Motion was made by David Holmgren, second-by Randall Mann and unanimously carried, to approve a variance to
subdivide, by metes and bounds description and for residential use a 4.16 acre parcel from and existing 17.04 acre
tract with the following conditions: 1) the parcel must contain room for two on-site septic systems, 2) there must be a
building site on the property that does not require any variances and 3) a registered surveyor’s drawing must be |
provided at the time of conveyance. It was noted that the parcel does meet the minimum size requirements for
residential platted lots on a general development lake.

Katherine L. Marcil, Detroit Lakes, MN, requested a varianceito subdivide,,by a metes and bounds
description and for residential use, a 4.16 acre parcel frorn and existing 17.04 acre tract. The property
is described as part of the Southeast Quarter of the Northeast Quarter and part of Government Lots 5
and 6, Section 6 of Dunn Township by Pelican Lake. Milton Lee represented the applicant at the public
hearing. The audience was polled with no one speaking for.or against the request. After consideration,
motion was made by David Holnigren, second by Randall Mann and unanimously carriedrto-approve a
variance to subdivide, by metes and bounds description and for residential use a 4.16 acre parcel from
and existing 17.04 acre tract with the follo\wing conditions: 1) the parcel must contain room for two on
site septic systems, 2) there must be a building site on the property that does not require any variances
and 3) a registered surveyor’s drawing must be provided at the time of conveyance. It was noted that

David D. Schmitz - Denied
Daniel D. Schmitz, Detroit Lakes, MN^ requested a deck that will be 9’ from the west property and 67’
straight line, 93’ surface line from the ordinary high water level. Note only extending 3’ closer than
existing deck. Drain field and septic tanks - the proposed deck extends over the top of the septic tank
and drywell. The clean outs for both tanks will be outside of the structure and the structure will be 8’
above grade at the tanks. 25% of lot surface covered. The existing lot has 25.4% covered with
impervious materials. The proposed deck will increase cover to 26.6% with impervious materials. Note
that the driveway and the deck are included but the deck is 8' above grade and also open below; The
driveway is gravel. If actual surface area were used in lieu of straight-line area the total area covered
by impervious materials including the proposed deck would be 23.1%. Top of Bluff- The entire lot sits
on a bluff. All of the existing structures have been cut into the bluff. The proposed deck will not change
any existing landscape or retaining walls. The property is described as Lot 4, Maple Lane Beach, Little
Pelican Lake in Dunn Township. The audience was polled with no one speaking for or against the
request. After consideration, motion was made}by Mark Steuart, second by Joe Maske and
unanimously carried, to deny the variance as requested-as no adequate hardship had been shown.
Charles Rodine - Denied
Charles Rodine, Gwinner, ND, requested a variance to replace enclosed deck in the bluff impact zone.
The property is described as Lots 3 and 4, Sunset Beach, West Battle Lake in Girard Township. The
audience was polled with Doug King^ and Heidi Huttson speaking in favor of the applicant’s request.
After consideration; motion was made by Randall Mann, second by Cecil Femling and/unanimously
carried, to deny the variance as requested rioting-that the replacement deck will be vi/ithin the bluff
impact zone and will be ahead of the building line. It was suggested that the applicant work with the
Land and Resource Department to determine how much of the.existing deck can be repair before it
would be considered a replacement project.:
