Assessor and the MN DNR bk 072011-001 MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARDOF ADJUSTMENT Thursday, October 6, 2011 The Otter Tail County Board of Adjustment met Thursday; October 6, 2011, with the following persons in attendance: Thomas Lee Leona Zimmerman Kyle Westergard, Land and Resource Management David Hauser, County Attorney Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m. Minutes Approved - The Board of Adjustment approved the minutes of the September 1, 2011 meeting as mailed. Paul Larson Steve Schierer Randall Mann The Board of Adjustment considered the following applications for variance: Marion Gill - Application approved as requested with conditions. (6:32 p.m.) Marion Gill, South'Half of the Northeast Quarter, part of Government Lot 2 and all of Government Lot 3, Section 6 of Perham Township by Devils Lake, requested to split approximately 13,694 square feet of area and permanently" attach to.Parcel 51-000-06-0074-004 (40143 Aerovllla Road). The parcel will :be used for nonresidential purposes. The remaining parcel will be approximately 119 acres. Request to use the survey and legal description.provided with this variance application. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Steve Schierer made a motion, seconded by Paul Larson and unanimously carried, to approve the proposed subdivision with the condition that this newly created parcel can only be used for nonresidential purposes and with the condition that a registered surveyor’s drawing must be presented at the time of conveyance. Braton - Application approved as modified with conditions. (6:35 p.m.) Mark Braton, part of Sub Lot 7, all of Sub Lot 8 and part of Sub Lot 9 of Government Lot 3, Section 20 of Dunn Township by Lake Lizzie, requested the following: proposing to replace the existing dwelling-being no closer to the ordinary high water level than the existing dwelling and behind the current building line. The replacement dwelling will be approximately 25’ back from the ordinary high water level. Requesting a 75’ variance for the replacement dwelling. Required setback is 100’. Mrs. Braton appeared at the public hearing with her husband. The audience was polled with noione speaking for or against the variance as requested. Ray Murray - Application approved as requested. (6:45 p.m.) Ray Murray, Lot 27 Hillside Addition Burau Beach, Wall Lake in Dane Prairie Township, requested the following: We would like to be able to use string line setback from road right-of-way about 6’ instead of 20’ due to the slop of the hillside. We ask for 8’ setback, 2’ back from string-line, request 12’ variance from road right-of-way. Darold Woessner, Contractor, represented the applicant at the public hearing. The audience' was polled with no one speaking for or against the variance as requested.' After consideration and discussion, Steve Schierer made a motion, seconded by Thomas Lee and carried with Paul Larson voting no, to approve a,variance of 12’ from the required road right-of-way setback of 20’ for the placement of a 30’ by 42’ garage 8’ from the road right-of-way. The applicant’s proposed structure will be further back than other similar structures in this immediate area and even though the applicant has adequate area to meet the required setback from the road right-of-way, the granting of this variance will allow placement of the proposed structure in an area that will not require excavation in a sensitive bank/hill area of the applicant’s property.
