After consideration and discussion, Paul Larson made a motion, second by Rick Wilson and unanimously carried, to
approve the proposed four lot non-residential subdivision as depicted on the drawing submitted with the variance
application with the condition that a registered surveyor’s drawing must be provided at the time of recording and with
the condition that there can be no outside building storage on these lots. The approval is consistent with a past action
of the^Bomd of Adjustment and it will provide residential storage space that is not placed on lake front lots. The
variance as approved does not directly or indirectly grant any other variances for the proposed development.

The audience was polled with no one speaking for or against the variance as requested. After consideration
and discussion, Steve Schierer made a motion, second by Rick Wilson and unanimously carried, to approve
the variance as requested for the 16’ by 24’ addition to the existing dwelling as depicted on the drawings
submitted with the variance application, to deny the variance as requested for the bread oven because there
are already multiple structures in the shore impact zone and to approve a variance from the required
ordinary high water level setback for the placement of the proposed 32’ by 60’ garage 10’ from the north
property line, which will place the garage 50 plus feet from the ordinary high water level. The variance as
approved does provide the applicants with a reasonable use of their property. The hardship/practical
difficulty is the unique shape of the applicants’ property. The variances as approved do not directly or
indirectly grant any other variances for the proposed development.
Tami Boyer and Robert Langlie - Variance application approved as requested. (7:21 p.m.)
Tami Boyer and Robert Langlie, Lots 14 and 15 Block 1, Freedom Flyer Estates, Long Lake in Hobart
Township, requested the following: Request permission to place fill in wetland to give access to lake shore
on property line between Lots 14 and 15. Request fill to be 20’ wide. Request to purchase wetland credits
outside of minor watershed. Terry Langlie and Doug Ackling appeared with the applicants at the public
hearing. The audience was polled with no one speaking for or against the variance as requested. After
consideration and discussion, Paul Larson made a motion, second by Ward Uggerud and unanimously
carried, to approve the variance as requested in the application dated February 14, 2015. It was noted that
the variance approval is consistent with past actions of the Board of Adjustment. The variance as approved
does not directly or indirectly grant any other variances for the proposed development.

William and Mary Walker -Variance application approved as requested. (7:30 p.m.)
William and Mary Walker, part of Government Lot 3, Section 35 of Tordenskjold Township by Stalker
Lake, requested the following: We wish to replace our existing dwelling under the repair/replacement
policy. Currently our dwelling is 14 by 70 without a garage, with a 12’ by 12’ roofed addition being 31 feet
from the ordinary high water mark. We are proposing to replace this structure with a 28 x 52 dwelling and a
14 X 27’ 6” garage. The garage would be in the near future being approximately the same footprint as
current dwelling. The exception would be the garage being 1 foot closer to the road right-of-way. Currently
it is approximately 8 feet from right -of-way.

DECLARATION OF COVENANTS, RESTRICTIONS AND STIPULATIONS
FOR TRACTS A, B, C, & D
THIS DECLARATION is made on the date hereinafter set forth by
Mark Johnson and Tonya Johnson, husband and wife, of Pelican Rapids, Minnesota, hereinafter referred
to as “Declarants”.
WHEREAS, Declarants are the owners of certain real estate as described in Exhibit A (Legal
Description(s) To Follow Upon Completion Of Survey) and have caused to be surveyed certain real estate
located in the County of Otter Tail and State of Minnesota, the platting of which will not be required;
and
WHEREAS, the Declarants intend to subdivide and sell in separate unplatted parcels consisting
of four (4) tracts, and said four (4) tracts (identified as Tracts, A, B, C and D) are described in Exhibit
“B” (Legal Description(s) To Follow Upon Completion Of Survey) attached hereto; and
WHEREAS, the Declarants desire to place protective covenants on all of said tracts of land for
the use and benefit of themselves and for their heirs, devisees, future grantees and assigns;
THEREFORE, this Declaration of Covenants is hereby made to apply to all of the said tracts of
land to assure, through intelligent control, that said premises shall become and remain attractive non-
residential property and to uphold and enhance property values.
It is the further intent of the Declarants that all of the following covenants, restrictions and
stipulations shall, in all respects and at all times, conform to all applicable regulations, laws and zoning
ordinances of the County of Otter Tail, State of Minnesota and United States of America; therefore,
whenever any regulations, laws or zoning ordinances of the County of Otter Tail, State of Minnesota or
United States of America shall be in any way more restrictive or stringent in their requirements than the
covenants, restrictions and stipulations which follow, it is the intention and desire of the Declarants that
the said more restrictive legal and regulatory requirements shall apply and shall be adhered to in place
of any of the following covenants, restrictions and stipulations; it is also the desire of the Declarants and
owners that whenever any of the following covenants, restrictions and stipulations shall be more
restrictive than the applicable county, state or federal laws, regulations or zoning ordinances, then in
that event the stricter covenants, restrictions or stipulations hereinafter contained shall be adhered to and
shall apply to all of said tracts.

ARTICLE I - DEFINITIONS
“Owner” shall mean and refer to the record owner, whether one or more persons orSection 1.
entities, of any of said tracts including buyers under a contract for deed, but excluding those having
such interest merely as security for the performance of an obligation.
“Tract” shall mean and refer to any of the parcels subdivided from and located within theSection 2.
boundaries of the real estate described in Exhibit A. (Legal Description(s) To Follow Upon Completion Of
Survey)
Section 3. “Declarants” shall mean and refer to the individuals named above and their successors
and assigns.
ARTICLE II - MINIMUM BUILDING AND USE RESTRICTIONS
Section 1.Building Restrictions
Only non-residential structures are permitted to be situated on the tracts described
herein. No residential structures shall be permitted.

B.All structures shall comply with the regulations and applicable ordinances, laws
and regulations of the County of Otter Tail, State of Minnesota or United States of
America which shall include, but shall not be limited to, those ordinances contained
in the Shoreland Management Ordinance of Otter Tail County, Minnesota.
C.All structures shall be of new construction. The exterior shall be harmonious to the
natural and structural environment and shall be earth tone in color.
D.The exterior siding used on all structures contemplated herein shall consist of metal
siding only.
E.All structures permitted hereunder shall have either a one-foot roof overhang or a
two-foot roof overhang.
F.No Wells or septic systems shall be permitted on any tract.
G.Only one structure is permitted on any given tract.
H.The structures contemplated in this document shall not exceed 1,536 square feet.

The structures contemplated in this document shall not exceed 20 feet in height.I.

Section 2. Use Restrictions
A.All trash, debris or waste shall be promptly disposed of and no tract shall be used as
a dump ground. All waste material and debris, refuse or garbage shall be kept in
the structures contemplated herein.
B.No lot shall be subdivided.
C.No personal property of any kind shall be stored or remain upon the premise
unless enclosed at all times within a structure.
D.No animals, livestock or poultry of any kind may be housed, raised or kept on any
tract.
E.No noxious or offensive activities shall be carried on, nor shall anything be done on
any tract which may become an unreasonable annoyance or nuisance to the owners
of the tracts described herein.
F.All permitted uses must also comply with all applicable county, state and federal
ordinances, laws, rules and regulations.
ARTICLE III - GENERAL PROVISIONS
Section 1. Right to Enforce: Enforcement of these covenants, restrictions and stipulations may be by
any proceeding at law or in equity against any person or persons violating or attempting to violate any
covenant, restriction or stipulation either to restrain violation or to compel compliance, or to recover
damages, and failure by any person to enforce any covenant, restriction or stipulation herein contained
shall in no event be deemed a waiver of the right to do so thereafter. Attorneys fees and costs of any
such actions to restrain violation or to recover damages as determined by the court shall be assessable
against and payable by any person violating the terms contained herein, and shall become a lien on the
premises in which said person has an ownership interest in favor of the person or persons to whom
damages have been awarded by the court of appropriate jurisdiction, said lien to attach upon the filing
of the judgment therein or a notice of lis pendens in said court action, whichever occurs first. Said lien
shall be enforceable by foreclosure either by court order as part of said action or by separate action to
foreclose said lien in the same manner as statutory foreclosure of a mortgage by action.
Section 2.

Hi,
My name is Kevin Wegscheid and my family owns the Little Pine Lake property across the street from where
there appears to be a variance request. The hearing is on April 9^^ and the request is by Robin and Jennifer
Hanson (I think). The variance appears to be splitting the one property into 4 parcels. It also mentions
storage units to be constructed.
I am curious as to why the 1 acre would need to be re-zoned to 4 parcels to put in a storage unit. Can you
help me understand? Also, is that parcel zoned in such a way that it accommodates businesses?
I am surprised to hear that someone is considering putting storage units on that property across from the
lake. My family (Rosenthal and Walz) have been on Little Pine as far back as I can remember and we all love
the serenity. It seems unusual that something like a storage facility would be located across from residential
when Perham area has so many other locations that could be used for such a business. I was wondering if
you could help me locate any information on this proposal. I’ve searched the web and I’ve come up short on
finding any re-zoning or any other plans for this activity.
