After discussion and consideration, Thomas Lee made a motion, second by Paul Larson and unanimously carried, to
approve the proposed development as described in the variance application dated April 20, 2016 and as depicted on the
drawing submitted with the variance application with the condition that impervious surface coverage cannot exceed
35% upon completion of the proposed project. The variance as approve does not directly or indirectly grant any other
variances for the proposed development. It was noted that the proposed development will be further back from the
ordinary high water level than the existing development.

Kevin Biffert, Lot 3 Block 2 Summer Haven Beach First Addition, Pelican Lake in Scambler Township,
requested the following: Structure to be setback 1 ’ from property line. Property next to mine is fully treed
and no site from others buildings or premise. 30’ by 75’ canopy with top only for parking. Kenny Biffert
represented the applicant at the public hearing. The audience was polled with Laurie and Sue Ishaug
speaking against the variance as requested. Letters and emails from the following individuals in opposition
to the variance as requested were read for the record: George and Sharon Gorton, John Gorton and John
Savre. After discussion and consideration, Steve Schierer made a motion, second by Richard Gabe and
unanimously carried, to deny the variance as requested as no hardship/practical difficulty unique to the
property had been shown that would allow for the granting of the variance as requested and there are other
alternatives available that will provide the applicant with a reasonable use of his property.

Jay and Stacey Stibbe, part of Government Lot 3, Section 10 of Dunn Township by Pelican Lake, requested
the following: I am asking to replace an existing deck. In doing so I would like to make it all one height
and include rail for safety and aesthetic purposes. Federal building code does not support current structure
and design. This is a concern from a liability and insurance standpoint. We are requesting a variance of 54’
for deck to be placed 21’ from ordinary high water level. Existing deck is 16’ from ordinary high water
level. Additionally, because we are giving up deck space towards the shoreline I would like to widen deck
to make a practical space and better match cabin. This also would give our neighbors a better site line.
Current impervious surface is at 37% and proposed will be 37.6%. Current impervious surface is 694
square feet in Shore Impact Zone. Proposed is 740’ square feet. Requesting a variance to increase
impervious surface coverage in the shore impact zone by 46’ square feet. The audience was polled with
Jack Young speaking in favor of the variance as requested. A letter from Duane and Winne Ulschmid in
support of the variance as requested was read for the record. After discussion and consideration, Thomas
Lee made a motion, second by Paul Larson and unanimously carried, to approve the proposed development
as described in the variance application dated April 20, 2016 and as depicted on the drawing submitted with
the variance application with the condition that impervious surface coverage cannot exceed 35% upon
completion of the proposed project. The variance as approve does not directly or indirectly grant any other
variances for the proposed development. It was noted that the proposed development will be further back
from the ordinary high water level than the existing development.
Scott and Chris Zeleny - Variance application approved as requested. (8:35 p.m.)
Scott and Chris Zeleny, part of Government Lots 3 and 4, Section 6 of Gorman Township by Silver Lake,
requested the following: We are asking for 100’ setback from the 200’ for a 40’ camper, outhouse and 12’
by 12’ shed. We have a total of 175’ from the ordinary high water level to the township road. 75’ behind us
is considered low land. Note - 8’ by 8’ water oriented accessory structure 65’ from ordinary high water
level. The audience was polled with no one speaking for or against the variance as requested. After
discussion and consideration, Paul Larson made a motion, second by Thomas Lee and unanimously carried,
to approve a variance of 100’ from the required ordinary high water level setback of 200’ for the placement
of a 40’ camper, outhouse and 10’ by 12’ shed 100’ from the ordinary high water level as depicted on the
drawing submitted with the variance application. Hardship/practical difficulty is the lot size. The variance
as approved will provide the applicants with a reasonable use of their property. The variance as approve
does not directly or indirectly grant any other variances for the proposed development.

List & Identify all existing and proposed onsite shore impact zone impervious surfaces on the scale drawing.
Def # 76. Shore Impact Zone (SIZ):Land located between the OHWL of public water and a line parallel to it at a setback of 50% of the structure setback
(see Section III.4.), but not less than 50 feet. For Ag land the SIZ is 50 ft. from the OHWL (see Section IV.4.).

County Shoreland Management Ordinance, the Otter Tail County Set Back Ordinance and/or the Subdivision Controls Ordinance.
The Otter Tail County Board of Adjustment will assemble for this hearing on
Thursday, May 12, 2016 at 8:00 p.m.
in the Commissioners’ Room of the Otter Tail County Government Services Center, Fergus Falls, MN. (Please use the public
entrance located on the northeasterly side of the Government Services Center. The second left off Fir Ave.) Individuals
requiring special accommodations should contact the County Auditor’s office prior to the date of the public hearing.
