU be approximately 75 feet deep. The construction record for a neighboring well, Minnesota Unique Well Number 652273, indicates that the well is 111 feet deep and penetrates alternating clay-sandy clay confining layers from 18 to 91 feet below the ground surface.
