After discussion and consideration, Thomas Lee made a motion, second by Steve Schierer and carried with Ward Uggerud voting no, to deny the variance as requested as the granting of the variance as requested would cause the applicants to violate Minnesota State Rule 7080 and a reasonable use of the property can be obtained with a smaller structrue. Access to the proposed structure would be over part of the existing drain field. Concern was also noted that the proposed structure is oversized for the property size. It was noted that a smaller structure would meet the 10’ side lot line setback requirement’ however, access would still be an issue. Hoiberg Family LLC - Variance application approved as requested. It was noted that the proposed development will be moving back from the water and out of the shore impact zone and that impervious surface coverage would be reduced as well. It was also noted that the parking area for this lot is across the road on a back lot. The placement of an existing storage building and the location of the road make this a unique situation. The variance as approved does not directly or indirectly grant any other variances for the proposed development or for any future development. After discussion and consideration, David Wass made a motion, second by Michael Harris and carried with Paul Larson voting no, to approve a variance of 5’ 6” from the required side lot line setback of 10’ for the location of a structure 4’ 6” from the side lot line. It was noted that the applicant’s acted in good faith, attempted to comply with the ordinance, have incurred a significant financial investment, the placement of the structure in its current location was not an intentional act by the property owners and no significant benefit would be gained by forcing the applicants to bring the existing structure into compliance with the 10’ setback requirement. The granting of the variance as requested is consistent with past actions of the Board. I spent quite a bit of time w/ the Recorders Office per your direction. The point was to identify if the Senn Lot (to be closing late May) was a lot of record prior to Oct 1971. I took the info that they gave me and brought it straight back to you. The attached is the paper that we were working off of that day. The dates along the bottom of the paper are in their handwriting. Given that information and your ok, I let my sellers/buyers know that this is a buildable lot. We closed that transaction. They broke off the piece and relisted the lot w/ me., as they had planned from the onset. Now we have an offer on the lot (w/a small back lot)., those new buyers have been told by the recorder and Michelle in your dept that this is a lot of record as of 1972 and therefore needs a variance. I have this in the hand writing of someone in the recorders office. I can run down there today w/ it so we can figure out who it was that told me this info. Whomever it was spent time on it and really seemed to care & be paying attention to my transaction... knowing that I had explained it was a $950K purchase, etc. Please let me know your thoughts. I object strongly to the proposed variance to allow Mr. Askertooth and Ms. Huseby to build on the riparian lot. It seeks relief from three, not just one, sections of the ordinance. The lake lot is not wide enough nor large enough to support a dwelling under the zoning regulations. Several years ago, when the county prepared to update the Shoreland Management Ordinance, several lake residents and associations, including the Pelican Lake Property Owners Association which I represented, supported Land & Resources proposed zoning for General Development lakes such as Pelican. Crucial to protecting density along the shoreline was the re-affirmation of the 100-foot minimum width of lake lots and minimum lot size. The objective, as I recall, was to reduce the impact of construction on the immediate shoreline. The riparian lot has nothing on it now. It has a shallow slope to the waterline from the back lot, and has a deep swale at the waterline that controls water run-off from many other properties. Developing this land will affect the neighbors for several lots on either side. Mr. Askerooth’s front lot is approximately 79 feet wide, and the lot is not deep enough to meet the SMO standard. By creating a large back lot, he has ample room to build as a matter of right. Please restrict construction to the back lot, and not permit it on the front lot. Approving this variance undermines the authority of the SMO to protect the shoreline. Most existing development along Senns Beach does not comply with the new standards for riparian lots, and this variance will encourage others to overbuild. There is no compelling need in this case to overlook the intentions of the zoning regulations, because a house on the back lot would have an unobstructed view of our beautiful lake.
