Plans include lawn, flower beds, patio (off french doors at rear of house). Retaining walls (ranging in height from 6” - approx 36”) spreading of black dirt that was removed from homesite during construction & smoothing out existing area at top of bluff to put lawn & gardens in plus restoring areas around house to find grade. Approx. 207 cubic yards in bluff impact zone to be smoothed out (no fill will be added or removed from this area). An additional 60 cu yds of black dirt to be spread around house for lawn & flower beds (this was removed from homesite for construction purposes. This is an After-The-Fact request. The property is described as Pt GL 2 & 3, Section 32 of Aurdal Township: Otter Tail River (56-OTR), AG. Bjorn and Barbara Finseth represented the Application. Kris Svingen (Attorney for Larry & Mary Jo Schwartz and Craig Rude) spoke against the request, expressing concerns regarding the erosion (work was done in the bluff impact zone and in the bluff) and run-off, and about allowing something just because it was done. Susan Rude expressed concerns regarding the removal of trees and the work was done prior to receiving a permit. Motion: A motion by Lachowitzer, second by Schwartz to deny as the permit would not have been granted if it had been requested prior to doing the project. Reason for denial is that the bluff area has been destroyed. Voting Yes: Boyer, Estes, Lachowitzer, Olson, Schwartz, & Zimmerman. Voting No: Maske & Sha. Motion: A motion by Schwartz, second by Boyer to approve what was proposed on the westside of the house and to approve the proposed retaining wall on the eastside of the house provided it is no higher than 2’ and outside of the bluff impact zone. Voting Yes: Boyer, Maske, Olson, Sha, & Schwartz. Voting No: Estes, Lachowitzer, & Zimmerman. Break: At 10:40 P.M., the Commission took a 5 minute break. Conditional Use Permit - Craig & Barry Dresser: Motion by Nelson, second by Lee, and unanimously carried to approve a Conditional Use Permit to re-construct existing retaining walls to stabilize hillside and reduce runoff and erosion with conditions as recommended by the Planning Commission. Conditional Use Permit - Bjorn & Barbara Finseth: Mr. Kalar reported that the Planning Commission is recommending denial of a Conditional Use Permit relative to the after-the-fact requests and approval of a Conditional Use Permit for proposed retaining walls on the east and west side of the house. Applicant, Barbara Finseth requested that the condition that the retaining wall be no higher than 2’ be changed to 3’. Discussion followed. Motion by Lee, second by Mosher, and unanimously carried to deny a Conditional Use Permit relative to the after-the-fact requests for the reasons recommended by the Planning Commission. Motion by Lee, second by Froemming, and unanimously carried to approve a Conditional Use Permit for the proposal on the west side of the house and the proposed retaining wall on the east side of the house provided the retaining wall is no higher than 3’ and outside of the bluff impact zone.
