Sewer storage tank setback from proposed Pergola’s as drawn - i. The North Pergola is 10’ by 16’ and is 6’ from septic storage ii. The East Pergola is 10’ by 10’ and is 6’ from septic storage tank and we are requesting both a variance from the tank for the 4’ shortage, and a variance from the south property line of 1 ’ 9”. 2. Variance requested for New Proposed Entry on the North side of the house, the distance to the North property line would be T 4” a 2’ 8” variance from the normal 10’ setback. 3. A proposed bay window (8’ by 2’ 6”) “No Foundation”. It would be 8’ 6” from the south property line as opposed to the 10’, a 1 ’ 6” variance and 44’ to the water setback a 6’ variance. September 10, 2015 meeting - The audience was polled with Catherine Eagan-Spicer speaking against the variance as requested. Jack Young represented the applicants at the public hearing. A letter from Rod Wilson in opposition to the variance as requested was read for the record. Emails from Duane and Winnie Ulschmid and Steve and Cathy Spicer in opposition to the variance as requested were read for the record. After discussion and consideration and with the applicant’s verbal consent, Thomas Lee made a motion, second by Loren Bailey and unanimously carried, to table this public hearing until the October 8, 2015 meeting to allow the applicant an opportunity to consider other alternatives that would limit impervious surface coverage to 25% or less. October 8, 2015 meeting - Prior to the public hearing the applicant submitted an email requesting the continuation of the previously tabled action until the May 2016 meeting of the Board of Adjustment. (9:30 p.m.) Sheila Carney, Lot 1 Block 2 Engstrom Beach and part of Government Lot 1, Section 19 of Edna Township by Big McDonald Lake, requested the following; The required waterfront setback does not allow for a reasonable buildable area due to the short distance from the right-of-way to the water’s edge. Due to the property not having a neighboring structure to the west, we would like to propose a waterfront setback of 50’ from the ordinary high water level. This distance is consistent with the neighboring cabins to the east along Enstrom Beach. Requesting a variance of 50’ from the required 100’ setback. April 14,2016 meeting - The applicant was represented by her architect (Mike Dodgson). The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Thomas Lee made a motion, second by Paul Larson and unanimously carried, with the verbal approval of the applicant’s representative, to table this hearing until the May 12, 2016 meeting for additional information regarding the site (buildable area) and the proposed structure. A letter from Cindy and -Darwin Hendrickson in support of the variances as requested was read for the record. After consideration and discussion and with the applicants’ verbal consent, Thomas Lee made a motion, second by David Wass and unanimously carried, to table this public hearing until the next scheduled meeting of the Board of Adjustment,' which will provide the applicants with an opportunity to review the impact of the permeable pavers on the neighbor’s property, to consider reducing impervious surface coverage to 25% or less, the possibility of extending the culvert to relocate the driveway and to consider alternatives that will place the proposed garage more than 5’ from the lot line. December 10, 2015 meeting - Rick Duval, Contractor appeared with the applicant at the public hearing. The applicant presented a revised set of plans, which requires the following variances: Variance of 20’ from the required ordinary high water level setback of 100’ and variance of 3 ’ from the required side lot setback of 10’ for a 22’ by 24’ garage. Variance of 1% for impervious surface for total of 26%. 1. 2. After discussion and consideration, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to approved a variance of 20’ from the required ordinary high water level setback of 100’, a variance of 3 ’ from the required side lot line setback of 10’ and a variance of 1 % from the maximum impervious surface coverage of 25% for the construction of a 22’ by 24’ garage 80’ from the ordinary high water level and 7’ from the side lot line as described and depicted in the revised plans submitted at the December 10, 2015 meeting. It was noted that the additional 1% would be impervious with or without the use of permeable pavers because it is the area that will be impacted by vehicles. Hardship/practical difficulty is a substandard lot of record. The variances as approved do not directly or indirectly grant any other variances for the proposed development. I am planning to be at the meeting tomorrow night but thought it best to send this information ahead of time in case the council members wish to review documents before the meeting, or if I am detained. We remain against all variances requested for the following reasons: • Lots are small and it places structures to close in proximity which may result in hazardous, unsafe, situations. There is only 90" open grass area from the rock area of their proposed entrance, to our tree; photo #1. This area is the only clear access from road to lake; if an entrance variance is allowed, it would basically put it right on top of our property line, limits access and would only be a few feet from our kitchen window. • The lot in question is 45'. They have continued to add space (unauthorized) by starting with 'bays' that turn into living space: photo #2, #3. #4 that use to be a shed/garage. The proposed variances #1 A & B on the notice of hearing appear to be the same approach, along with item #3 bay window. Our concern is they are enlarging the cabin and shed as an enhancement to interested buyers. Given the ideas to the new owner they could remove all existing buildings and continue with the now enlarged footprint for a new cabin/dwelling. This would be a considerable mistake on such a small lot and be very detrimental to adjacent 2 properties; again for accessibility and safety. I suspect that is why they want the entry. Item #2, on the side of the house verses updating the current entrance on back of the house. • They have rented this cabin out to several individuals and have not lived there; we understand it is rented again this year. Last summer two families were renting the property; 1 family stayed in the house, 1 family in the shed (which became a guest house without permit). There are people coming and going constantly and we have no idea who they are, or if they have permission to be there. • We understand Bob/Jack purchased property with the intention of reselling, without on site visit of the property. Denying the variance will not affect property use and we do not feel that the neighbors should bear the crowding of the property lines which would have an inherent decline in our property values. Denying the variance will not affect property use. • Our lake property next door is our lake home; our children are there. I work in the area with BTD Mfg, Snappy, Pet Care, Team Industries, SJE Rhombus, Tuffy's and Bongard's and feel we have the best interest of the land, and property, in mind for the future years to come.
