Minnesota 1178094 2 of 2 Robert Loerzel - Variance application approved with a modification. (7:21 p.ni.) Robert Loerzel, Lots 4 and 5 Klein Adams Point, Marion Lake in Dead Lake Township, requested the following: Requesting to add 7’ by 7’ shed on an 8’ by 8’ wood base. 65’ from ordinary high water level and 2’ from property line. In line with eument buildings and neighbors building with their setbaek on the south side of my property. The audienee was polled with Grant Colling speaking for the varianee as requested. After discussion and consideration, Paul Larson made a motion, seconded by Rick Wilson and unanimously carried, to approve the addition of a 7’ by 7’ shed on an 8’ by 8’ wood base 65’ from the ordinai^y high water level and 3’ from the propeity line. This is perhaps the only location available for the proposed;structure. The variances as approved do not directly or indirectly grant any other variances for the proposed or future development. Deb and Vern Tomanek - Variance application approved as requested. (7:25 p.m.) Deb and Vem Tomanek., part of Government Lot 5, Section 18 of Edna Township by Big McDonald Lake, requested the following: 2 requests. Setback and impervious surface. Setback decrease - required is 100’. Request a 36.5’ variance for the placement of a: 12’ by 24’ deck at 63.5’ to the ordinary high water level. The dwelling meets the building line - 51.5’, but will be placed at 75’. Impervious surface - we are weU under the allowable building area @ 7.8%. The existing public road is approximately 90% on our property. We are requesting an increase of 859 square feet of imperious surface area or 2.8%. The applicants were represented by Noah Riley and Jim (missed last name and recording not clear). The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Paul Larson made a motion, seconded by Thomas Lee and unanimously carried, to approve the variances as requested for the proposed development as stated in the variance application dated August 15, 2016 and as depicted on the drawing submitted with the variance application. The hardship/practical difficulty is the location of the existing road. The applicants proposed development is similar to other development in this immediate area. There will be no net increase in impeiwieus surface coverage upon completion of the proposed development. The variances as approved do not directly or indirectly grant any other variances for the proposed or future development. Randy Elmer - Variance application approved as requested with a condition. (7:30 p.ni.) Randy Elmer, part of Government Lot 3, Section 15 of Eagle Lake Township by Eagle Lake, requested the following: According to County ordinance the structure setback on Eagle Lake (GD) is 75’ from ordinai'y high water. The applicant is seeking approval for a structure being 37.7’ from the ordinai'y high water. The applicant is also seeking approval to build a structure within 11.2’ from a township road right-of-way. County ordinance requires a 20.’ setback from a township road right-of-way. The applicant is also seeking approval to cover 1,120 square feet within the shore impact zone where the County ordinance specifies a maximum of 260’ square feet. Dan Ness, Contractor appeared with the applicant at the public hearing. The audience was polled with no one speaking for or against the variance as requested. A letter from the Eagle Lake Lakeshore Association requesting the denial of the variances as requested was read for the record. After discussion and consideration, Rick Wilson made a motion, second by Thomas Lee and unanimously carried, to approve the variances as requested for the development as described in the variance application dated August 17, 2016 and as depicted on the drawings subn-utted with the variance application with the condition that the applicant reduce the length of the proposed driveway/parking area by 8’ for a 160’ square feet reduction. Hardsliip/practical difficulty is a substandard lot of record. The variances as approved will provide the applicant with a reasonable use of his property. The approval is consistent with past actions of the Board of Adjustment. The proposed development is an improvement to the property and is reducing the amount of imperious surface coverage within the shore impact zone. The variances as approved do not directly or indirectly grant any other variances for the proposed or future development. September 6, 2016 Board of Adjustment Otter Tail County Government Services Center 510 Fir Ave. W Fergus Falls, Mn. 56537 Re: Request for Variance 37941 Eagle Lake Road South Dear Board of Adjustment: Thank you for what you do to protect the valuable water resources in Otter Tail County: Eagle Lake Lakeshore Association, has reviewed the variance request and respectfully request you to deny it. Our purpose, as stated in our bylaws on our website, is the care, preservation and betterment of Eagle Lake. While we do not normally object to variance requests, this one is inconsistent with our purpose. We also believe the variance request is not consistent with the purposes and intents of the Otter Tail County Shoreland ordinance for the following reasons: This is a substandard lot in that it is just in excess of 50% of the 20,000 square feet minimum on a general development lake. On this substandard lot the applicants are proposing to have approximately 24% impervious surface (just barely below the 25% requirement for a standard lot). Applicants are required to have a setback of 75' from the ordinary high water. They are proposing to have a setback of approximately 50% of that. Applicants are proposing to have a setback of approximately 55% from the required setback from a township road. Applicants are seeking to cover 1,120 square feet of the shore impact zone over 4 times the square feet allowed by the ordinance. (The shore impact zone is a very vulnerable environmental area) Disturbances to the shore impact zone are particularly concerning with our purpose of the care, preservation and betterment of Eagle Lake. 1. 2. 3. 4. 5. 6.
