member of this office in an attempt to fully comply with all provi
sions of the ordinance and in fact, thought that we had done so.
We have now been informed that our side yard setback is iiot
sufficient. The placement of the home was not at random but was
done in order to get the best use and enjoyment from the property.
As the attached photograph , which is marked applicant's exhibit A,
will show, placement of the home nine (9) feet to the east would
cut off the driveway and access to the lot. There isn't sufficient
room between the township road and the trailer house to allow for
parking or a driveway, and cutting off the driveway would bring the
necessity of parking along the township right-of-way. This, we
felt, would bring about a genuine inconvenience and also result in
a traffic hazard. The only alternative would cause an.uniq^zcdhard-
ship and depreciate the beauty and value of t lis and surrounding pro
perties. As exhbit A would indicate, the only other possible room
for a driveway would be on the extreme eastern border of the property.
This would necessitate cutting down the only trees on the property
and the filling in of a rather large, natural hole directly to the
north of the trees. It is our feeling that the destruction of these
trees would be by far more antagonistic to the policies of Shoreline
Management than would be variance from the side yard setback.
As exhibit B would indicate, the nearest home to our western
border is well over 100' away and therefore, strict compliances would
not be necessary to avoid damaging the rights of other persons or
property, and in view of the rather unique problem of our trees, we
don't feel that the present location is contrary to the public inter
est or to the Management policies of this district.
Failure to grant the variance as stated above, will affectively
cut off our access to the lot or in the alternative, greatly ainiin-
ish the aesthetic quality of the area and the result would be that
we would be unable to enjoy and use our property in the same manner
as the surrounding land owners. In addition to tiie piotleiiis dis
cussed above, moving the foundation, j)lumbing, and electrical lines
would cost an estimated $3,000.0G-$4,000.00.
We feel that all of these problems cause an undo hardship and
are unique to this property and not shared by properties in the
immediate vicinity. Granting of the variance would not alter the
essential character of the neighborhood and would, in fact, enhance
the surrounding properties by allowing the trees to remain. Since
there is no danger of a cluster or conglomerate of structures result
ing from the present location, granting of the variance would in no
way be in conflict with the objectives of the ordinance or the com
prehensive plan.
