Motion was made by Randall Mann, second by Steve Schierer and carried with Paul Larson voting no, to approve a
variance to subdivide the applicants jointly owned property into two parcels as depicted on the registered surveyor’s
drawing, which was submitted with the variance application, with the condition that no further variance can be granted
on these two parcels. It was noted that the extra area within the back lot more than compensates for the lack of back
lot width. It was also noted that the variance as approved would provide the applicants with a reasonable use of their
property.

Re: OTTER TAIL COUNTY DOCK AND RIPARIAN USE ORDINANCE
On March 1, 2016, the Otter Tail County Board of Commissioners passed the Dock and Riparian Use Ordinance
regulating the placement of docks, boatlifts, etc. in the public waters of Otter Tail County. On May 24, 2018, Land &
Resource staff, along with Richard West, Otter Tail County Public Works Director and the Otter Tail County Sheriff, Brian
Schlueter, met on site with the property owners at the following properties regarding the dock and riparian use
ordinance:
• 24505 Labrador Beach RD (PIN 17000270352001) - Allan & Marlene Shimpa
• 24501 Labrador Beach RD (PIN 17000270352005) - Jeffrey & Cynthia Kummeth
• 24885 Labrador Beach RD (PIN 17000270352006) - Paul & Carol Breyer
During the site visit. Otter Tail County staff and all parties present agreed to the following:
1. No further dock or boatlift installations or adjustments to existing docks and boatlifts will occur in 2018; and,
2. Before ice out in 2019, all parties will meet at the Otter Tail County Land & Resources in Fergus Falls, MN. The
purpose of the meeting will be to discuss dock placements as the placements relate to the requirements of the
Otter Tail County Dock and Riparian Use ordinance that all parties involved can agree upon for 2019 and the
future.

Todd H and Robin K Larson, Portland, ND, requested a variance to divide our jointly owned property into
two parcels, which will be owned individually. The lake frontage lot will be 5.6 acres and will have 222’ of
lot width/water frontage. The back lot (parcel with no water frontage) will have 5.77 acres and
approximately 120’ of width. The minimum width for back lots within the shoreland area is 300’.
Requesting a variance to create a back lot having less than the required lot width. The property is
described as part of Government Lot 7, Section 27 and part of Government Lot 3, Section 34 of Dunn
Township by Franklin Lake. The audience was polled with no one speaking for or against the request.
After discussion and consideration, motion was made by Randall Mann, second by Steve Schierer and
carried with Paul Larson voting no, to approve a variance to subdivide the applicants jointly owned property
into two parcels as depicted on the registered surveyor’s drawing, which was submitted with the variance
application, with the condition that no further variance can be granted on these two parcels. It was noted

Steven A and Sharon M Anderson - Approved as requested. (8:23 p.m.)
Steven A. and Sharon M. Anderson, Dalton, MN, requested a variance to create two residential back lots
having approximately 240’ of lot width (requirement is 300’) and less than 80,000 square feet of area. Also
permanently attach existing surveyed lake lots (nonresidential use) to each residential back lot. It should
be noted that the lake lots are contiguous substandard lots. The property is described as part of
Government Lot 3, Section 27 and Lots 117 and 118 of Safer Humphrey Ranch Camp, Ten Mile Lake in
Tumuli Township. The audience was polled with no one speaking for or against the request. After
discussion and consideration, motion was made by Randall Mann, second by Steve Schierer and
unanimously carried, to approve a variance to create two buildable residential back lots. It was noted that
the variance as approved is consistent with other actions of the Board of Adjustment in this immediate
area. The variance as approved will provide the applicants with an ability to enjoy the same rights and
privileges as others in this immediate area.
Dennis and Nancy Peyeri - Approved as requested. (8:33 p.m.)
Dennis and Nancy Peyeri, Henning, MN, requested a variance of 80’ from the required ordinary high water
level setback of 200’ for the construction of a dwelling 120’ from the ordinary high water level. The property
is described as a ten acre parcel in the north half of the southeast quarter, Section 4 of Henning Township
by an unnamed lake. The audience was polled with Manley Nichols and Aaron Peyeri speaking in support
of the variance as requested. After discussion and consideration, motion was made by Paul Larson,
second by Cecil Femling and unanimously carried, to approve a variance of 80’ from the required ordinary
high water level setback of 200’ for the construction of a dwelling 120’ from the ordinary high water level. It
was noted that this is an established farm site (100 plus years) with other buildings/structures closer to the
ordinary high water level than this new dwelling.
Kent and Claudia Olson - Approved as requested. (8:45 p.m.)
Kent and Claudia Olson, Battle Lake, MN, requested a variance of 5’ from the required side lot line setback
of 10’ for the construction of a roof over an existing deck located 5’ from the side lot line. The property is
described as Lot 4, Inglewood, Blanche Lake in Girard Township. The audience was polled with no one
speaking for or against the request. After discussion and consideration, motion was made by Steve
Schierer, second by Randall Mann and unanimously carried, to approve a variance of 5’ from the required
side lot line setback of 10’ for the construction of a roof over an existing deck located 5’ from the side lot
line. It was noted that the proposed roof is away from the lakeside of the dwelling and is an extension of
the applicants’ house. Hardship is a substandard lot of record.

2. I know of my own personal knowledge that TRACT B-1 and TRACT B-2, (survey
dated 05/09/00) were at one time joined togeflier as one tract of land and owned and
acquired by Todd H. Larson and Robin K. Larson by a Warranty Deed dated May
23, 2000, and filed for record on May 24, 2000, at 3:30 p.m. as microfilm document
number 864200 in the Otter Tail Recorder’s Office.
3. By Application for Variance dated August 13, 2002, and recorded September 17,
2002, at 3:30 p.m. as instrument number 911584 in the Office of the Otter Tail
County Recorder, Todd H. and Robin K. Larson obtained a variance to subdivide the
jointly owned property into two parcels, TRACT B-1 and TRACT B-2 which was
depicted on the registered surveyor’s drawing, dated 05/09/00 and revised 09/13/00,
submitted with the variance application with the condition that no further variance
could be granted on these two parcels.
4. That some time after the variance was requested and recorded as document number
911584, Robin K. Larson and Todd H. Larson acquired an additional tract of
property identified as TRACT C and more particularly identified on survey of
05/15/()2 as follows, to-wit:

of the property will not violate current county zoning regulations and is in compliance

7. This Affidavit is made for purposes of clearing any objections to the marketability of
title as it pertains to zoning and subdivision regulations on the modification, changing
or reconfiguration of the foregoing Parcels A, B and C and that Otter Tail County

Dear Mr. Kolar:
In examining title to the property located on Franklin Lake owned by Robin Karlton
Larson and Todd H. Larson, I found a recorded Application for 'Variance (recorded as
document number 911584). In examining this Application for Variance (a copy of which
is enclosed for your convenience) there is a restriction that no further variance can be
granted on these two parcels. The proposed division indicates that lot A is a non-riparian
lot. The almost square tract of land of approximately 150 feet by approximately 125 feet,
plus or minus, which adjoins Franklin Lake was to be attached to Parcel B.
My clients are purchasing Parcel A and the square tract of land north of Parcel A. This
will allow them to have ownership of the lakeshore, thereby making their Parcel A a
riparian lot.
Enclosed please find photocopies of the only two deeds that were included in the abstract
separating ownership of these lots. As you can tell, the square tract of land is owned
jointly by Todd and Robin. It is this square parcel of land that will be deeded with Parcel
A to my clients.
