After consideration and discussion, Thomas Lee made a motion, seconded by Douglas Larson and carried with
Terry Marthaler voting no to deny the variance request to allow the impervious surface coverage to exceed 25%
being 28.64% and to exclude the verbiage in the Shoreland Management Ordinance which requires you to count a
driveway/parking area in the impervious surface calculation which would bring the impervious surface down to
27.04%. The Board of Adjusmient members indicated that the deck must be removed by September 30, 2022.This
decision is based on the Findings of Fact and Decision Form, which contains the criteria reviewed and the Board’s
finding have been attached to and incorporated as an official part of the minutes which have been placed on file
with the Land & Resource Management Department.

A variance may be granted only where the strict enforcement of county land use controls will result in a "practical difficulty". A
determination that a practical difficulty exists is based upon consideration of the following criteria:
The applicant identified the following practical difficulty: This is an existing deck. The house was constructed 3.5 years ago and there
were no variances needed. Variance was applied for in 2020 which was denied. Since the Ordinance has been revised there is no
need to have a lake setback variance. There is no driveway as the parking is all done in the road right of wav. This is a substandard
lot.

At the regular meeting of the Dunn Township Board of supervisors on December 11, 2017, at 6:30pm at
the town hall located at 47979 East Lake Lizzie Road in Otter Tail County, Minnesota this Resolution was
introduced by Supervisor Q . tigftSfTTW and moved the adaption of the following Resolution, which
was seconded by Supervisor t)* and unanimously adopted by the town board of
supervisors.
WHEREAS, the Town Board received a petition calling for the vacation of a town road under Minn. Stat.
164.07;
WHEREAS, The Planning Commission held a public hearing on said petition on the 13*’' Day of November

Section 6, Subp. 4
A. Setback Sight Line
Where nonconforming structures exist on the adjoining lots on both sides of a proposed building
site, structure setbacks may be altered, using the sight line method, without a variance to
conform to the adjoining setbacks from the OHWL, provided the proposed structure is not
located in a shore impact zone or in a bluff impact zone. A water-oriented accessory structure
cannot be used to establish a sight line.
Section 8, Subp. 4 (B)
1) Impervious surfaces of lots must not exceed 25 percent of the lot area, of which buildings must
not exceed 20% of the lot area. Impervious surface coverage within the SIZ, that is not part of
a planned unit development, must not exceed 15% of the area of the SIZ.
Staff Comments: Based on a review of the application and a site review. Staff offers the following comments:
This variance was heard last fall and denied. The language for the setback sight line was changed with the
new ordinance by removing the words "like use".
