Jerry Leaf - Approved with conditions.
Motion was made by Cecil Femling, second by Bert Olson and carried with Mark Steuart voting no, to approve a
variance to subdivide a .9831 acre tract from an existing 11.08 acre parcel with the following conditions:
1. the proposed tract must be permanently attached to Gerald Sorenson’s lake lot,
2. a registered surveyor’s drawing must be provided at the time of conveyance,
3. the area contained within the proposed tract cannot be used when calculating the 25% impervious surface
rule for front (lake) lot development,
4. the area contained with the purchaser’s lake lot cannot be used when calculating the 25% impervious
surface rule for back (new tract) lot development,
5. the proposed tract can only be used as a parking area, for a storage structure and/or for the placement of
a well.
The granting of this variance will allow for the enhancement of the purchaser’s substandard lake lot. It was also noted
that this is the second metes and bounds spilt request.by variance by this applicant and the board highly recommends
that if any additional substandard metes and bounds subdivisions are being considered the applicant should strongly consider platting the property^"" ^

Jerry Leaf, Detroit Lakes, MN, requested a variance to subdivide a .9831 acre tract from an existing
11.08 acre parcel for the purpose of conveyance and permanent attachment to Lot 4, Ripples Beach.
The property is described as part of Government Lot 7, Section 34 of Dunn Township by Franklin Lake.
Gerald Sorenson the purchaser of the proposed tract appeared along with the applicant. The audience
was polled with no one speaking for or against the request. After consideration, motion was made by
Cecil Femling, second by Bert Olson and carried with Mark Steuart voting no, to approve a variance to
subdivide a .9831 acre tract from an existing 11.08 acre parcel with the following conditions:
1. the proposed tract must be permanently attached to Gerald Sorenson’s lake lot,

Donald J. Scanlon - Approved with modifications
Donald J. Scanlon, Wayzata, MN, requested a variance to allow a holding tank to remain 45’ from an
existing well, 2’ from the north property line and 8’ from the west property line. The property is
described as part of Government Lot 1, Section 5 of Lida Township by Rush Lizzie Lake. The audience
was polled with no one speaking for or against the request. After consideration, motion was made by
Steve Schierer, second by Cecil Femling and unanimously carried, to approve the location of a holding
tank 2’ from the north property line and 8’ from the west property line. It should be noted and clearly
understood that the Board of Adjustment is not granting any variance for the 45’ separation of the well
from the holding tank and additionally it should be noted that it is the responsibility of the applicant to
contact the Minnesota Department of Public Health for a variance which would allow the applicant’s
well to remain less than the required 50’ from the applicant’s holding tank. The Board of Adjustment
stated that they are concerned with potential health issues when a holding tank is placed less than the
required 50’ from a well. The noted hardship for the approve lot line variances is a substandard lot of
record.

Martin and June Hanson - Denied
Martin and June Hanson, Fargo, ND, requested a variance of 5’ from the required lot line setback of
10’, a variance of 16’ from the required road right-of-way setback of 20’ and a variance of 6’ from the
required septic tank setback of 10’ for the location of a 24’ by 26’ garage 5’ from the lot line, 4’ from the
septic tank and 4’ from the road right-of-way. The property is described as Lot 12, Block 1, Baker’s
Addition to Sand Beach Park, Otter Tail Lake in Everts Township. It was noted that a phone call from
Rollie Mann, Manager of the Otter Tail Water Management District, had been received by the office in
which he requested that no variance should be granted by the Board of Adjustment for the location of
the proposed structure 4’ from the septic tank. A letter from Betty Blessum in support of the applicants’
was read for the record. The audience was polled with no one speaking for or against the request.
After consideration, motion was made by Randall Mann, second by Linda Bergerud and unanimously
carried, to deny the variance as requested as the granting of the applicants’ request would cover more
than 25% of the total lot area with impervious surfaces.
Ralph and Cecilia Steenson - Approved with modification.
Ralph and Cecelia Steenson, Cummings, ND, requested a variance of 8’ from the required side lot line
setback of 10’ for the placement of a 22’ by 24’ garage 2’ from the lot line. The property is described as
Lot 10, Rose Lake Beach - Wylies Addition, Rose Lake in Hobart Township. The audience was polled
with no one speaking for or against the request. After consideration, motion was made by Cecil
Femling, second by Randall Mann and unanimously carried, to approve a variance of 4’ from the
required side lot line setback of 10’ for the placement of a 22’ by 24’ garage 6’ from the lot line with the
condition that before a site permit can be issued an approved septic system must be installed.
Hardship is a substandard lot of record and terrain features of the applicants’ property.
