Motion was made by Steve Schierer, second by Mark Steuart and carried with Cecil Femling voting no, to deny the
variance as requested noting that many variances are required for the proposed development and also noting that
there are many unknown factors. For example well and septic locations, proper amounts of impervious surface
coverage and the road right-of-way location.

Daniel W. and Tracy L Faleide, Fargo, ND, requested the following: “set back to OHWL - This is an elevated
lot meeting the 30% slope, but not the height of a bluff (16’ 5"). This structure needs to be built towards the
water side of the lot because of limited parking area due to the slope in the back of the lot.” The drawing •
indicates a 24’ by 32’ cabin 39’ from the ordinary high water level and also indicates a 14’ by 48’ area 48,’ from
the ordinary high water level. The required ordinary high water level setback is 100’. The property is
described as part of Government Lot 7, Section 28 of Dunn Township by Lake Lizze. The audience was polled
with no one speaking for or against the request. After consideration and discussion, motion was made by
Steve Schierer, second by Cecil Femlirig and unanimously carried', to approve the construction of a
garage/storage building 50’ from the ordinary high water level with the condition that the proposed structure
can be no more than 40’ in length and must be at least 10’ from the lot line. Hardship is the topography and
terrain of the applicants’ property and.tbe unique shape of the lot.
David M. and Shawn M. Olson - Tabled

David M and Shawn M Olson, Frazee, ;MN, requested a variance to place a 14’ by 24’ detached, unenclosed,
floating foundation deck less.than 10’ from the sewage system. The property is described as part of Lot 6, ■
Block 1, Scalp Lake Acres, Lake Seven in Hobart Township. The audience was polled with no one speaking
for or against the request. After consideration and discussion,' motion was made by Randall Mann, second by
Steve Schierer and unanimously carried, to table the applicants’request, for additional review by the
applicants, until the September 6‘^, 2001 meeting of the Board of Adjustment. It should be noted that the
applicant (David Olson) verbally agreed to the Board’s action to table his variance request.
Ronald D. Krenz - Approved with conditions.
Ronald D. Krenz, Clitherall, MN, requested a variance to raise the house up, to rhove the house off the
existing foundation, to repair the foundation by extending it below the frost line and by raising the top of the
foundation wall 3’ above it’s present height. The existing structure is 8 to 10’ from the crest of the bluff. The
property is described as Lot 5, Shady Acres Beach, Survey Lots of Government Lot 4, Section 31 of Girard /
Township by West Battle Lake. The audience was polled with no one speaking for or against the request.
After consideration and discussion,'motion was made by Cecil Femling, second by Steve Schierer and
unanimously carried, to approve the repair of the foundation with the following conditions: 1.) the repaired
structure must occupy the same footprint as the existing structure, and 2.) the existing deck cannot be altered
and the existing deck must remain in the exact same location after the foundation has been repaired. The
granting of the variance will allow the applicant the ability to repair and protect his existing structure without
altering the essential character of the applicant’s property.
James R. Braun - Denied
James R. Braun, Soiux Falls, SD, requested a variance of 5’ from the required ordinary high water level
setback of 75’, a variance of 2’ from the required side lot line setback of 10’ and variances of 2’ and 14’ from
the required road right-of-way setback of 20’ for the placement of a 22.5’ by 40’ two story addition 70’ from the
ordinary high water level and 18’ from the road right-of-way and for the replacement of an 8.5’ by 5’ storage
building with a 12’ by 16’ storage building 8’ from the side lot line and 6’ from the road right-of-way. The
property is described as Lot 4, Rosenquist Beach, Eagle Lake in Eagle Lake Township. Terry Braun
represented the applicant at the public hearing. The audience was polled with no one speaking for or against
the request. After consideration, motion was made by Steve Schierer, second by Mark Steuart and carried
, with Cecil Femling voting no, to deny the variance as requested noting that many variances are required for
the proposed development and also noting that there are many unknown factors. For example well and septic
