(7:30 p.m.) Jeff and Connie Mackner, part of Government Lot 4, Section 21 and part of Government Lot 5, Section 20 of Edna Township by McDonald Lake, requested a variance of 50’ from the required ordinary high water level setback of 100’ for the construction of a 27’ by 58’ three stall garage/storage building 50’ from the ordinary high water level. The audience was polled with Richard Dubord, Van Kalinoski and David Brandt speaking against the variance as requested. A letter from Rosemary Borgerding opposing the variance as requested was read for the record. After discussion and consideration, Randall Mann made a motion, second by Paul Larson and unanimously carried, to deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested and the applicants have a reasonable use of their property without the granting of the requested variance. Scott and Christie Lindemann - Denied. (7:50 p.m.) Scott and Christie Lindemann, Sub Lot 2 of Government Lot 4, Section 23 of Rush Lake Township by Rush Lake, requested the following: Current Cluster Development will be subdivided into two lots. Lot 1 of new subdivision will remain a cluster development for the existing resort and will need variances approved for side setbacks for three existing cabins and one garage. Cabin one will be six feet from the existing property line. The garage will be ten feet from the new lot line. Cabin three will be 23’ from the new lot line and Cabin four will be 20’ from the new lot line. The required side lot line setback for cluster developments is 50’. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Paul Larson made a motion, second by Cecil Femling and carried with Rod Boyer abstaining, to deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested and granting the requested variance would make an existing substandard situation more substandard. Greg Krueger - Approved the variance as requested with a condition. (8:03 p.m.) Greg Krueger, Lots 8 and 9 Block 1 Pike Beach, Tamarac Lake in Scambler Township, requested a variance of 50’ from the required ordinary high water level setback of 100’ for the construction of an attached 28’ by 30’ garage 50’ from the ordinary high water level. The applicant changed the requested garage size to 26’ by 30’. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, second by Michael Conlon and unanimously carried, to approve the construction of an attached 26’ by 30’ garage being no closer to the ordinary high water level than the existing dwelling which is assumed to be 50’ from the ordinary high water level with the condition that the garage addition must be at least 10’ from the septic tank. It was noted that the proposed garage will continued on the same building line as the existing dwelling as noted orUhe drawing submitted with the variance application. Hardship is a substandard lot of record. Margaret A Blumer - Approved as modified. (8:12 p.m.) Margaret A Blumer, part of Government Lot 3, Section 10 of Eagle Lake Township by Eagle Lake, requested a variance of 35’ from the required ordinary high water level setback of 75’ for the purpose of constructing a replacement dwelling with an attached garage 40’ from the ordinary high water level. The audience was polled with Larry Peck and John Bemis speaking for the variance as requested. After discussion and consideration, Steve Schierer made a motion, second by Cecil Femling and unanimously carried, to approve a variance of 25’ from the required ordinary high water level setback of 75’ for the purpose of constructing a single story dwelling with an attached garage 50’ from the ordinary high water level. The Board noted that the variance as approved should provide the applicant with a reasonable use of the property and does not directly or indirectly grant any other variances. Hardship is a substandard lot of record.
