Chris Mickman - Denied
Chris Mickman, Anoka, MN, requested a variance to construct a garage for tool and boat storage for island
access. Garage location is on access easement. Distance from lake is over 100’ and over 20’ from property
line. The property is described as part of Government Lot 4, Section 2 of St. Olaf To\wnship by Long Lake.
The audience was polled with no one speaking for or against the request. After consideration, motion was
made by Mark Steuart, second by Steve Schierer and unanimously carried, to deny the variance as requested
as no adequate hardship unique to the property had been shown and there is adequate area on the
applicant’s property for the placement of the proposed structure which will not require the granting of a
variance.
Mary Lou Stickel - Approved as requested.
Mary Lou Stickel, Battle Lake, MN, requested a variance of 30’ from the required ordinary high water level
setback of 100’ for a 12’ by 20’ addition 70' from the ordinary high water level. The property is described as
Lot 1, Blanche Lake Beach, Blanche Lake in Everts Township. The audience was polled with no one speaking
for or against the request. A letter from Michael S. Benedict in support of the applicant’s request was read for
the record. After consideration, motion was made by Steve Schierer, second by Cecil Femling and
unanimously carried, to approve a variance of 30’ from the required ordinary high water level setback of 100'
for a 12’ by 20’ addition 70’ from the ordinary high water level. It was noted that the proposed addition would
be no closer to the ordinary high water level than the existing structure. Hardship is a substandard lot of
record.
Kathleen Braun - Approved with conditions.
Kathleen Braun Family, Annandale, MN, requested a variance of 100’ from the required ordinary high water
level setback of 200' for the construction of a 27’ by 46’ dwelling 100’ from the ordinary high water level. The
property is described as Lot 6, Block 1, Brightwood Shoreline, Dead Lake in Star Lake Township. The
audience was polled with no one speaking for or against the request. After consideration, motion was made
by Cecil Femling, second by Steve Schierer and unanimously carried, to approve a variance of 100’ from the
required ordinary high water level setback of 200’ for the construction of a 27’ by 46’ dwelling 100’ from the
ordinary high water level with the following conditions; 1) the existing 10’ by 45’ mobile home must be
reruoved before a site permit for the new structure can be issued and 2) the existing 8’ by 8’ shed (on west
property line) must be either removed or placed behind the location of the new structure. Hardship is a
substandard lot of record.

Brad Klimp, Battle Lake, MN, requested a variance to have ability to make .14 acre lot North of South Eagle
Lake Road a separate buildable parcel. The property is described as part of Government Lot 3 and Part of
the Southwest Quarter of the Northwest Quarter south of the township road and a .14 acre tract southeasterly
and adjacent to Lot 1, Rosenquist Beach, Section 15 of Eagle Lake Township by Eagle Lake. Terry Braun,
Realtor, represented the applicant at the public hearing. The audience was polled with Ken Knudsen
requesting the size of the lot. After consideration, motion was made by Steve Schierer, second by David
Holmgren and unanimously carried, to deny the variance as requested as no adequate hardship unique to the
property had been shown and the granting of the variance as requested would create a substandard lot.
(I spoke with Bill Kalar, Director of the Land and Resource Department, on Friday, June
22, 2001. Mr. Kalar stated that so long as the 40.27 acre tract remained as one parcel it
would be considered a pre 1971 tract for building purpose. This would mean that limited
development, with a permit, could occur on the property north of the road. Some
development would also require a variance and therefore is not guaranteed development.
For example a water oriented accessory structure (boathouse etc.) would required a
variance because the required side lot line setback cannot be met. A second dwelling
however would not be an option since there is already a dwelling on this 40.27 acre
parcel.
I mentioned to Bill that if a deed of conveyance was presented conveying either the
portion of the property north of the road or south of the road separately we would allow
the transfer because of the dedicated public road which separates the two parcels.
Bill then indicated that if this was to occur variances would be needed to declare the
parcel north of the road as a buildable lot. He noted that a substandard parcel per the
requirements of the ordinance must have been created by plat or deed prior to 1971 in
order for that parcel to be considered a buildable lot.
The parcel north of the road was created by exceptions from the original tract and was not
directly created by plat or deed. However the affect of the pre 1971 plat to the west and
the 1957 metes and bounds parcel to the east did cause the separation of the part of this
tract which lies north of the road prior to 1971. This may be sufficient reason for the
Board of Adjustment to approve a variance.
It would however also be helpful within your variance request to show what type of
development is being planned for the parcel north of the road. Note the size of the
proposed dwelling, where it would be located, where the septic system would be
installed, where the well would be located and what if any variances would be necessary
for development. Hopefully no variances for residential development would be required
as this would add to an argument that the parcel should be declared a buildable lot once
separated from that portion of the lot lying south of the road.
