This letter will confirm our telephone conversation in which I requested an extension of the Conditional
Use Permit, Eagle Lake (56-253). As I understand it, grade and fill projects are generally supposed to be
completed before 15 October, but since the Permit was not approved by the County Board until 18
October that was not possible. As such, we are requesting an extension.
Dan Ness, the contractor handling the project, told me today that he believes the project can be
completed and ready for final inspection by or before 15 December, assuming he is able to start the first
of next week. That, then, would be the period we would request for extension. If this is acceptable,
please send the permit directly to Dan and he will commence with the project immediately. In the event
weather causes an unforeseen change In this schedule, Dan will contact you directly.

Motion by Johnson, second by Froemming, and unanimously carried to change the Bond Sales date from
November 22, 2011, to November 29, 2011, because the Board of Commissioners do not meet on

Public Hearing Date for Lake Name Change
Motion by Johnson, second by Huebsch, and unanimously carried to establish a Public Hearing at
9:45 a.m. on Tuesday, November 29, 2011 to consider the petition to change the name of Big
McDonald #2 to McDonald Lake.
Recess & Reconvene
At 10:14 a.m., Vice-Chair Rogness declared the meeting of the Otter Tail County Board of Commissioners
recessed for a short break. The meeting was reconvened at 10:20 a.m.
Proposed Watershed District
David Hauser, County Attorney, discussed the paperwork process to merge two petitions; the original
petition from Wilkin County to form a watershed district and the other from the Bufflalo-Red River
Watershed District. Lengthy discussion took place regarding the funding of projects and Otter Tail County
Board representation with the proposal to join the BRRWD. Commissioner Johnson indicated that the
property owners around Lake Annie may not want to join the BRRWD as previously discussed. Vice-Chair
Rogness requested that Bruce Albright, Administrator of the Buffalo-Red River Watershed District, meet
with the Board for further discussion and clarification of options.
Water Issues Staffing Discussion
Larry Krohn, County Administrator, opened discussion regarding the County’s staffing as it relates to ditch
projects, ditch viewers, flooded roads, and other water issues. Commissioners offered several ideas
including moving responsibility for ditch projects to the Public Works Division and hiring a professional with
hydrology experience to work on projects for the County and also to be available to sublet to townships
and other governmental entities. The Administrator and other interested Department Heads will meet to
put together a proposal and recommendation. Commissioners also requested that the Administrator
develop a chronological timeline as reorganization occurs in order to assess progress to reach the
reorganization goal of 2015. Commissioners discussed the current committee structure. They requested
that the Personnel Board provide a recommendation to the County Board regarding a committee structure
that follows the reorganization plan.
Planning Commission Recommendations
Conditional Use Permit - Clarence B & Judy M Johnson:
Motion by Huebsch, second by Froemming, and unanimously carried to approve a Conditional Use Permit
to relocate a private driveway with conditions as recommended by the Planning Commission. The
proposal is located in Pt of GL 3, 3.68 AC, Section 10 of Eagle Lake Township; Eagle Lake (56-253), GD.
Conditional Use Permit - Otter Tail County Highway Department:
Motion by Froemming, second by Johnson, and unanimously carried to approve a Conditional Use Permit
for a bridge replacement project across the Otter Tail River as presented. The proposal is located at
CSAH 72 & Otter Tail River in GL’s 4 & 5, Section 4 of Everts Township; Otter Tail River (56-OTR), AG &
Otter Tail Lake (56-242), GD.

A Preliminary Plat of “Mischel Subdivision” consisting of One Single Family Residential
Backlot, Four Nonresidential Backlots and One Unbuildable Riparian Lot (attached to the
Residential Lot). The proposal is located in Pt of GL’s 5, 6, 7 & 8, (92.12 AC), Section 17

a maximum depth of 18” = 174 c. yds. Placing class five on surface, approx. 6" deep = 174
c. yds. Remaining spoils to be hauled off site. The proposal is located in Pt of GL 3, 3.68
AC, Section 10 of Eagle Lake Township; Eagle Lake (56-253), GD.

Meeting of the Otter Tail County Planning Commission was held on October 12, 2011 at
6:30 P.M. in the Commissioner's Room, Government Services Center, Fergus. Falls,
Minnesota.
Roll Call:
Members Present: Rod Boyer, Ken Erickson, Marion Gill, Bert Kinzier, Joe Maske, Bert
Olson, Robert Schwartz, David Trites, and Leona Zimmerman.
Members Absent: Rick Wilson.
Bill Kalar represented the Land & Resource Management Office (the County Attorney’s
Office was not represented at this Meeting).
Minutes of September 21, 2011: A motion by Erickson, second by Maske to approve the
September 21, 2011 Minutes as presented with a correction on the proposal for Homestead
on Ottertail, the lake classification for Otter Tail Lake, states RD, it should be GD. Voting:
All members in favor.
Clarence B & Judy M Johnson - Approved With Conditions:
A Conditional Use Permit Application (as stated by the Applicant on the Application): Request to
construct roadway (driveway) easement from Eagle Lake Rd North to existing easement
paralleling Eagle Lake. Eliminate section of current easement. Per Contractor - Construct
driveway 783’± in length with average depth of 6” and having a 12’ top. Fill 2 low areas at a
maximum depth of 18” = 174 c. yds. Placing class five on surface, approx. 6” deep = 174 c.
yds. Remaining spoils to be hauled off site. The proposal is located in Pt of GL 3, 3.68 AC,
Section 10 of Eagle Lake Township; Eagle Lake (56-253), GD.
Motion - August 10, 2011: Motion by Maske, second by Trites to table to October 12, 2011
as requested in the Applicant’s August 5, 2011 letter.
Clarence Johnson and Kris Svingen (Attorney) represented the Application.
Janet Bengtson and Chris Bengtson had questions regarding maintenance of the road and
the proposed location of the road.
Motion: A motion by Erickson, second by Gill to approve as presented, provided: 1. The
Township provides Land & Resource written approval of the proposed approach. 2.
Appropriate erosion control measures are implemented. Voting: All members in favor,
Olson abstained.
Otter Tail County Highway Department - Approve As Presented:
A Conditional Use Permit Application (as stated by the Applicant on the Application): To replace
deficient Bridge No. 56502, located on CSAH 72 in Everts Township over the Otter Tail
River in Government Lots 4 & 5, Section 4. Bridge to be replaced with a 48’ - 2” x 127’8"
concrete bridge. Approximately 1,222 feet of highway reconstruction is associated with the
project. The project is covered under MN DNR General Permit 97-1094. CEO and MPCA
permits are in progress. Right of Way and construction easements will be obtained prior to
construction. Plans are on file in the Otter Tail County Engineer’s Office. Work is to be
completed in 2012. The proposal is located at CSAH 72 & Otter Tail River in GL’s 4 & 5,
Section 4 of Everts Township: Otter Tail River (56-OTR), AG & Otter Tail Lake (56-242), GD .
The scale drawing must be a signed drawing which includes and identifies a graphic scale (feet), all existing and/or proposed structures,

Dear Mr. & Mrs. Johnson,
As we discussed yesterday during our telephone conversation, I am returning your
applications for further information. Enclosed is the Grade & Fill Application, Conditional
Use Application, your surveyor’s drawings, legal description and your check for $550.00.
I did have Tim Griep, our Grade & Fill Inspector review your proposal and he suggested
that your project would likely require a Conditional Use Permit Application. This being the
case list^
j/f) The required fee for a Conditional Use Permit Application is $400.00.
2) The parcel where the road is being constructed does not have a 911 address. It
' ^^-v^hould be noted that the one listed on your application is an adjacent property.
/3)^y suggestion is that you contact your contractor who is constructing the
'^’proposed easement road and get the necessary information regarding
below is the items we discussed.

earthmoving/fill areas, length & width of proposed road, slopes of ditch, and total
cubic yds for your project.
4) You stated that there would be no work done at this time on portion of easement
road that is being eliminated.
Once this information is complete, you may return the application to our office.
The next Planning Commission Meeting is June 8, 2011 with the filing date being May 18^^
before 12 noon (I have enclosed a schedule and also another Conditional Use Application
if needed).
