Todd and Brenda Gross - Denied. (6:45 p.m.)
After discussion and consideration, Thomas Lee made a motion, seconded by Richard Gabe to approve the variance as requested in the
variance application dated June 5, 2017 and as depicted on the drawing submitted with the application. This motion failed to pass with Paul
Larson, Darren Newville and Steve Schierer voting no. Those members voting in favor of the motion noted that this situation was not the fault
of the property owners, but was caused by the contractor and that the property owners acted in good faith. Those members voting against the
motion indicated that the site permit stated the maximum allowable height, indicated that had a request been presented for the additional height
before the construction was started they would not have approved a variance to exceed the maximum allowable height and noting that granting
the variance as requested would establish precedence that they do not wish to establish. The Board noted that the applicants should work with
the Land and Resource Department to resolve the issue on or before October 15, 2017.

OTTER TAIL COUNTY BOARD OF ADJUSTMENT
Thursday, July 13, 2017
The Otter Tail County Board of Adjustment met Thursday, July 13, 2017, with the following persons in attendance:

Called to Order - Steve Scliierer, Chair called the meeting of the Board of Adjustment to order at 6:30 p.ni.
Minutes Approved - The Board of Adjustment approved the minutes of the June 8, 2017 meeting as mailed.
The Board of Adjustment considered the following applications for variance:
Catrina Peterson - Tabled (6:33 p.m.)
Catrina Peterson, Lot 3 Pischke -Taylor First Addition, Spitzer Lake in Leaf Mountain Township, requested the following:
Replace existing dwelling. Requesting a variance to construct a dwelling and a non-dwelling no closer than 100' from the
ordinary high water level. Reason for request unable to meet 200’ setback due to lot size and lake on both sides. All other
requirements would be met. The audience was polled with no one speaking for or against the variance as requested. Two letters
from Dwight Eric Robertson in opposition to the granting of the variance as requested and noting that he was the legal owner of
the property where placed in the file. Catrina Peterson presented a letter from Ryan D. Fullerton, Attorney with Pemberton Law
which disputed Mr. Robertson’s ownership claim. After discussion and consideration, Thomas Lee made a motion, with the
applicant’s (Catrina Peterson) verbal permission, to table the public hearing on this application until the ownership issue has been
resolved. This motion was seconded by Darren Newville and unanimously carried.
Timothy Donley - Variance application approved as requested with a condition. (6:39 p.m.)
Timothy Donley, Lots 7 and 8 Block 1, Brightwood Shoreline, Dead Lake in Star Lake Township, requested the following:
Request variance to construct 40’ by 50’ storage building at 180’ from ordinary high water level. Required setback is 200’.
Request 20’ variance. The audience was polled with no one speaking for or against the variance as requested. The applicant noted
that the size of the building was changed from 40’ by 50’ to 40’ by 48’. Thereby reducing the requested variance from the
required ordinary high water level from 20’ to 18’. After discussion and consideration, Paul Larson made a motion, seconded by
Thomas Lee and earned with Chris McConn and Steve Schierer voting no, to approve a variance of 18" from the required
ordinary high water level setback of 200’ for the placement of a 40’ by 48’ storage building 182’ from the ordinary high water
level with the condition that it cannot exceed the maximum allowable height of 20’. The variance as approved does not directly
or indirectly grant any other variances for the proposed or future development.
Todd and Brenda (Jross - Denied. (6:45 p.m.)
Todd and Brenda Gross, part of Government Lot 1, Section 7 of Dunn Township by Pelican Lake, requested the following: The
rafters were changed from an 8-12 pitch to a 10-12 pitch, thus allowing (for less chance of head injury) a slightly elevated
ceiling on the upstairs storage room. The added room acquired, made the garage 21.9’ in height. The required height for a non
dwelling is 20’. The audience was polled with no one speaking for or against the variance as requested. After discussion and
consideration, Thomas Lee made a motion, seconded by Richard Gabe to approve the variance as requested in the variance
application dated June 5, 2017 and as depicted on the drawing submitted with the application. This motion failed to pass with
Paul Larson, Darren Newville and Steve Schierer voting no. Those members voting in favor of the motion noted that this

Hi Tim, my name is Todd Gross. I own the property on pelican Lake that you may have inspected sometime last winter. If
you remember, Christian Kiedrowski was the contractor on that garage. He told me that the garage did not pass
inspection and that it needed.to go to a variance board. He asked m'e^^and I told him to tell you to proceed with a
variance. I have heard nothing since that time. I had to fire him a few months ago for various reasons, as you may
surmise. As fits his history, it would not surprise me if he chose to ignore it. If you remember, the garage was 11" over
plans. He suggested that we go with a 10-12 pitch, as opposed to the 8-12 pitch on the rafters, to avoid head injuries
going up the stairs. I am not a contractor, arid it sounded good to me. I would appreciate your input as to how to make
this right. I assume, according to my neighbor, who also went through a variance, that I will be fined and have to get a
new building permit! So be it. Personally, I don't know how he keeps his contractors license. That's another subject for
discussion. I just know I wilj never use him again. Lesson learned the hard way. If ypu're not the inspector, could you
please point me in the right direction. I just want this cleaned up.
