ff David and Carol Place - Approved
David and Carol Place, Battle Lake, MN, requested a variance to build a 10’ by 40’ addition to the south
side of the existing cabin (far side from the lake). The existing cabin, which is approximately 28’ from
the lake and 22’ wide, was built within the current shore impact zone. The addition will be
approximately 50’ from the lakeshore. The southwest corner of the new addition would be 2’ from the
edge of the easement road. It should be noted that the easement road could be moved 4 to 5’ to the
south. The property is described as part of Government Lot 4, Section 11 and part of Government Lot
1, Section 14 of Eagle Lake Township by Eagle Lake. The audience was polled with no one speaking
for or against the request. After consideration, motion was made by Steve Schierer, second by David
Holmgren and unanimously carried, to approve a variance to build a 10’ by 40’ addition to the south
side of the existing cabin (far side from the lake) as depicted on the applicant’s drawing. Hardship is a
substandard lot of record.
Jeffrey and Judy Lopez - Approved
Jeffrey and Judy Lopez, Moorhead, MN, requested a variance of 20’ from the required ordinary high
water level setback of 100’ for the replacement of a roof on an existing structure 80’ from the ordinary
high water level. The property is described as Lots 1 A, 4 and 5, Jerry - Marg Beach First Addition,
Scalp Lake in Hobart Township. The audience was polled with no one speaking for or against the
request. After consideration, motion was made by David Holmgren, second by Steve Schierer and
unanimously carried, to approve a variance of 20’ from the required ordinary high water level setback of
100’ for the replacement of a roof on an existing structure 80’ from the ordinary high water level. The
granting of the variance as requested will allow the applicant the ability to maintain his property and to
enjoy the same rights and privileges as others in the immediate area. It was noted that the applicants
have submitted a realistic request. Hardship is the terrain of the applicants’ property.
Bruce H. Bopp - Approved
Bruce H. Bopp, Fergus Falls, MN, requested a variance of 37’ from the required ordinary high water
level setback of 100’ and a variance of 4’ from the required septic tank setback of 10’ for the location of
a 12’ by 17’ deck 63’ from the ordinary high water level and 6’ from the septic tank. The property is
described as the west half of Lot 47 and all of Lots 48 and 49, Deer Lake Beach, Deer Lake in Everts
Township. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by David Holmgren, second by Steve Schierer and unanimously
carried, to approve a variance of 37’ from the required ordinary high water level setback of 100’ and a
variance of 4’ from the required septic tank setback of 10’ for the location of a 12’ by 17’ deck 63’ from
the ordinary high water level and 6’ from the septic tank. Hardship is a substandard lot of record.
Tom and Virginia Kueppers - Denied
Tom and Virginia Kueppers, St. Paul, MN, requested a variance of 1.5’ from the required side lot line
setback of 10’ for the placement of a dwelling, with an attached garage, 8.5’ from each side lot line.
The property is described as part of Government Lot 6, Section 21 of Hobart Township by Rose Lake.
The audience was polled with Gerald McKenzie requesting that the 10’ side lot line separation be
maintained. After consideration, motion was made by Cecil Femling, second by Richard Sha and
unanimously carried, to deny the variance as requested noting that this is new construction that should
be designed to fit the lot and noting that other alternatives that do not require the granting of a variance
should be considered by the applicants.

Diane Ross - Withdrawn
Prior to the July 6, 2000;rr!eeting of the Board of Adjustment the applicant contacted the County
Auditor’s office to indicate her desire to withdraw her request. By general consent the Board
acknowledged and accepted her request to withdraw her variance application.
David and Carol Place - Denied
David and Carol Place, Monterey, CA, requested a variance to extend the west end of an existing cabin
6.5’ toward the property line for additional bedroom space, and for an entrance area to the cabin,
leaving 10’ to the west property line. The proposed addition will be approximately 26’ from the'water’s
edge and approximately 7.5’ off an easement road. The easement road serves only our cabin as
property owner to the east (house high on hill): has new access road on top of the hill. The easement
road ends on our property. The property is described as part.of Government Lot 4, Section 11 and part
of Government Lot 1, Section 14, Eagle Lake Toyynship by Eagle Lake. October ?, 1999 meeting -
Stanley Balgaard represented the applicants at the public hearing. The audience was polled with no
one speaking for or against the request. After discussion and consideration, motion was made by
David Holmgren, second by Cecil Femling and ,unanimously carried, to table the applicants’ request
until a future meeting date with the condition that written approval from the applicants authorizing this
action must be received no later than October 29, 1999, otherwise the request will be considered
denied. The tabling of this request will provide the applicants with an opportunity to review and
consider the possibility of eliminating the existing road easement, which might then provide an
opportunity for development on the back side (non-lake side) of the applicants’ dwelling. July 7, 2000
meeting - After discussion and consideration, motion was made by Cecil Femling, second by Mark
Steuart and unanimously carried, to deny the -variance as requested noting that the proposed addition
is within the shore impact zone and noting that other plans should be considered by the applicants.
Other Items -
Cecil Femling reviewed with the other members of the Board of Adjustment a recent conversation he
has had with Commissioner Malcolm. Lee concerning the Board of Adjustment.
Pat Eckert, Land and Resource Management.discussed with the Board various examples of situations
that presently require either Planning Commission or Board of Adjustment review. It was noted that
these issues'are being reviewed to determine if they should continue tO'be-reviewed by these Boards or
if changes to the requirements of the ordinances need to be made. Pat Eckert noted that the Board’s
suggestions and thoughts on these issues are needed.
Wayne Stein, Secretary discussed a recently received request from Peter Irvine, Attorney.
With no further business Randall Mann, Chairman, declared the meeting adjourned at 10:00 p.m.

Ronald O. Wilner- Approved with condition.
Ronald-O. Wilner, Battle Lake, MN, requested a variance to raise our house up 6’ 8” and fill the
basement in with sand up to ground level. We will pour a cement floor at that level. We are behind the
string line, but inside the shore impact zone. A 6’ 8" raise would place the structure 47” above the
water level as of August 21, 1999. The property is described as Lot 13, Silver View Park, Silver Lake in
Everts Township. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by Randall Mann, second by Cecil Femling and unanimously carried,
to approve a variance, which would allow the applicant to raise his house 6’ 8” as proposed with the
condition that the existing lakeside porch must be removed and placed in a location, which will be no
closer to the ordinary high water level than the raised dwelling. It was noted that the dwelling would be
approximately 40’ from the ordinary high water level. The granting of this variance provides the
applicant with a reasonable use of his property. Hardship is a grossly substandard lot of record.
David and Barbara Nelson - Denied
David and Barbara Nelson, Henning, MN, requested a variance of 10" from the required 36” vertical
separation from ordinary high water level for a 14’ by 20’ addition 26” above the ordinary high water
level. The proposed addition will be to the side of the existing dwelling away from the lake. The
property is described as Lot 8, Coney Island Acres, West Battle Lake in Girard Township. The audience
was polled with no one speaking for or against the request. After consideration, motion was made by
Cecil Femling, second by Randall Mann and unanimously carried, to deny the variance as requested
noting concern with a health issue and noting that the granting of this variance would allow a
substandard situation to become more substandard.
