After discussion and consideration, Randall Mann made a motion, second by Rod Boyer and carried with Cecil
Femling and Steve Schierer voting no, to approve the placement of the existing dwelling and an 18’ by 18’ addition no
closer to the ordinary high water level than the existing structure and at least 10’ from the side lot lines with the
condition that no deck can be placed between the existing house and/or the proposed addition and the lake and any
deck placed on the side of the proposed addition must not exceed 3’ in height and with the condition that a letter from
the township accepting the setback from the road right-of-way must be obtained before a permit for the proposed

has made application to the Otter Tail County Board of Adjustment for a variance as per requirements of the Otter Tail
County Shoreland Management Ordinance, the Otter Tail County Set Back Ordinance and/or the Subdivision Controls
Ordinance. The Otter Tail County Board of Adjustment will assemble for this hearing on
Thursday, August 11, 2005 at 6:30 p.m..
in the Commissioners’ Room of the Otter Tail County Government Services Center, Fergus Falls, MN. (Please use the
public entrance located on the northeasterly side of the Government Services Center. The second left off Fir Ave.)
Individuals requiring special accommodations should contact the County Auditor’s office prior to the date of
the public hearing.

closer to the ordinary high water level than the existing structure and a variance for the relocation of an
existing deck in front of the new addition.

The Otter Tail County Board of Adjustment met Thursday, August 11, 2005, with the following persons in
attendance:

Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at
6:30 p.m.
Minutes Approved •
The Board of Adjustment approved the minutes of the August 4, 2005 meeting as mailed.
The Board of Adjustment considered the following applications for variance:
Keith and Trudy Swanson - Approved the variance as modified with conditions. (6:32 p.m.)
Keith and Trudy Swanson, part of Government Lot 2, Section 14 of Edna Township by Paul Lake,
requested a variance to allow new structure to encroach into the 20' easement setback from and existing
private road. The audience was polled with Harold and Jan Overland seeking clarification as to how far the
requested encroachment would be into the easement. After discussion and consideration, Michael Conlon
made a motion, second by Steve Schierer and unanimously carried, to approve the proposed development
with the following conditions; 1.) no part of the proposed development can go into the 40’ easement area,
2.) the existing boathouse must be removed before a site permit for the proposed development can be
issues, 3) the existing shed down by the lake must be removed before a site permit for the project can be
issued, and 4.) the shed listed on the applicants' drawing as “Existing Shed to be Removed" must be
removed on or before June 1,2006. The Board noted that the variance as approved will not negatively
impact any other property.
Kyle and Mark Januszewski - Approved the variance as requested with a condition. (6:52 p.m.)
Kyle and Mark Januszewski, part of Government Lot 2, Section 22 of Pine Lake Township by Pine Lake,
requested a variance to have an 11.1 acre parcel in Government Lot 2 declared buildable for a residential
purpose. The audience was polled with no one speaking for or against the variance as requested. After
discussion and consideration, Steve Schierer made a motion, second by Michael Conlon and unanimously
carried, to declared this 11.1 acre parcel in Government Lot 2 a buildable lot for residential/nonresidential
purposes with the condition that no structures can be placed within 200’ of the ordinary high water level.

Curtiselle Offerdahi, part of Government Lot 2, Section 14 of Eagle Lake Township by Eagle Lake,
requested a variance of 52’ from the required ordinary high water level setback of 75’ and a variance of
14.5’ from the required shore impact zone setback of 37.5’ for the placement of the existing dwelling 10’
from the side lot line and 23’ from the ordinary high water level and a variance for an 18’ by 18’ addition
which will be no closer to the ordinary high water level than the existing structure and a variance for the
relocation of an existing deck in front of the new addition. Richard Aasen appeared along with the
applicant at the public hearing. The audience was polled with Paul Hanson seeking clarification regarding
the requested variance.

After discussion and consideration, Randall Mann made a motion, second by Rod Boyer and carried with
Cecil Fefriling and Steve Schierer Voting no, to approve the placement of the existing dwelling and an 18’
by 18’ addition no closer to the ordinary high water level than the existing structure and at least 10’ from the
side lot lines with the condition that no deck can be placed between the existing house and/or the proposed
addition and the lake and any deck placed on the side of the proposed, addition must not exceed 3’, in
height and with the condition that a letter from the township accepting the setback from the road right-of-
way must be obtained before a permit for the proposed project can be issued. Hardship is a very
substandard lot of record.
Douglas B and Ann M Etten- Denied. (7:08 p.m.)
Douglas E and Ann M Etten, part of Lot 13 and all of Lot 14, Sandy Haven Development; Stalker Lake in
Tordenskjold Township, requested either a variance of 3’ from the required setback of 20’ for the
placement of a drain field 17’ from the dwelling or a variance of 3’ from the required lot line setback of 10’
for the placement of a drain field 7’ from the lot line. The audience was polled with no one speaking for or
against the variance as requested. After discussion and consideration, Steve Schierer made a motion,
second by Cecil Femling and unanimously carried, to deny the variance as requested as no adequate
hardship unique to the property had been shown that would allow for the granting of the variance as
requested and a reasonable use of the applicants’ property can be obtained without the granting of the
variance as requested.
Pauline and Mark Andersen - Approved the variance as requested with a condition. (7:23 p.m.)
Pauline and Mark Andersen, part of Sub Lot A of Government Lot 9, Section 3 of Hobart Township by
Wimer Lake, requested a variance of 3' from the required shore impact zone ,setback of 50’ and a variance
of 53’ from the required ordinary high water level ,setback of 100’ for purpose of raising an existing
foundation located 47’ from the ordinary high water level by 18”. The.audience was polled with no one
speaking for dr against the variance as.requested. After discussion and consideration,,Cecil Femling made
a motion, second by Michael Conlon and unanimously carried , to approve a variance of 3' from the
required shore impact zone setback of 50’ and a variance of 53' from the required ordinary high water level
setback of 100’ for the purpose of raising an existing foundation located 47’ from the.ordinary high water
level by 18” with the condition that no more than 25% of the total lot area can be covered with impervious
surfaces.
Virgil and Kim Kollar and Mike and Marcia Dillion - Approved the variance as requested with a
condition. (7:29 p.m.)
Virgil and Kim Kollar and Mike and Marcia Dillion, Lot C Wagner Survey Lots of Government Lot 9 and of
the Southeast Quarter of the. Northeast Quarter, Section 14 of Elizabeth Township by Jewett Lake,
requested a variance of 48’ from the required ordinary high water level setback of 75’, a variance of 10.5’
from the required shore impact zone setback of 37.5’ and a variance of 6’ from the required side Jot line
setback of 10’ for the construction of a pitched, shingled roof over an existing dwelling located 4’ from the
lot line and 27’ from the ordinary high water level. The applicants’ also plans to put new siding and windows
on the existing dwelling. Mike and Marcia'Dillion appeared at the public hearing. Virgil and Kim Kollar
submitted a letter stating their agreement with the variance as requested. The audience was polled with no
one speaking for or against the variance as requested. After discussion and consideration, Steve Schieref
made a motion to approve a variance of 48’ from the required ordinary high water level setback of 75’, a
variance of 10.5' from the required shore impact zone setback of 37.5’ and a variance of 6’ from the
required side lot line setback of 10’ for the construction of a pitched,' shingled roof over an existing dwelling
located 4’ from the lot line and 27’ from the ordinary high water level with the condition that runoff from the
lakeside of the roof must be directed to the rear of-the structure. The Board noted that the proposed'
project is general maintenance to the existing structure. , ir
