(9:36 p.m.) Roger and Elise Erickson, Lot 10, Northland Beach, Big Pelican Lake in Dunn Township, requested a variance of 21’ from the required ordinary high water level setback of 75’ for the placement of a dwelling 54’ from the ordinary high water level. I obtained permits on July 1, 2002 to add a second story addition and a garage to my lake home. When I started work on the additions I discovered that the existing floors and foundation were totally rotted out and would not be able to be saved. At that time I called shoreland management and explained that I had permits for the additions and that I needed to put in new footing and floors. I installed them in the exact same place as the old footings, which were done by my father in 1957. I could not move the structure back because of the need to meet sewer requirements on the roadside of the structure. I am currently setback approximately 8’ behind my one neighbor from the lake and approximately 6’ in front of my other neighbor on the lakeside. This does not include their deck, which sets approximately 4’ in front of my lake home. I am respectfully requesting an after the fact variance for the setback. All other setbacks are met. After consideration and discussion, Steve Schierer made a motion, seconded by Paul Larson and unanimously carried, to approve a variance of 100’ from the required ordinary high water level setback of 200’ for the placement of the proposed cabin and deck and for the location of a future garage 100’ from the ordinary high water level. After consideration and discussion, Steve Schierer, with the verbal and written agreement of the applicants made a motion, seconded by Thomas Lee and unanimously carried, to table the applicants’ request until the next scheduled meeting of the Board of Adjustment, which will provide the applicants with an opportunity to meet with a representative of the Land and Resource Department and an opportunity to determine if the proposed development can meet the 3’ vertical separation requirement. Rose Ridge Resort - Approve the variance appiication as modified and with a condition. (7:12 p.m.) Rose Ridge Resort, part of Government Lot 1 and 2, Section 17 of Hobart Township by Rose Lake, requested the following; Proposed dwelling unit would be within 50’ of lot line setback which is an adjacent cluster development driveway. With approval of proposed dwelling, 5 existing structures will be removed within 2 years after completion to enhance lot appearance. Request to be 25’ to lot line. The applicant will file for a conditional use permit upon approval of the variance application. The audience was polled with Barb Olson seeking clarification as to the location of the proposed structure. After consideration and discussion. Rod Boyer made a motion, seconded by Paul Larson and unanimously carried, to approve a variance of 20’ from the required side lot line setback of 50’ for the placement of the proposed dwelling 30’ from the side lot line with the condition that no more than 25% of the total eligible lot area le covered with impervious surfaces. The variance as approved will not negatively impact this immediate area.ca Greg and Jenny Maue - General Discussion (7:20 p.m.) Greg and Jenny Maue submitted a letter dated June 19, 2012 describing the planned improvements to their property and noting the differences from the variance as previously approved in 2003. After general discussion and consideration, the Board noted that the proposed improvements as described are within the spirit and intent of the variance as originally approved. The proposed improvements appear to be less substantial than those previously approved by the Board of Adjustment in 2003. The Board took no formal action as it would not be appropriate to act outside of the receipt of a formal application and the Board has no authority to change the variance that was granted in 2003. AUDITOR fergius falls, MNMr. Wayne Stein, After consultation with inspector Mark Ronning, and as discussed with you via telephone, I respectfully request that you verbally relay (on our behalf) the beiow information at the July 5*^ Ottertail County Board of Adjustment (Variance) Meeting for consideration. Regarding: Variance #925654 - Approved on April 16*^ 2003. Due to lifestyle changes since the approval of the original variance in 2003; we are asking that the below outlined changes be considered and deemed covered by (or in the same basic 'spirit' of) the original approval of the variance. Summary: The 2003 approved variance request depicted a two story cabin expansion, and cabin extension towards the road to join with an attached garage. At this time we do not desire to pursue an extensive two-story modification to our cabin; but just a slight modification to the existing roof. We also do not desire to expand the cabin towards the road; so the garage we wish to pursue will therefore need to be detached instead of attached. Details: (Cabin) We wish to change the existing cabin roof from a 2-12 pitch, to a 4-12 pitch to allow for insulation. (Garage) Since the cabin is not being enlarged to two stories or expanded towards the road; the garage we wish to pursue can no longer be attached. It will instead need to be detached, smaller in size, and further from the lake. Considerations: The work being done on the cabin roof could be considered 'normal maintenance', with a slight increase to pitch. We have repaired and stabilized the original retaining wall to the road side of the cabin (that was previously deteriorating and would have been partly re^aced by the cabin expansion). ^The allowable height profile of the detachecTgafage will be less than that allowed for an attached garage. T / > The detached garage will be smaller than the original approved design, and will be 8 feet further from the lake; but still no closer to the road. The grade and fill requirements for the detached garage will be approximately equivalent to the original approved attached garage; but be on a more sound area. (No longer directly related to, and further from, the existing retaining wall to the road side of the cabin.) Our requested changes are far less extensive, less impactful, less intrusive than the original approved design; and better preserve the 'iook and feei' of the original cabin homestead. In closing, we hope that the County Board of Adjustment will consider the above information and conclude that our current requested changes are far less substantial than those approved in our original variance; but that they are still in overall general alignment with the changes previously approved, and as such, you will allow us to proceed.
