MOTION AS FOLLOWS:
Motion was made by Randall Mann, seconded by John Everts and unanimously carried, to
approve a 1' variance from the required road right-of-way setback of 20' for the
construction of a house with an attached garage 19' from the road right-of-way with the
provision that the total area occupied by buildings and other imperious surfaces cannot
exceed 25X of the total lot area.

porch area (lake side).
This variance was requested by the ShorelandManagement for the
site line of the neighbor to the south of the building site.
The neighbors are Bob and Norma Meyer.

Ditch 21 Report/4-11-95
We began the determination of benefits by classifing each 40 acre tract
of agricultural land as follows.
!:A-Land = Land that has a muck soil, which may have standing cattails,
water, unable to farm without the ditch.
B-Land = Soil types that are alow to drain, can be farmed most years.
Medium benefit.
Maximum benefits.
C-Land = Soil types that are slow to drain, can be farmed every year.
Minimum benefit.
D-Land = Soil types that are well drained, always farmed, does
contributes silt and runoff to the system.
After the agriculture land classification process was completed, we
used the form labeled "Agriculture Production" (appendix A), and the
distance of each 40 acre parcel to the ditch, to determine the economic
benefit (in dollars) to agriculture land.A and B land may be subject to
the regulations of the C.F.S.A. and the C.S.S.A. or other governmental
agencies.
Following an onsite land and water (boat) inspection, lakeshore
frontage was classified as follows:
A-Frontage = Maximum benefit- 3' above ordinary high water level (OHWL)
to 5' above OHWL
B-Frontage = Minimum Benefit- 5' above OHWL to 8' aboye OHWL
C-Frontage = Least benefit - Contributing to water by runoff- 8' above
OHWL or undevelopeable (elevation, width, etc).
Once these classifications were established we calculated the economic
benefit (in dollars) for lakeshore property.
As ditch viewers appointed by the County Commissioners, it is our
opinion that this is a fair and equitable determination of benefits and
damages (cost of buffer strips) for the ditch #21 watershed area.
See appendix B.

Orris L. Leabo - Approved
Orris L. Leabo, Fergus Falls, MN, requested a variance of 30’ from the required ordinary
high water level setback of 200' for the construction of an addition 170’ from the
ordinary high water level. The property is described as part of Government Lots 5 and 6,
Section 1 of Aurdal Township on Fish Lake. The audience was polled with no one speaking
for or against the request. After consideration, motion was made by Randall Mann,
seconded by Craig Anderson and unanimously carried, to approve a variance of 30’ from the
required ordinary high water level setback of 200' for the construction of an addition
170' from the ordinary high water level. It was noted that the addition will not obstruct
the view of the adjacent properties. It was noted that when the original structure was
constructed in 1978 it was 230' from the ordinary high water level. Hardship being the
significant changes in the established ordinary high water level for Fish Lake and the
peninsula shape of the applicant’s property.
Thomas Allen lieinhandl - Approved
Thomas Allen Weinhandl, Henning, MN, requested either a variance to subdivide a 1.27 acre
parcel from an existing 4.27 acre parcel or a variance to subdivide a 1.24 acre parcel
from an adjacent 24.44 acre parcel for the purpose of combining with the 1.27 acre parcel
thereby creating a parcel of approximately 2.5 acres. The property is described as part
of the Northeasi Quarter of the Northeast Quarter, Section 22 of Inman Township. The
audience was polled with no one speaking for or against the request. After consideration,
motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to
approve a variance to subdivide a 1.27 acre parcel from an existing 4.27 acre parcel with
the condition that a letter stating that there are no boundary line disputes must he
presented when the document is recorded.

David James Rivers, Blaine, MN, requested a variance of 7' from the required road right-
of-way setback of 20’ for the construction of a house with an attached garage 13’ from the
road right-of-way. The property is described as Lot 29, Okeson Beach, Eagle Lake in Eagle
Lake Township. The audience was polled with no one speaking for or against the request.
After consideration, motion was made by Randall Mann, seconded by John Everts and
unanimously carried, to approve a 1' variance from the required road right-of-way setback
of 20’ for the construction of a house with an attached garage 19’ from the road right-of-
way with the provision that the total area occupied by buildings and other impervious
surfaces cannot exceed 257. of the total lot area.
