A motion by Marker, second by Estes to deny as presented. The reasons
discussed were as follows: 1. This is a residential area located on the
scenic Pelican River. 2. The number of employees (6-7). 3. Eleven parking
spaces. 4. Open 7 days a week.

Donald C. & Elmvra Boom - Approved With Conditions;

Donald Boom and Clem Hendrickson (Anderson Land Surveying) represented the
Application. Herb Eichstad expressed concerns of the possibility of dirt
getting into the lake and requested that if it is approved, there be some
policing of the project.
A motion by Trites, second by Estes to approve providing: 1. Soil guard is
used on the first 150' of the proposed road and is in place within 3 days of
the start of the project. 2. Soil guard is used on all slopes that are
steeper than 2/1.
Voting; All members in favor, except Lachowitzer and Zimmerman voted no.
The Commission took a break from 9:00 to 9:15.

Dear Planning Commission:
The Township of Eagle Lake gives Mr Boom permission as to put in his driveway
It must come in square to our road with a flat stopping area, a 15 inch
culvert and a dike in his ditch with an 8 inch tile running to the township
culvert at the bottom of the hill.
The township will not accept this road. It must remain a driveway.

Due to the fact that this matter has again been continued until
September, we are aware that many of us will have left our seasonal
homes on Eagle Lake and will therefore be unable to attend the next
hearing regarding the conditional use permit for which Donald & Elmyra
Boom have applied. Therefore, we submit the enclosed photos of the
three back lots owned by the Boom's and for which they have applied for
the permit in question. We ask that the commission members note the
vast open area, existing building with driveway, and wooded area to
the South end of the properties.
We also herein present our concerns to you as regards this
development and pray that you will give them your fullest consider
ation.
We, the undersigned, are owners of lakeshore property on Eagle
Lake and are concerned with one or more of the following issues:
1 I Placement of the proposed dr iveway. . . Mr . S< Mrs. Boom have
open land adjacent to the proposed driveway site where they could
construct a driveway without disturbing any mature trees. They also
have an existing driveway which, contrary to Mr. Boom's claims, is
kept plowed and has been in use during previous winters. An extension
of the existing drive would seem less likely to cause soil to wash
into Eagle Lake during driveway construction.
21 Pollution to Eagle Lake. . .Mr. 2< Mrs. Boom have performed
excavation to their back lots in the past which resulted in a soil wash
into Eagle Lake for which they did receive fines. Unfortunatly, ntuch
of the previous soil wash is still lying at the bottom of the lake.
The fines did not correct the damage to our lake.
31 Proposed use of the three back lots to be served by this
driveway...Many of us are very concerned with the proposed use of the
three back lots. As the Boom's have shown previous lack of concern as
to the overall well- being of Eagle Lake, we fear that their
development of these back lots may not demonstrate a use that would be
in keeping with the current interests of preserving the lake for it's
best use in the future. We therefore ask that you inquire as to the
Boom's proposed use so that their plans may become a matter of public
record, reassuring all of us of the best public interest within the
law.

Donald & Elmyra Boom represented the Application;
concerns of the possibility of dirt running into the lake as happened
before, that he hated to see the trees to be cut down and also that he does
not like to see a double ringing of the lake (it is a small lake).
Herb Eichstad expressed
A motion by Trites, second by Lachowitzer to table, with the Applicants'
approval, to the August 7, 1996 meeting to give them additional time to
provide the material requested at the June 19, 1996 meeting: 1. A
topographical drawing specifying the alterations that are requested. 2. A
letter of approval from the Eagle Lake Townboard regarding access to the
Township Road. 3. A cross section of the first 100' of the proposed
driveway..

No Formal Action;
Bill Kalar showed the Commission a video of the retaining wall constructed
on the Ed Bazinet property. Pelican Lake (56-786). The Planning Commission
had recommended approval of this retaining wall in September 1995. The
retaining wall (and bank) is currently sliding down towards the lake.
Carl Johnson discussed with the Commission the portion of the Shoreland
Management Ordinance/Subdivision Controls Ordinance that allows
nonresidential backlots and how cumbersome it can be to developers.
