Storm Water System Agreement
Motion by Mosher, second by Lee, and unanimously carried to approve the appropriate
County officials’ signatures to execute an agreement between the County of Otter Tail and
Townsend Engineering for the engineering services for a permanent plan to lower South and
North Turtle Lake water levels with a Storm Water System at a not-to-exceed cost of
$10,900.
Planning Commission Recommendations
Conditional Use Permit - Gerald & Carol Sachs:
Motion by Lee, second by Nelson, and unanimously carried to approve an after the fact
Conditional Use Permit to operate a Real Estate Office, Lakeshore & More Realty -
Broker/Owner, Bradley J. Sachs, with a condition as recommended by the Planning
Commission. The property is described as Pt GL 4 (.40 Ac) Section 9 of Lida Township:
Lake Lida (56-747).
Conditional Use Permit - Verle & LuVeral Blaha:

Motion by Mosher, second by Nelson, and unanimously carried to approve a Conditional Use
Permit to build a new driveway for lake property owners from Golf View Shores Road as
presented. The property is described as Lot 1 BIk 1 Stalker Lake Golf View Shores, Section
34 of Tordenskjold Township; Stalker Lake; Stalker Lake (56-437).
Conditional Use Permit-Zion Evangelical Lutheran Church:
Motion by Lee, second by Block, and unanimously carried to approve a Conditional Use
Permit to install a lighted sign as presented. The property is described as Pt GL 5 & 6
...(7.55 AC) Section 22 of Dunn Township: Elbow Lake (56-774) and Franklin Lake (56-759).

James & Constance Day - Approved With A Condition:
A Conditional Use Permit Application (as stated by the Applicant): We request permission to
prepare a 200' x 200’ pad for future home site. This will involve removal of vegetation. All
vegetation will be buried on site in the ravine about 60’ S of pole barn. The topsoil will be
removed, saved & replaced after removal of the subsoil. The subsoil will be removed from
that area. We expect to remove an average of 234’ (the highest 5’ & lowest O’) which will
be approx, a total of 3703 cu yds of which 1895 cu yds will be removed off site. Approx.
450 cu yds to be placed on a low spot of the existing driveway and a low spot in front of the
pole barn. Approx. 700 cu yds will be placed in the ravine about 60’ S of pole barn. The
remaining 658 cu yds of soil will be used to achieve a 4 to 1 pitch on perimeter of the 200’
x 200’ building site. The property is described as Pt of GL 1 ... (17.74 AC), Section 35 of
Dunn Township: Franklin Lake (56-759), RD.

concerns regarding an easement and the fact that the road does not extend beyond either
side of the plat. He stated that this is contrary to the current Subdivision Controls Ordinance.
He expressed concern about a waterway extending through the plat and that potential
drainage easement is not extended in lots 1 & 2 as required. Carl Johnson indicated that a
property line dispute regarding Lot No. 1 had not been resolved. Attorney, Steve Rufer,
spoke on behalf of the applicants in response to concerns expressed. He stated that all lots
are substandard except one. Maplehurst Drive is not an easement and not less than a public
road. That issue was addressed at a previous Planning Commission meeting. Mr. Rufer
noted that a cul-de-sac would not be required in this case because the existing road does not
dead end. Existing drainage is shown on the plat. In response to a property line dispute,
Mr. Rufer stated that there is no legal survey or recorded title evidence to suggest a boundary
line issue. Joe Maske spoke in opposition of the plat and requested that the County Board
send this proposed plat back to the Planning Commission. Applicant, Gary Holthusen, stated
that the backlots will be tied to the front lots by law and cannot be divided from the front lots.
No one would be able to gather two or three backlots and make a residential lot. He
requested approval of the Planning Commission’s recommendation. Motion by Froemming,
second by Block, and unanimously carried to approve the Preliminary Plat known as LeMAR
consisting of 1 single family residential lot and 8 nonresidential backlots as shown on the
revised drawing dated September 8, 2003, and subject to the Land & Resource Office
receiving a title opinion before the Final Plat is brought to the County Board for approval.

Biennial Service Agreement Plan Public Notice
The Otter Tail County Human Service Department is developing the Consolidated Children
and Community Services and Minnesota Family Investment Program Plan for 2004-2005.
Citizen participation is invited in the development of this plan and the intended use of the
Title XX Social Services Fund.
The Minnesota Family Investment Program (MFIP) Consolidated Fund Act and the Children
and Community Services Act (CCSA) Consolidated Fund (Minnesota Statutes 256J.626 and
256M, respectively) requires counties to submit a biennial service agreement to the
Minnesota Department of Human Services (DHS) to receive these public funds.
The primary purpose of the Biennial Service Agreement is to establish agreed upon
outcomes and identify strategies counties will use to achieve these outcomes. The

Preliminary Plat and Conditional Use Permit - “Bluegill Bay Estates’VBalqaard Family
Enterprise:
County Attorney, David Hauser, read a letter addressed to Chairman Malcolm Lee, from
Knutson Ventilation Consulting, Inc., Gerhard W. Knutson, Ph.D., CIH. The letter was dated
August 15, 2003, and expressed opposition to approval of the Preliminary Plat of Bluegill Bay
Estates and the established ordinary high water level. Jim Peterson of Anderson Land
Surveying stated that he provided elevations to Terry Lejcher for his review as to whether this
was lakeshore or not. Mr. Lejcher approved these elevations and found them to be
adequate. Land & Resource Director, Bill Kalar, stated that 1298.0 is the correct OHWL
according to information received by the DNR and the County’s Ditch Inspector has reported
that the outlet for Lake Sewell is flowing at capacity. The lake is 1 to 114 ft. lower from earlier
this year.
Motion by Mosher, second by Block, and carried with Nelson opposed, to approve the
Preliminary Plat known as “Bluegill Bay Estates” based on the revised drawing of July 29,
2003, and a Conditional Use Permit to build a road for the development, with conditions as
recommended by the Planning Commission. The property is described as Pt Gov Lots 3 & 4
& Pt of the N14 of SWVi of NE14 of NE% of NE14 (13.6 ac). Section 23 of St. Olaf Township;
Sewell Lake (56-408).
Conditional Use Permit - John Stumpf:
Motion by Lee, second by Froemming, and unanimously carried to deny the Conditional Use
Permit request to replace a failing retaining wall. The property is described as Lot 2 BIk 1
Perrin’s Subdivision, Section 10 of Lida Township; Crystal Lake (56-749).
Preliminary Plat and Conditional Use Permit - “Sportsman Landing’/Brian Clouse:
Land & Resource Director, Bill Kalar, reported that the Planning Commission approved this
Preliminary Plat with a condition that if the purchase agreement with the DNR for Lot 3, Block
1 is not completed, this lot would be considered unbuildable. Applicant, Brian Clouse, and
his Attorney, Tom Gedde, represented the application. Mr. Gedde expressed concern with
the condition placed on the property and requested that the County Board approve this plat
