MN 56311 PH. 612-528-2235 July 5, 1984 ,T Commission Members: I have been retained by a group of property owners on Eagle Lake in Otter Tail County regarding a proposed variance from the Otter Tail County Shoreland Management Ordinance. Apparently, Mr. Donald Boom of Wheaton, Minnesota, has applied for a variance in order to fill a lot in to a depth of feet. My clients, Frank Peterson, Vivian Mattson, Herb Eichstadt and Harry Retting all own property that could be affected adversely by this action. At the hearing held on July 3, 1984, members of this group were present to express their concerns. It is their request that no variance be granted until adequate assurances are given to the Commission that the variance will not cause damage to their property by altering the natural runoff scheme in the area concerned. In the event the Commission grants the variance without such assurances, my clients intend to seek injunctive relief in order to obtain an opinion from a competent, professional surveyor regarding this matter. On behalf of the group, I respectfully request the Commission to inform me of any further action it may take in this matter.
