U >FILE MEMO - PARCEL #17000170236000 01/25/02 - Joyce Ms. Nelson came into the office to take out a Site Permit for a new dwelling on this parcel. In going over the site plan with her I noticed that the proposed structure (dwelling with attached garage) appeared to cross over a lot line into the next property. She said that they owned both lots and planned to build across the property line. I accessed the AS400 system for information on the other property, Parcel 17000991752000 (see printout data in file). Property owner listed as Norwest Bank ND Trustee with no other names indicated anywhere in the records. Ms. Nelson explained that the bank held the property in trust for them. She suggested I contact her husband by phone and ask him about the property lines. I contacted him on his mobile phone and told him my concerns. He said the bank was going to “deed over” a piece of the property under trust to be attached to the existing parcel (0236000) for the purpose of meeting the required building area for their new home. He offered to have the bank send a facsimile document stating their intentions. I explained that it would not be sufficient for our requirements to issue a Site Permit. I also told him I did not think they could change or take land away from a platted parcel because they would be decreasing the size of the lot. He said that in addition to “deeding” a portion of that lot over, they would be adding to the platted lot by attaching part of a lot they owned on the “other side” in conjunction with Mark Nyquist. (This was determined to be Parcel #17000991719000; no documentation on record showing that they own any part of that parcel.) Following my phone conversation with Mr. Nelson, I consulted with Mavis and asked her opinion. She and I both agreed (and Marsha verified for us) that the Nelsons would first need to bring in a survey indicating exactly how the properties would be changed. At Ms. Nelson’s request I made a list of what we needed to see in order to determine if the property splits would meet the requirements. I made one more phone call to Mr. Nelson and explained that I could not issue a Site Permit until all land requirements had been met and the actual documents recorded before we could proceed with issuing any permits for structure. I told him I would send the information with Ms. Nelson. The previously proposed and approved alignment, as submitted May 20, 2002, involved a total cut and fill of 168.6 cubic yards. The new alignment would involve only 49.2 total cubic yards (101.1 cut and 51.9 fill). This alignment will allow a better balancing of the site. This alignment will also allow for a better use of the property and less steep of grades on the drive.
