Township by Franklin Lake, requested the following: Noncompliant lot requires variance for setback of
proposed stmeture. Building line does not apply due to public access adjacent to property. Requesting to be
58’ from ordinary high water level, for addition to existing dwelling. The audience was polled with no one
speaking for or against the variance as requested. After discussion and consideration, Paul Larson made a
motion, second by Rick Wilson and unanimously carried, to approve a variance of 42’ from the required
ordinary high water level setback of 100’ for the placement of an addition to the existing dwelling 58’ from
the ordinary high water level as described in the variance application dated September 11, 2015 and as
depicted in the drawings submitted with the variance application. The variance as approved will provide the
applicants with a reasonable use of their property. Hardship/practical difficulty is the location of the
applicant’s property next to a public access. The variance as approved does not directly or indirectly grant
any other variances for the proposed development or for any future development.
Midlands Land Entprs LLC and Westwood Resort — Variance application approved as modified. (6:50 p.m.)
Midlands Land Entprs LLC and Westwood Resort, part of Government Lot 1, Section 26 of Rush Lake
Township by Rush Lake, requested the following: I would like to move Cabin No. 1 22’ closer to lot line to
the south and 50’ or more away from lake. Original cabin location if (28 by 40) if built it will be closer to
lake than new structure if allowed to move over and make smaller. Proposing to replace the existing
dwelling (Cabin No. 1) which has been removed. The new dwelling will be 28’ by 34’ and be 19’ from
south lot line. The required setback is 50’. Requesting a 31’ variance from the south lot line. Also,
proposing to locate the new dwelling approximately 51’ from the ordinary high water level. Required
setback is 75’. Requesting a 24’ variance from ordinary high water level. New dwelling will be ADA
throughout. The applicant was represented by Chad. The audience was polled with Tonya Luond
expressing concerns with view obstruction, drainage/water retention and property valuation. Ms. Luond
presented for the record a written statement which has been placed in the applicant’s file. After discussion
and consideration, Paul Larson made a motion, second by Rick Wilson and unanimously carried, to approve
the construction of a structure not exceeding 28’ by 40’ in size being no closer to the ordinary high water
level than 58’ as stated in Site Permit No. 28178 (B) and with the north wall of the new structure being
placed in the same location as the north wall of the original Cabin No. 1 as shown on the drawing submitted
with the application, which has been removed, and with the new stmeture extending no more than 28’
towards the south lot line. The variance as approved should provide the applicant with a reasonable use of
the property. The variance as approved does not directly or indirectly grant any other variances for the
proposed development or for any future development.

following: Enclose existing carport, no change to building footprint. Asking for variance on building
setback on west side 1 ’-0” currently and roadway setback currently 9’. Also, a variance for an addition to
an existing non-conforming garage that crosses the common property line between the property owned by
John Holten and Erik Holten. The applicant was represented by John Gunkelman. The audience was
polled with no one speaking for or against the variance as requested.

Crane Lake LLC -Variance application approved as requested. (7:20 p.m.)
Crane Lake LLC, part of Government Lot 1, Section 26 of Clitherall Township by Crane Lake, requested
the following: proposing to replace existing Cabin No 2 being 75’ from the ordinary high water level.
Required setback is 100’. Requesting a 25’ variance. The new cabin will be a 32’ by 16’ (wanting to
change roofline and square off structure). The applicant was represented by David and Candace Meyer. The
audience was polled with no one speaking for or against the variance as requested. After discussion and
consideration, Steve Schierer made a motion, second by Rick Wilson and carried with Thomas Lee voting
no, to approve a 25’ variance from the required ordinary high water level setback of 100’ for the
replacement of Cabin No. Two with a 32’ by 16’ structure 75’ from the ordinary high water level as
described in the variance application dated September 17, 2015 and as depicted in the supporting drawing
submitted with the variance application. The applicant’s proposal is generally in the same foot print as the
existing structure and is away from the ordinary high water level. The variance as approved does not
directly or indirectly grant any other variances for the proposed development or for any future development.
James Caliandro - Variance application approved as requested. (7:27 p.m.)
James Caliandro, Lot 1 Block 1 North Turtle Lake Shores, requested the following: Requesting a structure
setback change from 200’ to 150’ for environmental impact reason’s similar to variances given to others on
our lake. This setback is for residential purposes. The audience was polled with no one speaking for or
against the variance as requested. After discussion and consideration, Rick Wilson made a motion, second
by Thomas Lee and unanimously carried, to approve a variance of 50’ from the required ordinary high water
level setback of 200’ for the location of a building site 150’ from the ordinary high water level.
Hardship/practical difficulty is the terrain of the applicant’s property. The variance as approved is
consistent with past actions of the Board of Adjustment and will provide the applicant with a reasonable use
of his property. It was also noted that the location of a building site 150’ from the ordinary high water level
will result in less disturbance to the lot than if the building site is placed at the required 200’ setback. The
variance as approved does not directly or indirectly grant any other variances for the proposed development
or for any future development.

David Geiszler and Denise Lakeman, Lot 8 Nebraska Beach, Wimer Lake in Hobart Township, requested
the following: Build 204 square foot deck, six steps and landing 24 square foot. Requesting a 30’ variance
from top of bluff for a 0’ setback. The audience was polled with no one speaking for or against the variance
as requested. It was noted that a significant amount of material had been submitted by Vivian Anderson just
prior to tonight’s meeting for consideration by the members of the Board of Adjustment.
