XClusterStructure Setback Structure Size Sewage System Subdivision SPECIFY VARIANCE REQUESTED When we appeared in May, 1998 before the Board of Adjustment for a variance to construct a 3 season porch and deck, we were instructed to remove a pumphouse from its current location. We were not pre­ pared to argue this buildings ^.ocaticnthen, hut now, we would like to present the following information; 1. She building houses the water supply for the lot. 2. The building is behind the String-line. 5. The building has been there since at least 1963. 4. Is only 92" high, and tucked into a hedgeline. 5. Our plans include siding building when cabin is re-sided. It is our request that the portion of last variance requiring removal of this building be reversed, and the building be allowed to remain I UNDERSTAND THAT I HAVE APPLIED FOR A VARIANCE FROM THE REQUIREMENTS OF THE SHORELAND MANAGEMENT ORDINANCE/SUBDIVISION CONTROLS ORDINANCE OF OTTER TAIL COUNTY. Klaers - Denied Motion was made by George Walter, seconded by Randall Mann and unanimously carried, to deny the variance as requested and to allow the applicant 30 days in which to comply with the variance as previously griarited noting that the previously granted variance was approved with the condition that the shed would be removed from it present location. It was noted that the shed must be setback at least 52’ from the ordinary high water level in an area that does not require a variance. Stroud, Battle Lake, MN, requested a variance of 20’ from the required ordinary high water level setback of 200’ for structure setbacks on Lots 1, 2 and 3, Meadow Ridge Estates, of 180’ and a variance that would allow Lot 2, Meadow Ridge Estates, to be considered a buildable lot with less than the required 80,000 square feet of area. Lot 2 has approximately 76,000 square feet of area. It should be noted when Meadow Ridge Estates was platted it was assumed that the ordinary high water level was 1286. It has now been discovered that the ordinary high water level changed in 1988 to 1291. This change has resulted in the loss of approximately 20’ of property along the entire subdivision and has resulted in Lot 20 having less area than required by the ordinance. The property is described as Lots 1, 2, and 3, Meadow Ridge Estates, Johnson Lake in St. Olaf Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, seconded by George Walter and carried with Frank Lachowitzer voting no, to accept Lot 2 as a buildable lot having a total lot area of approximately 76,000 square feet. After additional consideration, motion was made by John Everts, seconded by Frank Lachowitzer to approve a variance of 20’ from the required ordinary high water level setback of 200’ for ordinary high water level structure setbacks on Lots 1, 2 and 3, Meadow Ridge Estates of 180’ noting that the development was prepared and approved based upon what was assumed to be the high water level without any realization that the ordinary high water level had been changed by the Department of Natural Resources in 1988. By a tied vote this motion failed. After additional consideration and discussion, motion was made by John Everts, seconded by George Walter and unanimously carried, to approve a variance of 20’ from the required ordinary high water level setback of 200’ for ordinary high water level structure setbacks on Lots 1, 2, and 3, Meadow Ridge Estates of 180’ with the condition that no additional building will occur ahead of the building line (for example no water - oriented accessory structures would be permitted). It should also be noted a water-oriented accessory structure would not be permitted even if a property owner should decide to develop at the 200’ setback from the ordinary high water level. Mary E. Klaers - Denied Mary E. Klaers, Fargo, ND, requested that the portion of the variance granted May 7, 1998, requiring the removal of an existing shed located approximately 27’ from the lake be reversed and that the structure be allow to remain in its current location for the following reasons: The building houses the water supply for the lot. The property is described as Sub Lot 12 of Government Lot 5, Section 16 of Dunn Township by Fish Lake. Nick Klaers represented the applicant at the public hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by George'Walter, seconded by Randall Mann and unanimously carried, to deny the variance as requested and to allow the applicant 30 days in which to comply with the variance as previously granted noting that the previously granted variance was approved with the condition that the shed would be removed from it present location.
