Chairman Rogness declared the meeting of the Otter Tail County Board of Commissioners recessed for a committee meeting and lunch break. The Board meeting was reconvened at 1:00 p.m. Dog Bite Hearing County Attorney, David Hauser reported that the Sheriffs Office declared the dog “Hunter” owned by Casey Strauch a potentially dangerous dog under M.S. 347.50 through 347.565. Mr. Strauch was given notice and an opportunity to request a hearing. Mr. Strauch requested the hearing; however did not appear for the hearing. Motion by Huebsch, second by Lindquist, and unanimously carried to affirm the Sheriffs designation that the dog “Hunter” owned by Casey Strauch is a potentially dangerous dog under Minnesota Statute. Discussion took place regarding possible safeguards needed for public safety. Commissioners requested that a Dog Bite Hearing be scheduled under the County’s Animal Health and Control Ordinance and that Mr. Hauser return to the Board with an update at the next regular County Board meeting. Otter Tail County, Planning Commission July 13, 2016; Page 2 CIC #53 / Copper Landing at Horseshoe Bay / Tradeshares Investment Group - Approved as Presented: A Conditional Use Permit Application (as stated by the Applicant on the Application): Request to modify CIC #53 (Conditional Use Permit #6602) of Copper Landing at Horseshoe Bay from 10 dwelling units, two of which currently exist, to a total of 6 dwelling units, to include 4 boat slips, a day dock, a fishing pier and a walking path. The project is located in that Part of Gov’t Lots 1 & 2 and the East Half of the Northeast Quarter and CIC #53, Section 22 of Buse Township: Horseshoe Lake (56-834), NE. Keven Aschnewitz (Tradeshares’ Investment Group) and Dan Hanson (Meadowland Surveying) represented the Application. Scott Juven had questions on the proposal and expressed opposition. Motion: A motion by Wilson, second by Bailey to approve as presented, reason being that this request proposes a reduction in the number of dwelling units. Voting: All Members in favor. Steven D Lind & Todd M Axtman - Approved as Presented: A Conditional Use Permit Application (as stated by the Applicant on the Application): Please consider this application for the installation of an elevated sand beach sitting area. The sand area is irregularly shaped and is approximately 40’ wide and has an average depth of 14’. A portion of the sand would remain behind the existing riprap and would have a 6” concrete curb edge around the perimeter. The sand depth would be approximately 15” deep requiring approximately 46CY of imported mason sand. There are several sand beaches which currently exist to the east along the shoreline. The project is located in Pt GL 4 SWIy of McDonald Shores 1®’ Addn., Section 20 of Edna Township: Big McDonald Lake (56-386), RD. Mike Lloyd, Seven Lind & Todd Axtman represented the Application. Unfortunately I am unable to attend said hearing due to American Legion obligations but respectfully denounce this request based on clear rules for NO development of lake shore on environmental lakes such as Hancock Lake. Mr. Bossert’s “beach” has a slope too steep that has already and will continue to erode into the lake over time causing damage with sediment flow into this environmental lake. I understand variances with zero environmental impact on Hancock Lake have been requested previously with the Commission’s response: “If we do it for you, we have to do it for everyone”. Approval of Mr. Bossert’s After-The-Fact Conditional Use Permit Application Request sets new precedent. Why have ANY lakeshore management rules when anyone can do what they want then simply pay $650 fine after being caught? For a mere $650 penalty, others on this lake will have a green light to rent a bobcat and destroy the natural lakeshore to build a beach.
