Motion
Wallace and Ina Powers - Denied
Motion was made by John Everts, seconded by Bert Olson to approve a variance of 70’ from the required ordinary
high water level setback of 200’ for a structure setback of 130’ with the condition that the existing deck and gazebo
must be placed at least 130’ from the ordinary high water level. It was noted that the proposed site is a very good
location. It was also noted that the deck could remain ahead of the 130’ setback only if it was less than 3’ in height.
The motion failed with Randall Mann, George Walter, Bert Olson and Cecil Femling voting no. After additional
consideration, motion was made by Randall Mann to approve a variance of 50’ from the required ordinary high water
level setback of 200’ for a structure setback of 150’. This motion dies for the lack of a second. After additional
consideration and discussion, motion was made by George Walter, seconded by Cecil Femling and carried, with John
Everts voting no, to deny the variance as requested noting that the applicants have a large parcel of land that should
provide a building site that meets the requirements of the ordinance and noting that the gazebo must 10’ or less in
height to remain ahead of the 200’ setback should the applicants proceed to construct a new dwelling.
