May 1, 2003 Meeting - The audience was polled with no one speaking for or against the request. After discussion
and consideration, motion was made by Cecil Femling to approve the variance as requested. After additional
discussion this motion was withdrawn. After additional consideration, motion was made by Randall Mann, second by
Leona Zimmerman and unanimously carried, to table this hearing until the May 8, 2003 Board of Adjustment meeting
so that the Land and Resource Department would have an opportunity to mark/determine the ordinary high water

Terry Lejcher, Area Hydrologist with the Department of Natural Resources, the ordinary high water level for Holbrook
Lake has been determined and that the applicants’ proposed development does in fact meet the required ordinary
high water level setback. After discussion and consideration, motion was made by Steve Schierer, second by Cecil
Femling and unanimously carried, to acknowledge and accept the applicant’s request to withdraw their variance
application and to authorize a refund of the applicants’ recording fee.

Gary D and Sylvia A Holthusen - Approved as requested with a condition. (7:48 p.m.)
Gary D and Sylvia A Holthusen, part of Government Lot 3, Section 26 of Lida Township by Lake Lida,
requested a variance to take lake shore (58.05’) and square footage (6,728 square feet approximately)
from the 4.35 acres and add these to Lot 31. This will extend Lot 31 shore line 58.05’ for a new total of
111.96’. This will enable the deed of sale to be registered. The result of this action will be that the 4.35
acres will be reduced by .15 acres to 4.20 acres. I want this remaining 4.2 acres considered a buildable
lot. The audience was polled with no one speaking for or against the request. After discussion and
consideration, motion was made by Paul Larson, second by Steve Schierer and unanimously carried, to
approve the variance as requested with the condition that a registered surveyor’s drawing must be
presented at the time of recording. It was noted that the variance as approved will be an improvement to
Lot 31 of Maplehurst and will not negatively impact the other parcel.

requested a variance of 100’ from the required ordinary high water level setback of 200’ for the placement
of a structure 100’ from the ordinary high water level. The audience was polled with no one speaking for or
against the request. After discussion and consideration, motion was made by Cecil Femling to approve the
variance as requested. After additional discussion this motion was withdrawn. After additional
consideration, motion was made by Randall Mann, second by Leona Zimmerman and unanimously carried,
to table this hearing until the May 8, 2003 Board of Adjustment meeting so that the Land and Resource
Department would have an opportunity to mark/determine the ordinary high water level.
John and Jean Hertsgaard - Approved as modified with a condition. (8:07 p.m.)
John and Jean Hertsgaard, Lot 2, Ripples Beach, Franklin Lake in Dunn Township, requested a variance of
35’ from the required ordinary high water level setback of 100’ for the construction of a 13’ by 14’ sunroom
65’ from the ordinary high water level. A variance from standards would permit us to bring our cabin up to
the standards of neighboring dwellings. The irregular contour of our lot has a flat spot, which is located
where we propose to add our sunroom. Areas to the east which have irregular features, but meet
standards would be disruptive to the integrity of our heavily treed lot. This proposed sunroom is a modest
addition. The audience was polled with no one speaking for or against the request. After discussion and
consideration, motion was made by Randall Mann, second by Paul Larson and unanimously carried, to
approve the proposed sunroom being no closer to the ordinary high water level than what would be allow
by the application of the string line test with the condition that a storage shed located between the house
and the lake must be move to a location which complies with the setback requirements of the ordinance.
The variance as approved will allow the applicants to enjoy the same rights and privileges as others in this
immediate area. Hardship is a substandard lot of record.

assistance of Terry Lejcher, Area Hydrologist with the Department of Natural Resources, the ordinary high
water level for Holbrook Lake has been determined and that the applicants’ proposed development does in
fact meet the required ordinary high water level setback. After discussion and consideration, motion was
made by Steve Schierer, second by Cecil Femling and unanimously carried, to acknowledge and accept
the applicant’s request to withdraw their variance application and to authorize a refund of the applicants’
recording fee.
Connor F, Schmid and R. Murrary Partnership - Approved
May 8, 2003 Meeting -
This variance hearing had been previously tabled at the April 10, 2003 Board of Adjustment meeting.
Randall Mann, Chairman, read that portion of the variance application that will be discussed at this Board
of Adjustment meeting. A letter from Robert L. Russell, Attorney for the applicant, dated May 5, 2003 was
read for the record. The letter stated that the following:
“As you know, the Otter Tail County Board of Commissioners has approved a Conditional Use for the Blue
Heron Bay Cluster Development, including approval of 138 residential housing units. The Applicant is in
the process of revising the original plan for 151 units to conform to the approved CUP."
“Since the revised site plan may modify the size, number and location of Water Oriented Accessory
Structures as proposed in the original plan as well as the number and configuration of dock cluster, the
Applicant hereby WITHDRAWS, without prejudice, the variance request dealing with 1) the number of boat
slips (116 to 138) and 2) the number of water-oriented accessory structures or WOASs (from 1 to 3)."
“We understand that the variance request dealing with the height of the existing barns will continue to be
on the agenda for the Board of Adjustment this Thursday evening. In that regard, I am enclosing diagrams
prepared by Lake Region Surveying, Inc. showing the height of the buildings and their distance from the
lake."
Randall Mann acknowledged and noted for the record that the applicant has withdrawn all requests from
the original variance application with the exception of the height variance request. Randall Mann
requested that the members of the Board of Adjustment, the applicant, the attorney representing the
applicant and those in attendance wishing to address the Board of Adjustment limit there comments to
issues relating to the requested height variances.
