(Date/lnitiai) MKL — 0483-001 256,371 — Victor Lundeen Co., Prirtiers. Fergus Falls. Minnesota Page 3. - April 8th. 1993 Brad D. and Craig P. Colman - Withdrawn Brad D. and Craig P. Colman, Fargo, ND, requested a variance to construct a double garage with living quarters. This structure would be considered a second dwelling for this lot. The proposed dimensions of the garage are 28' by 28' with a height of 18'. The applicant's long term goal is to construct the garage and later add on a house and eventually remove the existing cabin that is located 20' from the lake. The property is described as part of the NW1 /-^.Section 2 of Dunn Township on Little Pelican Lake. The audience was polled with no one speaking for or against the request. A letter from Orris Shulstad in favor of the applicant's request was read for the record. After much discussion and consideration, the applicant decided to withdraw his variance application. Donald Shol - Approved Donald Shol, Erhard, MN. requested a variance to subdivide a 4.97 acre tract into two lots by metes and bounds description. Lot 1 will have approximately 108,900 square feet of area and lot 2 will have approximately 107.593 square feet of area. Lot one is considered a back lot and requires a variance of approximately 51,100 square feet from the required lot area of 160,000 square feet and a variance of 86' from the required lot width of 300'. Lot two is less than 2.5 acres in size and requires a variance from the subdivision controls ordinance. Lot 2 does meet the minimum shoreland ordinance requirements for platted lots on a natural environment lake. The property is described as part of Government Lot 2, Section 1 5 of Friberg Township on Heilberger/Little Heilberger Lake. Appearing with the applicant at the hearing was Larry Samuelson, the potential buyer of Lot 2. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by Dan Oehler and unanimously carried to approve the variance as requested by the applicant, with the provision that both a surveyor's drawing and a statement indicating that there are no property line disputes will be provided at the time of recording. Hardship being that this is a section of land located between Little Heilberger Lake and Heilberger Lake. Each lot meets the minimum shoreland ordinance requirements for platted lake lots. These lots are of legal size depending upon direction from which they are viewed. It should be noted that there will be no buildings on the property to the east of Lot 1 on the other side of County Road No. 22. Susan Person - Approved Susan Person, Dent, MN, requested a variance of 1 r from the required 20' road right-of-way setback for the construction of a 5' 5" high retaining wall. The property is described as Lots 5 and 6, Kozelnik's Beach, Big McDonald Lake in Edna Township. The applicant was represented by Robert Person and Peter M. Irvine, Attorney. A letter from the Edna Township Board was read for the record. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Dan Oehler and carried with Bert Olson and Cecil FemHng voting no, to approve a variance of 11' from the required 20' road right-of-way setback for the construction of a 5'5" high retaining wall as presented in the applicant's modified plan subject to the approval of the Edna Township Board and as approved by the Otter Tail County Planning Commission. The left and right retaining walls must be in line with each other.
