Cost of the professional service is $40 per hour and mileage costs. Planning Commission Recommendations Preliminary Plat - “Adair Acres’VPatrick L. & Laurie Thompson: Land & Resource Director, Bill Kalar, stated that Adair Acres is near West Battle Lake and the Planning Commission recommended approval of the plat with six conditions. Chair Froemming opened discussion to the public. Attorney Kris Svingen, representing the developers, reviewed the process since last May wherein the developers addressed concerns regarding the plat. He spoke in favor of the Planning Commission’s recommendation and requested that the County Board approve the Commission’s recommended action. Attorney Steve Rufer, representing lake property owners on the other side of the road of this development, presented concerns with increased crowding on the road and acceptable factors for 2"'* and 3^'^ tier development. He requested that the County Board consider this before making a decision. Discussion followed. Motion by Froemming, second by Mosher, and unanimously carried to approve the Preliminary Plat known as ’Adair Acres” consisting of 13 single family residential lots with conditions as recommended by the Planning Commission. The property is described as Pt of SE1/4 of the NE1/4, Section 31 and Pt of SI/2 of the NW1/4, Section 32 of Girard Township: West Battle Lake (56-239). Conditional Use Permit - Bruce & Nan Carlisle: Motion by Lee, second by Block, and unanimously carried to approve a Conditional Use Permit to contour part of the lot to develop a building pad with conditions as recommended by the Planning Commission. The property is described as Pt GL 6 & Pt NE1/4 NE1/4, Section 10 of Dunn Township: Pelican Lake (56-786) Conditional Use Permit - Ron Buckhouse: Motion by Nelson, second by Mosher, and unanimously carried to approve a Conditional Use Permit to construct a patio and retaining walls with conditions as recommended by the Planning Commission. The covenants (provided by the Applicant at this meeting), must include prohibition of commercial use. 2. A drainage area (elevations less than 1360) between Lots 10 & 11 (drawing dated 6/8/01) must have a dedicated drainage area that is not for building purposes. 3. The driveways must be constructed with a stormwater run-off plan (may require culverts) that is to be approved by Land & Resource Management prior to construction. 4. It must be determined by the Tribal Council as to whether there are any historical sites in the area. 5. A 30’ structure setback to the road right-of-way must be required. 6. According to the letter I received you are discussing a conditional use permit for Dr. Bruce Carlisle. My property is adjacent to theirs on the westsside of their lot. me state I am not against their project, but I have two important concerns. Let 1 St My property is shaped similar to a bowl and my only drainage for water run off is into the ravene they are asking to fill in. My water must run east so they must stay lower than my lot in order for my drainage to work. 2 nd My cabin was built many years ago and sits very close to their lot in places,especially on the north end next to the lake, there is only about 4 feet of space.between my cabin and their lot line. I believe they are planning on drawing some dirt from there into the lower part of the lot. I don't have any problem with that as long as they are careful. For the last two years I have mentioned to them to do something because without rip-rap or something the erosion has really taken a toll, and I am concerned it will affect the stability of my cabinv I am sure they have a very good plan and this problem will be taken care of. e I will repeat that I am not against their project. But I would like something in writing in the variance that protects my cabin from any problems, such as shore line erosion or shifting of my cabin from them moving earth. Also, My drainage must be able to go east onto their property. I want to be a good neighbor but they must be careful to not disrupt some of the soils to cause problems.
