MOTION AS FOLLOWS:

Motion was made by Randall Mann, seconded by Cecil Femling and unanimously carried, to approve as a buildable lot
the subdivision, by metes and bounds description, a parcel having a total lot area of approximately 37,402 square feet and
having a lot width at the building line of approximately 147’. It was noted that this parcel would be adjacent to an existing .
substandard development. It was also noted that the applicant’s request is a reasonable request.

parcel will be permanently attached to Lot 10, Block 1 of Haugen’s Point and that the 30’ by 46'
structure located on the 120’ by 50’ parcel will meet the setback requirements. The property is
described as Lot 1, Block 1, Haugen’s Point, Pelican Lake and Bass Lake in Dunn Township.
The audience was polled with no one speaking for or against the request. After consideration,
motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to
deny the variance as requested as no adequate hardship had been shown, the granting of the
variance would establish a precedence for side lot line setbacks on back lots within this
immediate area and the granting of the variance would create a substandard situation.
Arland Gordon Erlandson - Approved
Arlan Gordon Erlandson, Detroit Lakes, MN, requested a variance to subdivide, without platting,
a parcel of less than 5 acres (approximately 37,402 square feet) from an existing 49.65 acre
parcel. The applicant also requests a “3’ width at the building line.” The property is described
as part of Government Lot 1, Section 2 of Dunn Township by Little Pelican Lake. The audience
was polled with no one speaking for or against the request. After consideration, motion was
made by Randall Mann, seconded by Cecil Femling and unanimously carried, to approve as a
buildable lot the subdivision, by metes and bounds description, a parcel having a total lot area of
approximately 37,402 square feet and having a lot width at the building line of approximately
147’. It was noted that this parcel would be adjacent to an existing substandard development.
It was also noted that the applicant’s request is a reasonable request.
John and Mary Simko - Approved
John and Mary Simko, Sioux Falls, SD, requested a variance of 10’ from the required road right-
of-way setback of 20’ for the placement of 30’ by 26’ garage 10’ from the road right-of-way.
Frost footings were installed 10’ from the road last fall. The property is described as part of Lot
4, Eagle Lake Beach, Eagle Lake in Eagle Lake Township. The audience was polled with no
one speaking for or against the request. After consideration, motion was made by Craig
Anderson, seconded by Robert Schwartz and carried with John Everts abstaining, to approve a
variance of 10’ from the required road right-of-way setback of 20’ for the placement of the
proposed garage 10’ from the road right-of-way with the condition that the vehicle ingress and
egress must be at a right angle to the road. It was noted that the applicant’s lot does contain a
bluff.
Michael David Heiser - Approved
Michael David Heiser, Eagle Bend, MN, requested a variance of 5’ from the 18’ maximum height
of a non-dwelling structure for the construction of a 40’ by 56’ shop having a maximum height of
23’. The property is described as Government Lot 12, Section 22 of Eastern Township by Lake
Mary. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by John Everts, seconded by Randall Mann and unanimously
carried, to approve a variance of 5’ from the 18’ maximum height of a non-dwelling structure for
the construction of a 40’ by 56’ single story shop approximately 200’ from the township road and
having a maximum height of 23’. It was noted that the height of the structure is needed to
accommodate the size of the overhead doors that are required for a semi-truck entrance. It was
also noted that the applicant has a very large parcel on an undeveloped lake and that the
structure will be setback approximately 400 to 500’ from the lake. It was also noted that the
placement of this structure in this location will not set a precedence for this immediate area nor
will this structure obstruct the view of future lake development.

Douglas N. Krieger - Approved
Douglas N. Krieger, Pelican Rapids, MN, requested the following: “Due to the indicated depth
of our lot, in order to build the home that we want, we will require a variance to allow 10.25’ of
the Southwest corner of our house and 14’ deck to extend beyond the setback point as
indicated on submitted drawing”. The property is described as part of Lot 1 and all of Lot 2,
Henry’s Hill Subdivision of Government Lots 3 and 4, Section 27 of Dunn Township by Franklin
Lake. The audience was polled with no one speaking for or against the request. Letters from
the following individuals in favor of the applicant’s request were read for the record: Louis
Krieger, Esther H. Henry, Andrew (Butch) Vander Plaats and Roger L. Cross. In addition, a
letter from Judy Sumpter, Dunn Township Clerk, indicating township approval of the applicant’s
request so long as the structure is at least 36’ from the edge of the township road. After
consideration, motion was made by John Everts, seconded by Cecil Femling and unanimously
carried, to allow the use of the string line as depicted on the applicant’s drawing. The string line
would be applied from the house on the point, which is two lots to the west of the applicant’s lot,
to the house on the lot immediately to the east of the applicant’s lot. Hardship is a substandard
lot of record. It was noted that this is a good location for the placement of this dwelling and that
the dwelling located on the first lot to the west is out of place making it impractical to use when
determining the string line.
Gerald M. Hall - Approved
Gerald M. Hall, Oxbow, ND, requested a variance of 4T from the required ordinary high water
level setback of 75’ and a variance of 3.5’ from the required shore impact zone setback of 37.5’
for the construction of a 20’ by 24’ two story addition to an existing dwelling approximately 34’
from the ordinary high water level at its closest point. The property is described as Lot 3, Block
2, Oak Grove Summer Resort, Pelican Lake in Scambler Township. Mark Neslon, Architect,
appeared along with the applicant at the public hearing. Wally Senyk, County Attorney,
reviewed, for the benefit of the board members, the applicant’s past variance requests and past
development of this property. The audience was polled with no one speaking for or against the
request. After consideration, motion was made by John Everts, seconded by Craig Anderson
and unanimously carried, to approve a variance of 41’ from the required ordinary high water
level setback of 75’ and a variance of 3.5’ from the required shore impact zone setback of 37.5’
for the construction of a 20’ by 24’ two story addition to an existing dwelling approximately 34’
from the ordinary high water level at its closet point as depicted on the architect’s drawing. It
was noted that the new construction will be behind the existing setback line, that the existing
deck will be removed, a portion of the existing structure (10’ by 14’) will be demolished as
depicted on the architect’s drawing, most of the new deck will be out of the impact zone, the
new deck will not exceed 3' in height and the new construction will be no closer to the ordinary
high water level than the existing structure. It was noted that the overall plan is an improvement
over the existing situation.
Landis M. Weaver - Approved
Landis M. Weaver, Ottertail, MN, requested a variance of 8 to 10’ from the required ordinary
high water level setback of 75’ for the addition of a 30’ by 34’ canvas awning, to an existing
upper deck, approximately 65 to 67’ from the ordinary high water level. Additional information
concerning the applicant’s request is available at the County Auditor’s office. The property is
described as part of Government Lot 3, Section 21 and part of the Northwest Quarter of the
Northwest Quarter, Section 28 of Otter Tail Township by Otter Tail Lake. The audience was
polled with no one speaking for or against the request. After consideration, motion was made
