Planning Commission April 10. 2002 Page 2 Ahead of Schedule: The Planning Commission got ahead of schedule and Bill Kalar discussed the following with the Commission: 1. Mr. Kalar distributed and discussed a booklet from the 2002 Planning & Zoning Workshop that was received from David Hauser. He requested the Commission review the booklet. 2. Bill Kalar distributed a memo from the Wetland Technical Evaluation Panel regarding "Pleasant Pointe", Little Pleasant (56-1127), Pleasant (56-449) & Little Anna (56-450) Lakes. This memo indicates that they are in agreement with the proposed township road relocation provided the DNR purchases proposed Lot 1. 3. Bill Kalar discussed with the Commission the possibility of GIS generating maps when preliminary plats are being considered. The process is in the early stages, but is being looked into. 4. Bill Kalar indicated that it appears that most of the Ordinance changes discussed by the Planning Commission this winter will not be passed this year. He indicated that David Hauser and himself are working on some wording for the County Board to review. Break: At 7:20 the Commission took a 10 minute break. “Sugar Maple Shores” / Northern Lakes Co. - Approved with Conditions: A Preliminary Plat of "Sugar Maple Shores” consisting of 7 Single Family Residential Lots 1 BIk. Also, request the construction of dedicated road for the proposed plat of “Sugar Maple Shores”. The approximate distance of dedicated road 1,300 ft. Brian & Peggy Bladow expressed the following concerns — the notice was misleading (some thought the project was off of Co Hwy 83), increased traffic on an already busy road (residents & construction vehicles), the boat access in the area is private (not public), the lake is small, disturbance of loon nests: they questioned why the road does not come off of Highway 83 and requested a guarantee that the road will never connect to Timber Lane Hills. Jim Eastman had questions regarding the proposed amount of lake frontage on the lots. Motion: A motion by Sha, second by Maske to approve with the following conditions: 1. Before filing the final plat. Land & Resource Management must receive a document verifying that Lots 6 & 7 are adequate for 2 sewage systems other than a holding tank or a mound system. 2. The wetland must be delineated. 3. The road construction must avoid the wetland. Wetland impact is being mitigated through the State Wetland Bank. This approval is also contingent upon compliance with the Minnesota Wetland Conservation Act. Votinq: All members in favor. William H. & Bonnie L. Barber - Approved with Conditions: A Conditional Use Permit Application to: 1) Place 1,774 cubic yards of fill to accommodate construction of singie family home and storage building and driveway; and to place 500 cubic yards of topsoil. 2) Excavate 400 cubic yards of material from east wetland area to deepen the pond. The property is described as all that part of the NW% of the SE% and GL(s) 2, 3, & 4 in Section 17 of Everts Township. Preliminary Plat ‘Prime Pine ViewVM. John H. Cordes: Motion by Froemming, second by Nelson, and unanimously carried to approve the Preliminary Plat known as “Prime Pine View” consisting of 4 residential backlots with conditions as recommended by the Planning Commission. The property is described as all that part of GL 2, Section 25 of Leaf Lake Township: East Leaf Lake (56-116). Preliminary Plat “Sugar Maple Shores’/Northem Lakes Co: Land & Resource Director, Bill Kalar, stated that the Planning Commission discussed the proposed Preliminary Plat of “Sugar Maple Shores” on Round Lake in Everts Township. The Planning Commission recommended approval with several conditions. Jim Peterson of Anderson Land Surveying stated that the applicant would like to table this request so additional information could be provided on the areas of concern. Chair Mosher opened the floor for comment. Melanie Green, Chair of Everts Township presented a petition of objection from the people who live in Timber Hills and two photographs of the township road near the cul-de-sac. Ms. Green stated that the people who live on Timber Hills Road are opposed to the development because of the condition of the road and additional traffic. She thought the access to the development would be from CH 83. Ms. Green asked that the County Board vote against the Preliminary Plat today or postpone the request. Mr. Wayne Rowe requested additional information on potential Indian Mounds. Jim Peterson spoke on behalf of the applicant and agreed to waive the 60-day rule to make a decision. Motion by Mosher, second by Froemming, and unanimously carried to refer the Preliminary Plat request of “Sugar Maple Shores” back to the Planning Commission to consider additional information. The applicant has agreed to waive the 60-day rule. Peggy Bladow presented two letters for the record. One letter from John & Ann Mehl regarding the overcrowding and natural resources that they feel would be affected on the lake. The other from Brian & Peggy Bladow regarding natural habitat issues and road issues. A petition was presented in objection to the development. Mr. Hauser stated that the petitions can be received: however, it is not the number of signatures in objection that will be considered, but the content of what their objections are that will be considered. Mr. Kalar stated that this request will be scheduled on May 8, 2002, at 8:30 p.m. with the Otter Tail County Planning Commission. Conditional Use Permit - Day Id & Vicki Danielowski: Motion by Mosher, second by Nelson, and unanimously carried to approve the revised plan for this retaining wall and an after the fact Conditional Use Permit with conditions as recommended by the Planning Commission. One of those conditions reduces the three lots on the lake to two lots of equal size. Developer, Clem Hendrickson, stated that every lake lot on this proposed plat is well over the required lot size; therefore, he questioned the reason for that condition. Mr. Kalar stated that the rationale given by the Planning Commission was because this is a natural environment lake and by reducing the number of lots, access will be limited to one shared access. Wade Tate, representing his family, spoke in opposition of approval of the plat at this time. Mr. Tate's concerns were 1) aquatic plant growth on the shoreline relative to how this plat will be developed, 2) the fact that a meeting between the applicants and the DNR regarding access to the lake had not taken place, 3) if the ordinary high water level is higher than has been established on the map, there may be a problem for building and septic on the properties, 4) concerned with springs in this area of the shoreline, 5) potential flooding concerns, and 6) concern with accuracy of the survey that was completed. Mr. Tate requested that the approval process be delayed to further address these concerns. Paul Winkler, owner nf ijonertv on the east and west side of Mason Lake, spoke in opposition of the plat. Applirant, Mr Dixon, stated that he had called the DNR and spoke to them about lake access and over the water docks to avoid the cattails. Discussion followed. Motion by Froemming, second by Lee, to approve the Preliminary Plat known as “Mason Lake Estates" consisting of 7 lots for single family residential use and to approve a Conditional Use Permit to construct a road to service the plat with conditions as recommended by the Planning Commission.
