We are not requesting water or sewer hookups, as they are moveable. June 8, 2017 meeting - A letter from Vernon and Alyce Smith in support of the variance as requested was read for the record. A letter addressing the variance request from Lucy Tabatt was read for the record. An email and pictures from Kevin Biffert was noted for the record. The applicant was represented at the public hearing by Lori and Diane Ishaug. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, with the applicant’s verbal permission, to table their request until the July 13, 2017 meeting of the Board of Adjustment so that the applicants can have an opportunity to discuss with Land and Resource Department the procedures and process for a cluster development. The members of the board expressed concern that the granting of the variance as requested would establish precedence that they are not interested in establishing. Following the tabled motion in May of 2015, we worked with Anderson Surveying and others to present a plan for a PUD development...as several indicated to us that this was a direction that we should pursue. This proposal was brought to the County Planning Commission 3 months ago, in August of 2016, with the end result being a denial of the proposal. However, a member of the County Planning Commission said to us at the August meeting, that there has to be a way to make this work...and we are now looking into alternative solutions that would make this work and be a win/win for all involved. Here are my concerns: Eagle Lake property owners have a long history of caring deeply about the environmental impact we leave on the lake and land surrounding the lake. There were/are building rules put in place that echo this desire. My fear is the beginning domino-effect of development on the land all the way around the lake. How can one owner or group of owners be granted special building rules without others starting down this process? Another environmental impact is that of 4 separate properties all using the same small lakeshore footage. This is something Peterson Family Cabin, LLC property has been doing over the past number of years. In addition to the main house on the lake, they have parked 3 large trailers on this property behind the road. Because of the above stated concerns, I am not in favor of Peterson Family. The officers and directors of ELLA have considered the variance request and do not believe it is consistent with our organization's purpose. We monitor shoreland ordinance changes and educate our members on proposed changes. We applaud the County Commissioners for adopting the ordinance and its amendments including the public input they carefully consider. We specifically monitor all variance requests on and around Eagle Lake. We do not routinely object to variance requests unless we believe they are contrary to our purpose. This variance request should not be granted, because it is an attempt to avoid the back-lot requirements of the shoreland ordinance. Such requirements were adopted to avoid overcrowding. While the Ordinance provides a process for variances, we do not believe this variance request provides any justification as to why it should be approved. It appears to be designed to convert one single family residential lot into possibly 4 residential units. We made commitments last December to be gone for three weeks during the time of the hearing. We own the .59 acre tract shown on the land survey that is part of this variance request. It is westerly of Lots 10,11 and 12 of Rosenquist Beach. It is adjacent to the west side of South Eagle Lake Trail. There is only one culvert underneath South Eagle Lake Trail. It is 12" in diameter and 30 feet long and made of steel. This culvert goes from our .59 acre tract to Lot 11 (Linda Bailey Lot) and through a drainage ditch towards Eagle Lake. The drainage ditch on Lot 11 is partly plugged all the way and particularly near the east end of the culvert. This impedes the flow of surface water from the 10 to 15 acres from the west side near MN Hwy. 78 to the east end which is South Eagle Lake Trail and southerly from South Eagle Lake Road. The drainage area also includes land to the north west of the culvert. South Eagle Lake Trail was reshaped on the surface a few year ago coming down from the hill going northerly and running more of the surface water to the west side of South eagle Lake Trail. This extra run-off water can then flow towards our .59 acre tract. This culvert and ditch on Lot 11 did have considerable water at times when the Peterson and Rettig land was owned and farmed by Mr. Rosenquist. That land has been mostly undisturbed for years. The culvert did have water flow in April of 2014 during the time of snow melting and other times. Our concerns are as follows: 1. We are concerned if three residential lots are established on the Peterson property. It is possible surface water would drain faster towards the culvert on our .59 acre tract if more impervious surface is developed. 2. The culvert and partially blocked ditch (wood blocks, stones, concrete blocks and dirt) on Lot 11 cannot take very much surface water as it exists now. 3.^ Any variance^nted tends to set guide lines for future requests.
