(7:28 p.m.) ' Albert and Rebecca Schierman, Lot 1 of the Subdivision of Lot 9 Block 2 Crystal - Lida Beaches, Lake Lida in Lida Township requested the following: Deck plus railing exceeds the acceptable ordinance requirement of the County, Deck is less than 75’ from the, ordinary high water level. The drawing submitted with the I variance application indicates that a portion of the deck is also ahead of the string line. The audience was polled with no one speaking for or against the variance as requested. A letter from Duane Trout in support ' of the variance as requested was read for the record. After consideration and discussion, Steve Schierer made a motion, second by Paul Larson and carried with Cecil Femling voting no, to deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested and noting that the Board would not have approved this variance request had the request been submitted prior to completion of the project because the deck is ahead of the established building line. Richard and Karen Bleess -Tabled. (7:45 p.m.) Richard and Karen Bleess, Lot 2 Friese Beach, Eagle Lake in Eagle Lake Township, requested the following: Current structure is in bluff zone area. 1. Need variance for dormer on west side (approximately ' 14’ by 6.5’) and 2. Need variance for addition on east side (approximately 14’ by 27’). Closest addition will be 10’ from bluff. Need 20’ variance. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Randall Mann made a motion, to approve the dormer addition and to deny the 14’ by 27’ addition. (8:03 p.m.) Terry and Judy Johnson, Government Lot 1, Section 5 of Star Lake Township by Moore Lake, requested a i variance of 62’ from the ordinary high water level setback of 200’ for the placement of a 28’ by 50’ house with a 26’ by 28’ attached garage and a variance of 104’ from the required ordinary high water level i setback of 200’ for the placement of a 40’ by 60’ storage building 96’ from the ordinary high water level. The audience was polled with Lyle Paulson, Robert Richard and Charmaine Richard speaking against the variance as requested. After consideration and discussion, Steve Schierer made a motion, second by Randall Mann to deny the variance as requested noting that it is not a buildable lot and the granting of the variance as requested would establish precedence. The motion to deny failed with Michael Harris, Paul Larson and Robert Schwartz voting no. After discussion and consideration, Michael Harris made a motion, second by Robert Schwartz and carried with Randall Mann and Steve Schierer voting no, to approve variances of 95’, 7’ and 62’ from the ordinary high water level for the placement of a 28’ by 50’ house with an attached 26’ by 28’ garage 105’ from the westerly ordinary high water level, 193’ from the southerly ordinary high water level and 138’ from the easterly ordinary high water level as depicted on the drawing dated July 12, 2006 with the condition that no other variances are required for the proposed development ! and to deny the variances as requested for the proposed 40’ by 60’ shed as no adequate hardship unique to the property had been shown that would allow for the granting of the variances as requested for the shed. i ,i ■ i .September 7, 2006 Page #4 Elj Pachel - Denied. After consideration ;and discussion, Steve Schierer made a motion, second by Paul Larson and unanimously carried, to deny the variance as requested noting that the requested variance no longer reflects the' variance required, therefore, it would not be appropriate for the Board to.act upon the revised information until a new application is submitted and proper notification has been provided. *V.' After consideration and discussion, Randall Mann made a ; 1 motion, second by Cecil Femling to approve development (structure and/or decks over 3’) being no closer to the ordinary high water level than what would be permitted by the established building line with the condition that the 4 proposed structure must be a single story structure and with the condition that no more than 25% of the total lot area • > can be covered with impervious surfaces. The motion was withdrawn after additional discussion. After addition i consideration and discussion, Steve Schierer made a motion, second by Paul Larson and unanimously carried, with ' the verbal perrriission of the applicant, to table the public hearing until the September 7, 2006 meeting to allow the applicant an opportunity to reconsider her proposed development plans. I the Board noted that the building addition will be to the. rear, of the existing dwelling and away from the bluff. The Board also noted that the variances as granted do not directly or indirectly grant any other variances.
