A motion by Davis., second by Nelson to withdraw the motion
by Davis concerning Walter Palm sewage system on Eagle Lake
contained in minutes of September 3j 1975 meeting.

A motion by Edlund, second by Delzer to approve the special
use permit of Ted Carr,dated September 2l\., 1975 on Walker
Lake, No. 5^-310j RD, Sec. 12 of Amor Twp. subject to
special use notice. Adjoining people to respond no later
than October l6, 1975 if they have objections. The County
Board shall evaluate any objections received on October 21,
1975 and make a decision. Reason for this action is to
provide additional time to construct road prior to freeze-up.
Voting Yes: Lenius, Edlund, D. Nelson and Delzer.
Voting No; Beck, Davis and Estes. Ryan abstained.

Dear Sir,
We have been inspecting sev/age systems and issuing
abatements on illegal systems on Eagle Lake. One
lot has a questionable variance, Mr. Walter Palm's
cottage located on Lot 5 of Okenson Beach. It appears
that the tovin board gave verbal permission to Mr. Palrri
to encroach on the township right-of-way. If this
is the case would you i^upply this office with a vrritten
document approving such encroachment if not we will
issue Mr. Palm an abatemsnt on his system. Your
prompt reply vjould not only be appreciated by us but
no doubt by Mr. Palm.

Dear Mr, Lee:
It was unfortunate that I missed you when I visited your office
yesterday, seeking information and interpretation of your policy
as far as the Shorland Management Ordinance of Otter Tail County
is concerned.
Specifically, how the enforcement of this ordinanee was, or will
be applied to lot No. 5, Okerson Beach, Eagle Lake, owned by Walter
Palm,
After reading the management ordinate, sketching his lot and
building, I found less than 10 square feet available for an acceptable
drain field. My first reaction was that the other lot owners
should be given the same variance that was granted Palm when we
modified our sanitary system to conform.
The variance options appeared to be:
An easanent from the town board for an installation next
to the road within the 10* boundry.
An easement from an adjoing lot owner for installation
within the 10’ setback,
A variance waiving the 20* distance from an occupied
building.
When Palm first showed me his new basement, I noticed how wet the
walls appeard to be going several blocks above the floot level,
it occured that a variance on item 3 could constitute a health
hazard, and I would not want that on my property,
I did not see a plot plan with dimensions as required with the
copy of the application, if it had been, I am sure your office
would have recogonized the above problem.
It would appear that yoiir office was not given the proper advance
notice and the system was covered before an inspection could be
accomplished, so the need for a variance was not recognized.

An attempt to circumvent your ordinace in this case would have
to be deliberate, since the information that I have, another
contractor refused to bid on this job because there was not sufficient are available for a drain field.

Fortunately the composers of this ordinance also included an
enforcement provision with penalties.
Enclosed herewith is a copy of a petition that has been circulated,
and a hearing has been scheduled by the town board for nine AM
on August 2nd. If the old road is laid down, a variance under
General Paragraph "G”, regarding trucks, etc, be forbidden to
drive over a system after it has been installed,
Mr, Palm has been the leader in opposition to relocating the
road, has been flaunting his "legal” sanitary system before
lot owners* and has a degree of support because they have made
the statement that if Palms* is legal, ours will be. If Palm
is confronted by the fact that he may have the same drain field
problem as the rest of us, his attitude may change.
Be assured that I will take whatever redress necessary.
