VARIANCE REQUESTED IS:
Split a 2,7 acre backlot into two parcels. One parcel would be a minimum of
80,000 sq. ft. and be owned by Steven Henry. The other parcel would be approximately
37,600 sq. ft., and it would be deeded to James Henry, who already owns the land
immediately adjoining the leftover 37,600 sq. ft. James Henry owns approximately
10-11 acres adjoining the 2.7 acre parcel in question. Steven Henry will be
providing an easement across the 80,000 sq. ft. back lot to allow James Henry
access to his acreage,
A plat map is furnished to show the original 2.7 acre parcel and a survey has
been ordered to show the proposed split and will be available for viewing at the
variance meeting. As required by minimum standards, the square footage for an
RD lake is doubled to 80,000 sq. ft., and the lot width will be approximately
500' which is more than the required 300'.
The reason for this request is to accomodate a sale of the Steve Henry lakefront
home and backlot and also to satisfy a verbal agreement between Steve and James
Henry that James Henry would own a portion of the original 2.7 acre backlot.

After consideration, motion was made by Craig Anderson, seconded by Cecil Femlingand unanimously carried,
to approve a variance of 2’ from the required 1 O' septic tank setback for the location of a 24’ by 24' garage.
Patricia Scott - Approved
Patricia Scott, Wahpeton, ND, requested a variance of 26' from the required ordinary high water level setback
of 75' for the construction of an 8’ by 24’ addition to an existing dwelling 49' from the ordinary high water
level. The property is described as the SWLY 100’ of NELY 170' of Res. A, Evergreen Glen, Star Lake in Star
Lake Township, The audience was polled with no one speaking for or against the request. After consideration,
motion v/as made by Bert Olson, seconded by Dan Oehler and unanimously carried, to approve a variance of 26'
from the required ordinary high water level setback of 75’ for the construction of an 8’ by 24’ addition to an
existing dwelling. The addition will be no closer to the lake than the existing dwelling.
Steven J. Henry - Approved
Steven J. Henry, Pelican Rapids, MN, requested a variance to split an existing 2.7 acre parcel into two tracts
of less than 2.5 acres. One parcel would have a minimum of 80,000 square feet and a lot width of
approximately 500'. The other parcel would have approximately 37,600 square feet of area. The smaller
parcel would be deeded to an adjacent property owner. The property is described as part of Government Lots
3 and 4. Section 27 of Dunn Township on Franklin Lake. Steven Kantrud represented the applicant at the
hearing. The audience was polled with no one speaking for or against the request. After consideration, motion
was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to approve the variance as
requested with the conditions that a registered surveyor’s drawing and a letter stating that there are no
property line disputes will be provided at the time of recording.
Paul Michael Hermes - Approved
Paul Michael Hermes, Fergus Falls, MN, requested a variance of 31' from the required ordinary high water
level setback of 100' for the construction of a 12’ by 48’ addition to an existing dwelling 69’ from the
ordinary high water level. The addition would have a deck added on the top which would have a 3’ railing around
the entire deck. The property is described as Lots 4, 5 and 6, White Swan Beach. Swan Lake in Dane Prairie
Township. Peter Hermes represented the applicant at the hearing. The audience was polled with Nella and Odin
Johnson speaking against the request. After consideration, motion was made by John Everts, seconded by Craig
Anderson and unanimously carried, to approve construction up to what the string line test would permit and
any excavation plans for the proposed construction must be reviewed and approved by the Land and Resource
Managerrient office. The granting of this variance allows the applicant to enjoy the same rights and privileges
as his neighbors.
Charles Ponto - Approved
Charles Ponto, Frazee, MN, requested a variance of 3’ from the 18’ maximum height requirement of a non
dwelling structure (one story) for the construction of a 50’ by 100’ building with a height of approximately
21 ’, The property is described as part of Government Lot 6, Section 27 of Hobart Township on Long Lake. The
audience was polled with no one speaking for or against the request. After consideration, motion was made by
Cecil Femling, seconded by Dan Oehler and unanimously carried, to approve a variance of 3’ from the 18’
maximum height requirement of a non-dwelling structure for the construction of a 50' by 100’ building with
a height of approximately 21 ’. This is a non-dwelling structure that will be constructed using a wood frame
with steel covering. The structure will not obstruct vision.

setback of 20’ for the construction of a 24' by 24' garage, The property is described as part of Government Lot
3, Section 29 of Dunn Township on Lake Lizzie. The audience was polled with no one speaking for or against
the request. After consideration, motion was made by John Everts, seconded by Craig Anderson and
unanimously carried, to approve a variance of 20' from the required road right of way setback of 20' for the
construction of a garage. The granting of this variance request allows the applicant to enjoy the same rights
and privileges as adjacent property owners,

IGeorge Edward Markgraf, S. St. Paul, MN, requested a variance of approximately 100' from the required
ordinary high water level setback of 200’ for the construction of a dwelling. The property is described as part
of Government Lot 1, Section 26 of Dora Township on Elbow Lake. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by
John Everts and unanimously carried, to approve a variance of approximately 100' from the required
ordinary high water level setback of 200' for the construction of a dwelling located as depicted on the
applicant's map in blue with the condition that no additional variances are required and that this parcel will
not be subdivided in the future. The granting of this variance allows the applicant reasonable use of the
property and will keep the dwelling out of the bluff zone.

Stephen E. Devine - Approved
Stephen E. Devine, Fargo, ND. requested a variance of 6' from the required side lot line setback of 1 O' for the
construction of a 10' by 12' shed 4' from the property line. The property is described as Lot 13, Block 1,
Crystal Hills 4th Addition, Crystal Lake in Lida Township. The audience was polled with no one speaking for or
against the request. After consideration, motion was made by Cecil Fern ling, seconded by Craig Anderson and
unanimously carried, to approve a variance of 4’ from the required side lot line setback of 10' for the
construction of a 10’ by 12' shed 6’ from the property line.
Midwest Cable-Plow Inc., - Approved
Midwest Cable-Plow Inc,, Parkers Prairie. MN, requested a variance to split off a parcel of approximately ,2
acre from an existing parcel that is presently less than 2.5 acres. This parcel would be transferred to an
adjacent property owner. Requires a variance from the subdivision controls ordinance. The property is
described as part of Government Lot 1 , Section 22 of Parkers Prairie Township on Lake Adley. The audience
was polled with no one speaking for or against the request. After consideration, motion was made by John
Everts, seconded by Dan Oehler and unanimously carried, to approve the variance as requested with the
conditions that a registered surveyor's drawing and a letter stating that there are no property line disputes
will be provided at the time of recording.
Clair A. Prody - Denied
Clair A, Prody, Fergus Falls, MN, requested a variance to construct a 26' by 54' dwelling with a walkout
basement and an attached deck in the bluff zone area. Requesting a 30' variance from the required 30' setback
from the top of a bluff. The property is described as Lots 45 and 46, Girard Beach, West Battle Lake in Girard
Township. The audience was polled with no one speaking for or against the request. A letter from Harrison H,
Schmitt and Teresa A. Fritzgibbon opposing the granting of the variance request was read for the record. After
consideration, motion was made by Bert Olson, seconded by Cecil Femling and unanimously carried, to deny the
variance request as no adequate hardship had been shown. The bluff zone area is considered a high risk area.
