Motion by Lindquist, second by Rogness, and unanimously carried to approve payment of the County
Board bills per Attachment A of these minutes.
Preliminary 2010 Budget and Lew Discussion
Auditor, Wayne Stein, reported that the Otter Tail County proposed levy and budget must be adopted
today. He provided a lengthy briefing and power point presentation regarding Department of Revenue
requirements, special levy information, use of reserves to reduce building debt, and various examples
that could be used for the preliminary budget.
Planning Commission Recommendations
Conditional Use Permit - “Barky’s Resort’/Marc & Kathy Gruenenwald:
Motion by Froemming, second by Lindquist, and unanimously carried to approve a Conditional Use
Permit to replace a mobile home on the resort with a condition as recommended by the Planning
Commission. The property is described as Pt of GL 3, Section 32 of Amor Township; Otter Tail Lake
(56-242), GD.
Conditional Use Permit - Thomas Meinhover & D. Gluesina:
Motion by Huebsch, second by Rogness, and unanimously carried to approve a Conditional Use
Permit for a commercial business with a condition as recommended by the Planning Commission.
The property is described as N1/2 NE1/4 E of Twp Rd ex Plat (39.36 AC), Section 35 of Rush Lake
Township; Rush Lake (56-141), GD.
Wind Tower Discussion:
Land & Resource Director, Bill Kalar, briefed the Board regarding the Planning Commission’s
discussion regarding wind towers. As stated in the Planning Commission minutes, the following items
should be addressed on the Conditional Use Application when approval to install a wind tower is
being considered; 1) The proposed size - a maximum of 20 kwl (for residential use). 2) The
proposed setback(s) to lotline(s), shore impact zone & road right-of-way - 1 x’s the height + 10’. 3) A
proposed Decommissioning Plan. Mr. Kalar stated that these additions would require an amendment
to the Shoreland Management Ordinance or a separate countywide ordinance dealing with wind
towers could be drafted.
Conditional Use Permit - William J. Boediaheimer
Motion by Huebsch, second by Rogness and carried, with Erickson opposed because an ordinance
has not been adopted, to approve a Conditional Use Permit to erect a wind tower with a condition as
recommended by the Planning Commission. The property is described as Pine Lake Shores Lot 3
BIk 1, Section 35 of Gorman Township; Little Pine Lake (56-142), GD.
Conditional Use Permit - Rov Stoerina:
Motion by Huebsch, second by Rogness, and unanimously carried to approve a Conditional Use
Permit for topographical work for a building site as requested. The property is described as R of
GL 3, (11.10 AC), Section 7 of Dead Lake Township; Star Lake (56-385), GD.

Discussion - Wind Towers: Bill Kalar discussed with the Commission the considerations
identified used in the Shoreland Management Ordinance when reviewing Wind Towers.
The Commission continued this discussion at the end of the Meeting.

Bruce Stoddard recommended approval of the proposal, stating energy from a wind tower

Michael & Judy Herzog - Tabled To November 18, 2009:
A Conditional Use Permit Application (as stated by the Applicant): For purpose of a site for
building (40’ x 60’). Cut down hill for driveway into building site and put to south side for fill.
Grade height is existing driveway. Remove stumps. The property is described as Pt GL 3
(2.5 AC), Section 26 of Dead Lake Township; Dead Lake (56-383), NE.
Judy & Michael Herzog, and Roy Stoering (contractor) represented the Application.
Dennis Reynolds expressed concerns regarding a bluff onsite and water run-off onto his
property and the other neighbor’s property. Chuck Proels expressed concerns regarding
water run-off onto his property.
Motion: A motion by Trites, second by Maske to table, at the Applicant’s request, to the
November 18, 2009 Meeting (material must be received by October 30, 2009) allowing the
Applicant to recalculate their impervious surface and provide an engineer’s certified run
off plan. Voting: All members in favor.
Break: At 8:10 the Commission took a 10 minute break.
Roy Stoering - Approved As Presented:
A Conditional Use Permit Application (as stated by the Applicant): Remove fill from south side
of said line to be put on north side. Bring fill from one side to other for purpose home 40’ x

Bob Honer indicated he has no objections to the request. Mike Holan had questions
regarding Dead Lake Township’s letter and their proposal of relocating Beaver Dam Road.

Motion by Erickson, second by Lindquist, to deny a Conditional Use Permit to erect a 70’ wind tower
and turbine for electrical generation at the Daniel & Betty Strang property as presented. Chairman
Erickson called for a roll call vote. The motion failed with Lindquist and Erickson in favor, Huebsch
and Froemming opposed and Rogness abstaining.

regarding tabling the request. Motion by Huebsch, second by Froemming, and carried with Erickson
opposed, to table the Conditional Use Permit requests of Daniel & Betty*Strang and Thomas &
Georgette Wegscheid until October 1, 2009, with agreement from the applicants to waive the 60-day
notice rule. Tabling will allow time to provide direction on how to apply theiguidelines. The CUP
requests will be scheduled for reconsideration at the County Board meeting on September 29, 2009.

jjT Ckftiditional Use Permit - Thomas & Georgette Weascheid:'^^j^and & Resource Director, Bill Kalar, stated that these two requests are for approval of wind turbines.
The Planning Commission recommended denial of both requests. He conveyed the message from
the Planning Commission that the 16 considerations in the Shoreland Management Ordinance when
determining approval of a Conditional Use Permit may not be adequate or specific enough for the
consideration of putting up wind towers. They suggested that the County Board develop guidelines
for consideration of wind towers in the shoreland area and place a moratorium on towers until the
guidelines can be developed. Commissioner Lindquist spoke in favor of a moratorium.
Commissioner Rogness was opposed to a 6 month moratorium. Commissioner Huebsch spoke in
opposition of a moratorium because wind towers are being supported at the federal and state levels
and Otter Tail County needs to be a part of the economic development. Commissioner Froemming
offered his observations of a local farmer’s wind tower and noted that there was no noise. County
Attorney, David Hauser, stated that this can be studied without a moratorium and that people who
have applied for a CUP must be considered based on the rule at the time of application.
Commissioner Huebsch visited the Daniel and Betty Strang site and attended the local Lake
Improvement Districtknnual meeting and no one was opposed to their request for a wind tower. He
felt it should not be denied simply based on the fact that it is near a lake. Applicant Daniel Strang
urged the County Board to approve the request and responded to the reasons for denial identified by
the Planning Commission and noted that timing is important because of State funding.

tower and turbine for electrical generation at the Daniel & Betty Strang property as presented.

Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at
6:30 p.m.
Minutes Approved -
The Board of Adjustment approved the minutes of the April 5, 2007 meeting as mailed.
The Board of Adjustment considered the following applications for variance:
Ray DeBoever- Denied. (6:32 p.m.)
Ray DeBoever, Lot 17 Clearmont Beach and Lot 2 Sandy Shore Development, Otter Tail Lake in Everts
Township, requested a variance to change the variance granted May 4, 2006. Separate Lot 2 Sandy
Shores Development from Lot 17 Clearmont Beach. At present a machine shed (30’ by 40’) and a small
cabin (14’ by 15’ shack) on blocks are on Lot 2, which is 100’ by 250’. Lot 17 Clearmont Beach is a bare
lot measuring 75’ lakeshore by 150’. A 55’ road separates Lot 2 and Lot 17. I pay County sewer on both
lots, plus nearly $1,000 in taxes on Lot 17, which at present is a lot that cannot be utilized. The audience
was polled with no one speaking for or against the variance as requested. Letters from Kathleen Hoeft,
Bruce Monson, Marilee Tischer and Laurie Woessner and an email from Kevin and C. Kay Berger in
support of the variance as requested was read for the record. After consideration and discussion, Steve
Schierer made a motion, second by Joe Maske and unanimously carried, to deny the variance as
requested as no adequate hardship unique to the property had been shown that would allow for the
granting of the variance as requested and the requested variance is not necessary for the applicant to have
a reasonable use of his property.

power generation. This structure is a combined 40’ tall. I would like a variance for the 5’ over the 35’ limit.
